OAKLAND — Prosecutors dismissed the case against a man suspected of assisting an accused killer’s getaway last year, after determining they wouldn’t be able to hold a key pretrial hearing before its legally mandated deadline.
Kalif Collins, 25, was charged with being an accessory to murder in the May 11, 2025 killing of 30-year-old Daesjhon Grayson. Prosecutors had alleged Collins drove the murder suspect, 26-year-old Zairy Rubio, away from the scene and later falsely reported his car stolen.
At a Jan. 26, hearing, the Alameda County District Attorney’s office threw out the case, citing a penal code that applies when the prosecution fails to hold a preliminary hearing within a 60-day time limit, court records show. The case against Rubio remains active, with one significant holdup: police don’t know where he is.
The two were charged last year — Rubio with murder and Collins with accessory — but Rubio still remains listed as a fugitive and has not been arraigned, court records show. Collins was out on $30,000 bail when his charges were dismissed.
Grayson was shot and killed about 10 minutes before midnight on May 11, 2025, on the 600 block of 16th Street in Oakland, near a shelter where Grayson allegedly lived, authorities said at the time.
