Sacramento County prosecutors to retry K Street shooting suspects
SACRAMENTO, Calif. —
The two men accused in the K Street shooting are headed back to court, as prosecutors are retrying the case after the first trial ended in a mistrial.
The Sacramento County District Attorney’s Office said the next court date for Dandrae Martin and Mtula Payton is set for Jan. 7, 2027.
Prosecutors didn’t confirm what new charges the two men are facing.
The April 3, 2022, shooting left six people dead and 12 others injured along downtown’s K Street corridor. The first trial ended in a mistrial after the jury was unable to reach a unanimous decision.
Although six people were killed in the shooting, only three are considered victims because of a California law that states anyone who participates in a shooting that injures or kills someone is not a victim.
Martin and Payton are the two surviving suspects in the case. Dandrae’s brother, Smiley Martin, was also arrested, but he died in custody in 2024.
During the first trial, prosecutors dropped first-degree murder charges after the jury was unable to reach a unanimous decision. The jury returned to deliberate second-degree murder charges, but could still not come to a verdict.
However, Dandrae Martin and Payton were convicted on their weapons charges for being felons in possession of firearms.
The victims in the K Street shooting
The three victims were 21-year-old Johntaya “JoJo” Alexander, 57-year-old Melinda Davis, and 21-year-old Yamile Martinez-Andrade.
Sergio Harris, DeVazia Turner and Joshua Hoye-Luchessi also died in the shooting, but California law does not consider people who participated in gunbattles that result in death or injury to be victims.
