{"id":100603,"date":"2025-12-19T03:21:11","date_gmt":"2025-12-19T03:21:11","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/100603\/"},"modified":"2025-12-19T03:21:11","modified_gmt":"2025-12-19T03:21:11","slug":"san-francisco-moves-to-create-reparations-fund-despite-legal-concerns","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/100603\/","title":{"rendered":"San Francisco moves to create reparations fund &#8212; despite legal concerns"},"content":{"rendered":"<p>Woke San Francisco lawmakers unanimously voted to create a reparations fund for the city\u2019s small black community \u2014 despite claims that the plan could run afoul of the Constitution.<\/p>\n<p>The San Francisco Board of Supervisors voted on Tuesday to establish the fund to benefit black residents who suffered discrimination under city policies.<\/p>\n<p>The fund will tap private donations and city money appropriated to it to provide services and potentially cash payouts up to $5 million, according to one eye-popping proposal <a href=\"https:\/\/nypost.com\/2023\/01\/16\/sf-reparations-panel-proposes-5m-lump-sum-payment-to-eligible-residents\/\" rel=\"nofollow noopener\" target=\"_blank\">floated in 2023<\/a>.<\/p>\n<p>The reparations are meant to \u201cprovide restitution, compensation, and rehabilitation to individuals<br \/>who are Black and\/or descendants of a chattel enslaved person and have experienced a proven harm in<br \/>San Francisco,\u201d according to the bill.<\/p>\n<p>\u201cI think it is horrendously unlawful. AP<\/p>\n<p>\u201cThe ordinance has a very explicit racially discriminatory purpose,\u201d he added.<\/p>\n<p>Quinio said under laws like the 14th Amendment of the Constitution and California\u2019s Prop. 209, governments can\u2019t discriminate on the basis of race or other protected characteristics \u2014 even if private funds are used. <\/p>\n<p>The reparations fund would be run by San Francisco\u2019s Human Rights Commission, which fell into scandal last year after a top official was accused of skimming funds from a similar initiative\u00a0to pay for\u00a0a spa retreat, parties, her podcast \u2014 and even her son\u2019s UCLA tuition.<\/p>\n<p>A reparations panel in 2023 issued a report making dozens of recommendations, ranging from $5 million cash payouts and affordable housing to income subsidies and tax abatements for 250 years. <\/p>\n<p>That report will be \u201ccentral\u201d to the reparations fund, according to a Human Rights Commission spokesperson. <\/p>\n<p>Local conservative activist Richie Greenberg blasted the reparations plan as the product of \u201cshoddy research.\u201d<\/p>\n<p>\u201cAs a result, they rubber-stamped a horrendous, unworkable and unlawful mess,\u201d he raged.<\/p>\n<p><img style=\"aspect-ratio:1.49926794;display:block\" loading=\"lazy\" decoding=\"async\" data-modal-image=\"37968711\" width=\"885\" height=\"590\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2025\/12\/2023-supervisors-san-francisco-taking-8252052.jpg\" alt=\"Supervisor Shamann Walton speaks at a reparations rally outside of San Francisco City Hall.\" class=\"wp-image-37968711\"  \/>Supervisor Shamann Walton speaks at a reparations rally outside of City Hall in San Francisco. AP<\/p>\n<p>Advocates argue the city\u2019s history of redlining and razing homes owned by black families during redevelopment decades ago have caused long-term damage to the community, which has shrunk considerably to some 5% of the city population. <\/p>\n<p>\u201cThis is not the end-all, be-all of what we have to do in San Francisco,\u201d said Supervisor Shamann Walton, who wrote the reparations bill, at a Dec.1. committee meeting. <\/p>\n<p>Mayor Daniel Lurie\u2019s office did not respond to The Post about whether he plans to sign the bill.<\/p>\n<p>This isn\u2019t San Francisco\u2019s first foray into reparations. <\/p>\n<p>In 2023, Walton asked for $50 million from the city\u2019s shrinking budget to create an Office of Reparations \u2014 but was rebuffed by former mayor London Breed. <\/p>\n<p>Breed instead pushed resources to the Dream Keeper Initiative, an ill-fated, $120 million program to support the city\u2019s black community, which has struggled with high rates of homelessness, drug abuse, and poverty.<\/p>\n<p>\t\t\t\t\t\t\tNeed West Coast news?
