RAPID CITY, S.D. (KOTA) – South Dakota Attorney General Marty Jackley has joined a multi-state lawsuit challenging a California law that regulates plastic packaging and related materials used by manufacturers and distributors.
The lawsuit targets California’s Plastic Pollution Prevention and Packaging Producer Responsibility Act, which the coalition argues places significant requirements on companies that manufacture, package or ship products using plastic materials.
According to state officials, businesses that do not comply with the law could face restrictions on selling products in California.
“This Act imposes unreasonable, burdensome requirements on businesses and consumers nationwide,” Jackley said in a statement. “This is an unconstitutional mandate that will result in higher costs for businesses and ultimately higher prices for consumers.”
South Dakota is one of 17 states participating in the lawsuit. Other states involved include Nebraska, North Dakota, Iowa, Texas, Florida, Georgia and Utah.
The lawsuit was announced Tuesday by the South Dakota Attorney General’s Office.
