SAN DIEGO (FOX 5/KUSI) — The San Diego City Council unanimously passed a new law to restrict ICE agents in San Diego.

In the wake of increased ICE activity in San Diego, city council leaders unanimously passed a new law 8-0 during its Tuesday meeting.

“I have been a 25-year U.S. citizen, and today I carry my passport card with me everywhere because I am afraid of being taken, deported, without due process,” one San Diegan said during public comment.

The Due Process and Safety Ordinance is as follows:

Requiring federal and out-of-state law enforcement to have a judicial warrant to gain access to non-public city-controlled property

Prohibiting the city from supporting discriminatory/unauthorized enforcement actions that target people based on protected characteristics

Protecting residents’ data privacy from public systems

Creating multilingual “Know Your Rights” programs at city and city-funded facilities

And extending protections to city contractors, lessees and grantees

“Having those laws on the books, it’s not again just a statement of the way we feel, but it’s actually saying this is the official position of the city, in a way that has teeth,” Councilmember Sean Elo-Rivera said.

The Trump administration has been vocal against cities that limit cooperation with ICE.

“I think that the Trump administration should do more to be lawful and do less finger-pointing and ranting about the actions of cities like San Diego to stand up for the rights of our residents,” Elo-Rivera said.

While some don’t agree with the city council’s decision, Elo-Rivera wishes the law could go even further.

“I can’t protect all people in all places, but what we can do is say if you are on city property, are on private space of the city,” Elo-Rivera said. “Then you’re damn right there’s going to be certain expectations for what happens in our spaces.”

The approved ordinance now heads to Mayor Todd Gloria’s desk. Once he signs it, it will go into effect in 30 days.
