The California Apartment Association has assailed a San Francisco unoccupied apartments tax as an unconstitutional infringement on the rights of property owners. <\/p>\n

The association, which claims representation of more than 50,000 apartment owners and operators, is backing municipal property owners\u2019 defense of a 2024 trial court ruling<\/a> that struck down Proposition M, the city voter initiative that enacted the ordinance two years earlier. The tax is tantamount to a taking of their property in violation of the US Constitution\u2019s Fifth Amendment, the local landlords contend.<\/p>\n
