Jenkins)<\/p>\n<p>Millions of California residents are about to get <a href=\"https:\/\/www.npr.org\/sections\/shots-health-news\/2025\/02\/18\/nx-s1-5301201\/trump-executive-order-ivf-in-vitro-fertilization\" rel=\"nofollow noopener\" target=\"_blank\">access to in vitro fertilization<\/a>, or IVF, services in the new year.<\/p>\n<p>As of Jan. 1, 2026, a new law \u2014 <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240SB729\" rel=\"nofollow noopener\" target=\"_blank\">California Senate Bill 729<\/a> \u2014 will require some health insurance plans to cover infertility diagnosis and treatment, including IVF. <\/p>\n<p>The law will require some insurance plans to cover infertility treatment as they do basic medical needs. It is described as a \u201cfirst stepping stone\u201d toward closing the gap between people who want to build families and <a href=\"https:\/\/timesofsandiego.com\/life\/2022\/10\/22\/san-diego-moms-fertility-financing-now-available-with-0-interest-for-12-months\/\" rel=\"nofollow noopener\" target=\"_blank\">the high costs that once blocked them<\/a>.<\/p>\n<p>The bill prohibits discrimination in coverage based on sexual orientation, gender, or marital status. It applies to most small- and large-group insurance plans, with exemptions for some religious employers.<\/p>\n<p>To qualify for this bill, the state mandate requires insurance plans to meet three criteria: they must be fully insured, under a large group plan, and written in California. Though the bill will eliminate most of the costs of infertility diagnosis and treatment, it won\u2019t eliminate all of them.<\/p>\n<p>\u201cCoverage doesn\u2019t mean no patient financial responsibility. The infertility care is still subject to co-pays, deductibles, co-insurance, and out-of-pocket maximums,\u201d said Shannon Taylor, the Insurance Administrator at <a href=\"https:\/\/www.fertilityclinicsandiego.com\/\" rel=\"nofollow noopener\" target=\"_blank\">Reproductive Partners Fertility Center in San Diego<\/a>.<\/p>\n<p>Patients will still be responsible for co-pays, deductibles, co-insurance, and out-of-pocket maximums, just as with any other healthcare service.<\/p>\n<p>But the mandate won\u2019t cover people who live in California but who have insurance plans written out of state, or people who are on self-funded or self-insured plans. The law also leaves out anyone on smaller employer plans, Medi\u2011Cal, military coverage, and some others.<\/p>\n<p>But for many patients, the law will turn previously hypothetical or unaffordable options into realistic paths to parenthood.<\/p>\n<p>\u201cSo many of them (patients) are already so excited\u2026 They\u2019re relieved,\u201d Taylor said.<\/p>\n<p>The fertility treatments covered will include IVF, Intrauterine Insemination (IUI), and Frozen Embryo Transfers (FET). Since IUIs are considered a lower\u2011intensity first\u2011line treatment, they are unlimited under the bill.<\/p>\n<p>\u201cIf you are successful with one IVF cycle, and you have several embryos available, you can transfer them until they\u2019re gone under this benefit, which is incredible,\u201d Taylor said.<\/p>\n<p>Infertility diagnosis and drugs for IUI, IVF, and FET are also covered if a patient\u2019s plan qualifies. IVF medications stop being covered after the third egg retrieval.<\/p>\n<p>For many, fertility treatment requires multiple attempts for desired results. Having coverage for repeated IUIs and several IVF cycles aligns with real\u2011world medical needs.<\/p>\n<p>\u201cFrom my perspective, I think the most significant change this brings is that it restores hope,\u201d Taylor said. \u201cIt allows more Californians to hope once they find out that they\u2019re infertile, and it gives them ample opportunities to continue to try to build their family.\u201d<\/p>\n<p>Taylor described one patient who was already sorting through their insurance rules before recognizing her plan would cover infertility treatment in January. She paused her treatment for two months, and decided to restart under the new law. Taylor said her patient broke down in tears over the size of financial relief she received.<\/p>\n<p>Still, Taylor said patients should review their insurance plan details to determine whether they meet the mandate criteria.
