The United States Department of Justice is suing the city of San Jose, saying its $1,600 gun permit fee is unconstitutional.
San Jose’s gun permit application fee is the highest in the nation.
The federal government said charging private individuals that “exorbitant fee” violates the Second Amendment. Feds claim it denies citizens their right to carry firearms for self-defense.
NBC Bay Area reached out to San Jose Mayor Matt Mahan for comment but did not immediately hear back.
The San Jose Police Department was also named in the lawsuit. The department does not comment on pending litigation.
