Jammer Gene \u2013 stock.adobe.com<\/p>\n<p>\u201cChildren do not belong to the State \u2014 they belong to families,\u201d Education Secretary Linda McMahon said.<\/p>\n<p>The department has given the California Department of Education two weeks to respond and come into compliance with federal law. If it does not, the federal government could take necessary \u201cenforcement action.\u201d<\/p>\n<p>Parents of hundreds of students were apparently left in the dark thanks to the state\u2019s move. Getty Images<\/p>\n<p>\u201cThe environment they are creating in the state makes it basically impossible for districts to comply with FERPA,\u201d a senior Department of Education official told The Post.<\/p>\n<p>Under a <a href=\"https:\/\/nypost.com\/2025\/12\/16\/media\/california-school-district-lets-students-change-names-and-gender-identity-in-secret-from-parents\/\" rel=\"nofollow noopener\" target=\"_blank\">California law passed in July 2024<\/a>, school districts are prohibited from requiring staff to disclose a student\u2019s gender identity or sexual orientation to parents without the student\u2019s permission. This law, known as the Support Academic Futures and Educators for Today\u2019s Youth Act, prevents schools from enforcing \u201cforced outing\u201d policies.<\/p>\n<p>\u201cSchools do not get to choose which records they feel like providing to parents and which ones they don\u2019t,\u201d the official said.<\/p>\n<p>The state apparently pressured schools to create secret \u201cgender support plans\u201d and override parent portals.
