It\u2019s unclear how much support it will get, although four other councilmembers support increasing transparency at the City of Fresno.<\/p>\n<p>City Councilmember Miguel Arias is bringing forward a new city policy that addresses a number of transparency and accountability gaps uncovered by <a href=\"https:\/\/fresnoland.org\/2026\/01\/07\/fresno-contracts-loophole\/\" rel=\"nofollow noopener\" target=\"_blank\">a Jan. 7<\/a> <a href=\"https:\/\/fresnoland.org\/2026\/01\/07\/fresno-council-contracts\/\" rel=\"nofollow noopener\" target=\"_blank\">Fresnoland investigation<\/a>.\u00a0<\/p>\n<p><a href=\"https:\/\/fresno.legistar.com\/LegislationDetail.aspx?ID=7829166&amp;GUID=A7427619-6602-4520-B571-61256393BB81&amp;Options=&amp;Search=\" rel=\"nofollow noopener\" target=\"_blank\">Arias\u2019 pr<\/a>o<a href=\"https:\/\/fresno.legistar.com\/LegislationDetail.aspx?ID=7829166&amp;GUID=A7427619-6602-4520-B571-61256393BB81&amp;Options=&amp;Search=\" rel=\"nofollow noopener\" target=\"_blank\">posal<\/a> directs the city\u2019s administration to create an all-in-one online, searchable transparency page on the City of Fresno\u2019s website, where all contracts worth $100,000 or less would be listed, along with their amounts.<\/p>\n<p>The transparency page would also lay out all lobbyist contracts, a list of all lobbyists registered with the city and disclosure forms for city officials\u2019 economic interests \u2014 also known as <a href=\"https:\/\/www.fppc.ca.gov\/Form700.html\" rel=\"nofollow noopener\" target=\"_blank\">California\u2019s Form 700<\/a>.\u00a0<\/p>\n<p>\u201cThis will ensure the policy is crystal clear going forward and the public\u2019s ability to access this information doesn\u2019t take nearly a year, <a href=\"https:\/\/fresnoland.org\/2026\/01\/07\/fresno-contracts-loophole\/#:~:text=Fresno%20city%20councilmembers%20say,to%20provide%20the%20records.\" rel=\"nofollow noopener\" target=\"_blank\">as experienced by Fresnoland<\/a>,\u201d Arias said.<\/p>\n<p>Originally, Arias said he\u2019d support reforming the city\u2019s transparency, such that <a href=\"https:\/\/fresnoland.org\/2026\/01\/07\/fresno-contracts-loophole\/#:~:text=Five%20members%20of,100%2C000%20or%20less.\" rel=\"nofollow noopener\" target=\"_blank\">all no-bid contracts<\/a>, not just those worth $100,000 or less, are accessibly listed on the city\u2019s website. <a href=\"https:\/\/fresnoland.org\/2026\/01\/07\/fresno-contracts-loophole\/#:~:text=Five%20members%20of,speak%20to%20Fresnoland.\" rel=\"nofollow noopener\" target=\"_blank\">Four other councilmembers<\/a> also told Fresnoland that.\u00a0<\/p>\n<p>The current draft of the policy does not require that level of transparency.<\/p>\n<p>Arias also said the proposal would expressly bar city officials from entering into multiple contracts with a single consultant worth $100,000 or less \u2014 the sum of which in a single fiscal year is greater than the city\u2019s <a href=\"https:\/\/fresnoland.org\/2026\/01\/07\/fresno-contracts-loophole\/#:~:text=Then%2DCouncilmember%20Luis,of%20dollars%20altogether.\" rel=\"nofollow noopener\" target=\"_blank\">$100,000 contracts threshold<\/a>.\u00a0<\/p>\n<p>Only city contracts greater than $100,000 require Fresno City Council approval. Fresnoland\u2019s Jan. 7 investigation found that city officials <a href=\"https:\/\/fresnoland.org\/2026\/01\/07\/fresno-contracts-loophole\/#:~:text=A%20Fresnoland%20investigation,of%20dollars%20altogether.\" rel=\"nofollow noopener\" target=\"_blank\">have regularly handed out millions in government contracts worth $100,000 or less<\/a> \u2014 and the public has no way to see how many get handed out.\u00a0<\/p>\n<p>Additionally, Fresnoland found at least <a href=\"https:\/\/fresnoland.org\/2026\/01\/07\/fresno-contracts-loophole\/#:~:text=Fresno%E2%80%99s%20online%20contracts,from%20council%20approval.\" rel=\"nofollow noopener\" target=\"_blank\">a dozen examples of the same consultant<\/a> ending up with multiple contracts worth $100,000 in a single fiscal year, whose total sum was greater than the city\u2019s contracts threshold.\u00a0<\/p>\n<p>\u201cIf it wasn\u2019t for Fresnoland\u2019s reporting, the full city council and the public wouldn\u2019t have known about contracts that were signed and exceeded the contracts limit, in violation of the municipal code as <a href=\"https:\/\/fresnoland.org\/2026\/01\/15\/legal-advice-city-contracts\/#:~:text=%E2%80%9CThe%20City%20Attorney%E2%80%99s,at%20City%20Hall.\" rel=\"nofollow noopener\" target=\"_blank\">confirmed by our legal counsel<\/a>,\u201d Arias told Fresnoland.<\/p>\n<p>What about the \u2018pass-through expenses\u2019 loophole?<\/p>\n<p>For years, former Councilmember Luis Chavez entered into under-threshold contracts with a company run by political consultant Alex Tavlian using public money.\u00a0<\/p>\n<p>Fresnoland found that Chavez\u2019s council office paid Tavlian\u2019s company more money than the city\u2019s contracts threshold, even though they <a href=\"https:\/\/fresnoland.org\/2026\/01\/07\/fresno-contracts-loophole\/#:~:text=Their%20July%202024,the%20approval%20threshold.