A federal judge in San Diego ruled that California\u2019s policies allowing schools to hide students\u2019 gender transitions from their parents is unconstitutional, issuing a permanent injunction on the controversial practice. <\/p>\n

Teachers Elizabeth and Mirabelli and Lori West, both Christians, brought the lawsuit in response to California Department of Education policies that required them to conceal children\u2019s gender transitions<\/a> \u2013 including adopting a new name and pronouns<\/a> \u2013 from their families, absent explicit permission from the child.<\/p>\n

In 2024, Gov. Gavin Newsom signed a law that generally barred public schools from requiring employees to reveal information about kids\u2019 gender identity or expression from parents without the student\u2019s consent. Getty Images<\/p>\n

Mirabelli and West were placed in the \u201cimpossible\u201d position, attorneys argued, of lying in violation of their faith and personal ethics. <\/p>\n

U.S. District Court Judge Roger T. Benitez agreed, writing in a decision issued Monday that California parents are \u201cleft in the dark\u201d about something as significant as their child\u2019s gender identity. <\/p>\n

\u201cEven if the State Defendants could demonstrate that excluding parents was good policy on some level, such a policy cannot be implemented at the expense of parents\u2019 constitutional rights,\u201d Benitez wrote.<\/p>\n

Advocates of the gender secrecy<\/a> law, who included Attorney General Rob Bonta and state lawmakers, argued the policy was necessary to protect children from a \u201cforced outing\u201d that could cause bullying and harassment at home. <\/p>\n

Bonta went so far as to sue Chino Valley Unified School District in 2023 for a policy that required sharing students\u2019 transitions with parents if they adopted new names of pronouns or requested access to facilities like bathrooms not aligned with their biological sex. <\/p>\n

Bonta and the California Department of Education did not immediately respond to a request for comment. <\/p>\n

Critics quickly slammed the state policies as a violation of parents\u2019 right to know what\u2019s happening with their children. <\/p>\n

\u201cThe State knew this was a losing legal battle and tried to pull out every lawyer\u2019s trick in the book to avoid responsibility,\u201d\u00a0said Jeffrey M. Trissell, counsel at Thomas More Society and attorney at LiMandri & Jonna LLP, in a statement. <\/p>\n
