How would San Francisco take over PG&#038;E assets?"},"content":{"rendered":"<p class=\"paragraph-block article-body undefined text-left\">San Franciscans were hit with their <a href=\"https:\/\/sfstandard.com\/2026\/01\/02\/pge-outage-richmond-blackout-sea-cliff\/\" data-post-id=\"ccc0aed9-7297-4df4-8210-b71c9fa0e633\" rel=\"nofollow noopener\" target=\"_blank\">sixth power outage in less than a month,<\/a> just two days into the new year.\u00a0\u00a0<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">The prolonged blackouts left people with medical complications <a href=\"https:\/\/sfstandard.com\/2025\/12\/22\/pg-e-blackout-san-francisco-power-outage\/\" data-post-id=\"12af653b-e7a8-44c5-99f6-b71a9e10df87\" rel=\"nofollow noopener\" target=\"_blank\">stranded at home<\/a> while businesses <a href=\"https:\/\/sfstandard.com\/2025\/12\/22\/sf-restaurants-suffer-lost-sales-wasted-food-pge-blackout-\/\" data-post-id=\"e34cafd5-94cb-4464-a6cb-df4393776618\" rel=\"nofollow noopener\" target=\"_blank\">lost tens of thousands of dollars<\/a> in spoiled inventory and lost sales during the busy holiday season. Across the city, people had one main target for their ire: Pacific Gas &amp; Electric Company, the city\u2019s main power provider for more than 120 years.\u00a0<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">State Sen. Scott Wiener took the opportunity to <a href=\"https:\/\/sfstandard.com\/2025\/12\/22\/san-francisco-pge-public-power-eminent-domain\/\" data-post-id=\"56a6efc0-4769-4ccc-9209-fc9668dc7a4b\" rel=\"nofollow noopener\" target=\"_blank\">renew his efforts<\/a> to break up with the utility giant through legislation. Meanwhile, one of his opponents in the race to fill Nancy Pelosi\u2019s congressional seat, Saikat Chakrabarti, <a href=\"https:\/\/www.reddit.com\/r\/sanfrancisco\/comments\/1pz2swo\/saikat_chakrabarti_for_congress_san_francisco\/?share_id=6eFdDBjEf5KmVUSfSU7ZX&amp;utm_content=1&amp;utm_medium=ios_app&amp;utm_name=ioscss&amp;utm_source=share&amp;utm_term=1\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">took to social media (opens in new tab)<\/a> to declare that, rather than wait, San Francisco could just use its legal authority to \u201cseize PG&amp;E\u2019s infrastructure now and switch to public power.\u201d\u00a0<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">Eminent domain \u2014 the government\u2019s mechanism to force the sale of private property for public use \u2014 has emerged as a rallying cry for critics of PG&amp;E\u2019s monopoly and residents fed up with repeated blackouts. Supporters argue that if San Francisco took control of the utility\u2019s local infrastructure, the city could prioritize reliability over profits sent to outside investors.<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">The power has been used to commandeer land <a href=\"https:\/\/sfstandard.com\/2025\/09\/12\/gavin-newsom-climate-housing-transit\/\" data-post-id=\"ad7af151-ff38-4ad7-b3e5-899801ecc069\" rel=\"nofollow noopener\" target=\"_blank\">for the high-speed rail project <\/a>and is commonly employed for the construction of new power lines or sidewalks. But Brad Kuhn, a partner at Nossaman LLP who leads the firm\u2019s <a href=\"https:\/\/www.nossaman.com\/practices-Eminent-Domain-Inverse-Condemnation\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Eminent Domain practice, (opens in new tab)<\/a> said it\u2019s rarely been used successfully to take over an existing private utility.<\/p>\n<p><img alt=\"Cars with headlights and taillights create dense traffic along intersecting city streets at night.\" loading=\"lazy\" width=\"5280\" height=\"3956\" decoding=\"async\" data-nimg=\"1\" class=\"block lazyloaded\" style=\"color:transparent;background-size:cover;background-position:50% 50%;background-repeat:no-repeat;background-image:url(&quot;data:image\/svg+xml;charset=utf-8,%3Csvg xmlns='http:\/\/www.w3.org\/2000\/svg' viewBox='0 0 5280 3956'%3E%3Cfilter id='b' color-interpolation-filters='sRGB'%3E%3CfeGaussianBlur stdDeviation='20'\/%3E%3CfeColorMatrix values='1 0 0 0 0 0 1 0 0 0 0 0 1 0 0 0 0 0 100 -1' result='s'\/%3E%3CfeFlood x='0' y='0' width='100%25' height='100%25'\/%3E%3CfeComposite operator='out' in='s'\/%3E%3CfeComposite in2='SourceGraphic'\/%3E%3CfeGaussianBlur stdDeviation='20'\/%3E%3C\/filter%3E%3Cimage width='100%25' height='100%25' x='0' y='0' preserveAspectRatio='none' style='filter: url(%23b);' href='data:image\/gif;base64,R0lGODlhAQABAAAAACH5BAEKAAEALAAAAAABAAEAAAICTAEAOw=='\/%3E%3C\/svg%3E&quot;)\"   src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2026\/01\/-S3840x2877-FPNG.png\"\/>A view of traffic from above when more than 130,000 PG&amp;E customers were without power on Dec. 20, 2025. | Source: Tayfun Coskun\/Anadolu\/Getty Images<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">\u201cThe utilities are always going to put up a massive fight since this pertains to their lifeblood,\u201d Kuhn said. \u201cThe biggest challenge the public agencies face is proving that there is a more necessary public use \u2014 essentially that they would operate things better or more efficiently than the investor-owned company.