A judge has sided with the City of Fresno in a lease dispute involving Granite Park, clearing the way for the city to take immediate possession of the property.
During pretrial proceedings, the court interpreted the lease agreement between the City of Fresno and Central Valley Community Sports Foundation for the Granite property consistent with the city’s interpretation.
The parties stipulated that there was at least one material breach of the lease, which entitles the city to take immediate possession of Granite Park.
The city pursued legal action after what it described as multiple defaults, including nonpayment of billboard revenue, which the tenant admitted to during a deposition.
The city also said Central Valley Community Sports Foundation did not have appropriate insurance coverage to protect the city from claims arising from the tenant’s operation of the park.
“I’m pleased the judge validated the City’s position that CVCSF violated its lease,” City Manager Georgeanne White said. “I look forward to moving on from this saga and ensuring that Granite Park is a resource for our residents.”
