BAKERSFIELD, Calif. (KGET) — Former Kern County supervisor Zack Scrivner remains in compliance with the terms of his mental health diversion program as of Thursday.

Superior Court Judge Marcos Camacho, Joseph Penney with the state Attorney General’s Office and Scrivner’s attorney H.A. Sala all agreed he was in compliance during a diversion hearing Thursday morning.

Sala said Scrivner is “doing exceptionally well” in the diversion program.

The next hearing is set for June 4.

On April 23, 2024, Scrivner took mind-altering substances before getting in bed with and allegedly touching his underage daughter, according to the state Attorney General’s Office.

He also illegally possessed an AK-47 style rifle and an AR-15 style rifle, prosecutors said.

The Attorney General’s Office took the case because Kern County’s district attorney is Cynthia Zimmer, Scrivner’s aunt.

The AG’s Office charged Scrivner with three counts of child endangerment and two counts of possession of an assault rifle, but not a sex offense, which allowed him to seek and be granted the mental health diversion.

Scrivner was granted entry to the diversion program in December.

If he completes all requirements in the diversion program, his case could get dismissed without any jail time or prosecution.

Robert Scrivner, Zack Scrivner’s son, said his father molested his younger sibling. Robert Scrivner said he and his brother then got in an altercation with Zack Scrivner to take a firearm away from him, getting injured in the process.

On Tuesday, state Senator Shannon Grove’s bill to reform mental health diversion passed the state Public Safety Committee. It is expected to continue moving through the legislature.

Asm. Jasmeet Bains also proposed three bills related to the Scrivner case: the SCRIVNER Act, the Epstein Loophole Act and the Mental Health Diversion Reform Act. The SCRIVNER Act and the Epstein Loophole Act passed Tuesday.
