{"id":133805,"date":"2026-01-14T22:49:08","date_gmt":"2026-01-14T22:49:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/133805\/"},"modified":"2026-01-14T22:49:08","modified_gmt":"2026-01-14T22:49:08","slug":"prop-50-appeals-court-rejects-republican-bid-to-block-california-maps-california","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/133805\/","title":{"rendered":"Prop 50: appeals court rejects Republican bid to block California maps | California"},"content":{"rendered":"<p class=\"dcr-130mj7b\">A federal appeals panel on Wednesday upheld the <a href=\"https:\/\/www.theguardian.com\/us-news\/california\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">California<\/a> ballot initiative that allows temporary changes to congressional district maps designed to benefit Democrats in upcoming elections.<\/p>\n<p class=\"dcr-130mj7b\">The measure, known as <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/nov\/05\/california-proposition-50-explainer\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Proposition 50<\/a>, emerged in response to actions taken in Texas, where Republican leaders sought to adjust congressional districts to increase GOP representation in the US House. As the midterm elections approach, a period when shifts in party control are common, Trump urged Texas officials to redraw their maps to boost Republican seats.<\/p>\n<p class=\"dcr-130mj7b\">In response, Governor <a href=\"https:\/\/www.theguardian.com\/us-news\/gavin-newsom\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Gavin Newsom<\/a> and other Democratic leaders in California pushed for a special statewide vote. The election asked residents whether the state should adopt interim district maps aimed at flipping five Republican-held districts, including one formerly represented by the late congressman Doug LaMalfa.<\/p>\n<p class=\"dcr-130mj7b\">After voters approved Prop 50, Republican opponents challenged the maps in court. They argued that the initiative violated the Voting Rights Act by intentionally crafting districts to advantage Hispanic and Latino voters.<\/p>\n<p class=\"dcr-130mj7b\">The judges, however, rejected that argument in a 2\u20131 ruling on Wednesday. Supporters and critics of the measure now expect the dispute to advance to the US supreme court, which previously allowed Texas\u2019s revised district lines to stand.<\/p>\n<p class=\"dcr-130mj7b\">\u201cRepublicans\u2019 weak attempt to silence voters failed,\u201d Newsom said in a <a href=\"https:\/\/www.gov.ca.gov\/2026\/01\/14\/governor-newsom-on-republicans-failed-attempt-to-silence-voters\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">statement<\/a> shortly after the ruling. \u201cCalifornia voters overwhelmingly supported Prop 50 \u2013 to respond to Trump\u2019s rigging in Texas \u2013 and that is exactly what this court concluded.\u201d<\/p>\n<p class=\"dcr-130mj7b\">In the <a href=\"https:\/\/htv-prod-media.s3.amazonaws.com\/files\/prop-50-injunction-denial-69680662c674c.pdf\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">majority opinion<\/a> denying a request to pause implementation of the maps, the judges wrote: \u201cThe United States fails to show that the voters acted with discriminatory intent.\u201d<\/p>\n<p class=\"dcr-130mj7b\">The supreme court ruling that partisan gerrymandering claims are not subject to judicial review means <a href=\"https:\/\/www.theguardian.com\/us-news\/republicans\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Republicans<\/a> challenging the California maps face the same hurdle Democrats encountered in Texas: demonstrating that race, rather than political affiliation, drove the redistricting process.<\/p>\n<p class=\"dcr-130mj7b\">In their lawsuit, Republicans <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/nov\/05\/california-redistricting-measure-republican-lawsuit\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">cited remarks<\/a> from Democratic legislators and a redistricting consultant indicating that the plan retained several districts originally created by an independent commission to enhance representation for voters of color. While such districts are permitted under federal law, the lawsuit claimed Democrats failed to follow the proper procedures in maintaining them.<\/p>\n<p class=\"dcr-130mj7b\">Democrats countered that the racial gerrymandering accusations were unsupported. They pointed to an independent analysis showing no increase in the number of districts with Latino-majority populations. They also highlighted public statements from Newsom and other party leaders asserting that the revised maps were intended to offset Republican advances in Texas, not to target voters based on race.<\/p>\n<p class=\"dcr-130mj7b\">Two judges \u2013 Josephine Staton, appointed by Barack Obama, and Wesley Hsu, appointed by Joe Biden \u2013 ruled in California\u2019s favor. Judge Kenneth K Lee, a Trump appointee to the ninth circuit court of appeals, dissented, arguing that Democrats had crafted at least one district in southern California \u201cto prevent Latino voters from drifting away from the party\u201d.<\/p>\n<p class=\"dcr-130mj7b\">The maps approved under Prop 50 will govern congressional elections in 2026, 2028, and 2030.