\u201d\u00a0<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">Regardless of the outcome, a San Francisco effort would be hugely expensive and take years, likely outlasting current political terms and residents\u2019 immediate frustrations.<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">Kuhn could not comment specifically on the potential takeover involving San Francisco and PG&amp;E since his firm represents the city on separate matters, but provided insight from his two decades guiding public agencies and property owners through the process.\u00a0<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">\u201cThese takeovers last multiple years,\u201d he said, adding that even if successful, public agencies are not entitled to have their attorney fees recovered afterwards. \u201cIt\u2019s all coming out of pocket.\u201d\u00a0<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">That could add millions of additional dollars to the billions it would already take to purchase PG&amp;E\u2019s infrastructure.<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">A price tag far beyond power lines<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">Should San Francisco decide to go down this path with PG&amp;E, at least two-thirds of the Board of Supervisors would have to vote in favor of authorizing eminent domain actions. If a purchase agreement cannot be reached with the property owner \u2014 more than likely in the case of PG&amp;E \u2014 then the city would have to file a lawsuit in court to establish its justification.<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">In order to force a sale, the city would have to successfully prove the necessity of such an action in court and pay PG&amp;E fair market value for its assets and loss of business. The property owner can contest or dispute any findings made by the city in the subsequent trial.<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">\u201cInvestor-owned utilities can argue that they\u2019ve been providing services for decades, and thus, have the expertise and resources to be more efficient than a public agency that doesn\u2019t have the know-how,\u201d Kuhn said, adding that private providers are also regulated by the California Public Utilities Commission and already have to secure approvals for rate increases.\u00a0<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">\u201cPG&amp;E has had the privilege and honor of serving the residents of San Francisco for more than 100 years, and we remain committed to serving San Franciscans for years to come,\u201d a representative for the utility said in a previous statement, claiming the city had previously failed to \u201cspecifically identify\u201d the assets it wanted to take and adequately explain the plan to regulators.<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">Appraisals wouldn\u2019t just include the cost of buying PG&amp;E\u2019s substations or power lines. Other aspects that would need to be litigated include: How much of the existing system is the city taking over? How do portions of the system severed from the rest get addressed? Do existing employees who support those portions lose their jobs? Oftentimes, private utilities will value their assets 10 to 20 times more than what public agencies will bid.\u00a0<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">Right now, the California Supreme Court is in the midst of considering a significant case \u2014 <a href=\"https:\/\/law.justia.com\/cases\/california\/court-of-appeal\/2025\/e078348.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Town of Apple Valley v. Liberty Utilities (opens in new tab)<\/a> \u2014\u00a0that would determine how the courts handle future eminent domain cases and what barriers each side would have to overcome in litigation.\u00a0<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">If the town of Apple Valley prevails later this year, then public agencies will get more deference from the courts when citing their findings and appraisals, Kuhn explained. However, if Liberty wins, then each new eminent domain case would be subject to heightened judicial review and scrutiny.<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">If those valuations ever get agreed upon, how the city of San Francisco, which is facing a <a href=\"https:\/\/sfstandard.com\/2025\/12\/12\/san-francisco-daniel-lurie-budget-donald-trump-layoffs\/\" data-post-id=\"64eea6d8-f5ca-426b-81fb-5d9404dea334\" rel=\"nofollow noopener\" target=\"_blank\">worsening budget deficit<\/a>, would finance a multibillion-dollar transaction is an entirely different matter. Most cities would have to put forth another bond measure, Kuhn said, in essence raising taxes on residents to pursue the effort.\u00a0<\/p>\n<p class=\"paragraph-block article-body undefined text-left\">Officials at City Hall and the San Francisco Public Utilities Commission have led exploratory efforts to take over the city\u2019s share of the PG&amp;E grid in years past.