\" rel=\"nofollow noopener\" target=\"_blank\">never went before the Fresno City Council for approval<\/a>.\u00a0<\/p>\n<p>Chavez did that <a href=\"https:\/\/fresnoland.org\/2026\/01\/07\/fresno-contracts-loophole\/#:~:text=A%20Fresnoland%20investigation%20found%20that%20it%20was%20the%20third%20year%20in%20a%20row%20that%20Chavez%E2%80%99s%20council%20office%20paid%20Tavlian%E2%80%99s%20government%20consulting%20company%20more%20than%20the%20approval%20threshold.\" rel=\"nofollow noopener\" target=\"_blank\">three years in a row<\/a>.\u00a0<\/p>\n<p>Additionally, Fresnoland found that the City of Fresno was using an internal legal interpretation to exempt \u201cpass-through expenses\u201d from the city\u2019s contracts threshold, as opposed to <a href=\"https:\/\/library.municode.com\/ca\/fresno\/codes\/code_of_ordinances?nodeId=MUCOFR_CH4CIPUCOSA\" rel=\"nofollow noopener\" target=\"_blank\">Fresno city code<\/a>, <a href=\"https:\/\/fresno.legistar.com\/LegislationDetail.aspx?ID=6726120&amp;GUID=26C861FA-1CC3-4F91-9B3A-C8D08DAF2699&amp;Options=&amp;Search=\" rel=\"nofollow noopener\" target=\"_blank\">policies approved by the city council<\/a>, or <a href=\"https:\/\/www.fresno.gov\/personnel\/human-resources-support\/#administrative-order:~:text=Administrative%20Orders\" rel=\"nofollow noopener\" target=\"_blank\">the city\u2019s administrative orders<\/a>.\u00a0<\/p>\n<p>City Manager Georgeanne White told Fresnoland that Chavez\u2019s use of more than $31,000 of public funds for Facebook ads <a href=\"https:\/\/fresnoland.org\/2026\/01\/07\/fresno-council-contracts\/#:~:text=Even%20though%20payments,50%2C000\/%24100%2C000%20limit.%E2%80%9D\" rel=\"nofollow noopener\" target=\"_blank\">didn\u2019t count toward the city\u2019s contracts threshold<\/a>. Another city official clarified that\u2019s because they were seen as <a href=\"https:\/\/fresnoland.org\/2026\/01\/07\/fresno-council-contracts\/#:~:text=While%20the%20rules,by%20a%20consultant.\" rel=\"nofollow noopener\" target=\"_blank\">pass-through expenses<\/a>.\u00a0<\/p>\n<p>According to the current draft of Arias\u2019 policy, pass-through expenses would be subject to the city\u2019s contracts threshold, closing what he referred to as a <a href=\"https:\/\/fresnoland.org\/2026\/01\/07\/fresno-contracts-loophole\/#:~:text=%E2%80%98This%20policy%20has%20created%20a%20loophole%2C%E2%80%99%20councilmember%20says\" rel=\"nofollow noopener\" target=\"_blank\">loophole in city policy<\/a>. It essentially allows a councilmember to use an unlimited amount of taxpayer money for social media ads as long as they were reimbursements to an outside consultant for pass-through expenses.<\/p>\n<p>Arias told Fresnoland that the policy will also include a blackout period blocking top city officials from using city funds for print or digital advertisements six months before an election they\u2019re participating in \u2014 either a ballot measure or a specific political race.\u00a0<\/p>\n<p>\u201cI am confident these changes will reduce the likelihood of a recurrence of the actions identified through Fresnoland\u2019s reporting, and addressed by the City Attorney,\u201d Arias said.<\/p>\n<p>It\u2019s unclear how much support Arias\u2019 proposal will receive, although it\u2019s slated for discussion at the Jan. 29 city council meeting next week.\u00a0<\/p>\n<p>In a press conference on Jan. 7, hours after Fresnoland\u2019s investigation was published, Councilmembers Brandon Vang and Nick Richardson promised to take action to reform city policies.<\/p>\n<p><img loading=\"lazy\" data-recalc-dims=\"1\" decoding=\"async\" width=\"780\" height=\"520\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2026\/01\/IMG_0970.jpg\" alt=\"\" class=\"wp-image-47182\"  \/>Fresno City Council President Mike Karbassi speaks during a June 10, 2025 budget hearing. Omar Rashad | Fresnoland<\/p>\n<p>Another city leader seeks to revise city policy in private<\/p>\n<p>Fresno City Council President Mike Karbassi is moving forward with establishing an ad-hoc committee to <a href=\"https:\/\/fresno.legistar.com\/LegislationDetail.aspx?ID=7829165&amp;GUID=8B904CD7-522A-4FC4-87D1-9A3476E3DD93&amp;Options=&amp;Search=\" rel=\"nofollow noopener\" target=\"_blank\">come up with revisions to a number of city policies<\/a>. Since it is an ad-hoc committee, its focus is limited and it will also meet in private. Members of the public will not be able to observe these behind-the-scenes conversations.\u00a0<\/p>\n<p>Karbassi declined Fresnoland\u2019s request for an interview but responded to questions over text.\u00a0<\/p>\n<p>Fresnoland asked Karbassi why he chose to make the committee private, and whether there are any advantages in doing that.\u00a0<\/p>\n<p>\u201cIt\u2019s not about advantages vs disadvantages,\u201d Karbassi said. \u201cPolicymaking (is) central to our jobs as elected representatives. The public expects us to commit to doing the hard work on their behalf. Not every single meeting with every person or group at every hour of every day is held in public for all to see.
