{"id":155558,"date":"2026-01-29T22:26:07","date_gmt":"2026-01-29T22:26:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/155558\/"},"modified":"2026-01-29T22:26:07","modified_gmt":"2026-01-29T22:26:07","slug":"fresno-police-wont-arrest-federal-agents-under-ca-mask-law-city-says","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/155558\/","title":{"rendered":"Fresno Police Won\u2019t Arrest Federal Agents Under CA Mask Law, City Says"},"content":{"rendered":"<p>Fresno city officials on Thursday clarified that the city\u2019s police department will not arrest federal agents who violate California\u2019s recently <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202520260SB627\" target=\"_blank\" rel=\"noopener nofollow\">enacted law banning<\/a> law enforcement officers from wearing masks.<\/p>\n<p>City Manager Georgeanne White told the City Council at their Thursday meeting that she had contacted Mayor Jerry Dyer, who is attending the <a href=\"https:\/\/gvwire.com\/2026\/01\/26\/mayor-jerry-dyer-to-address-policing-ice-tactics-at-us-conference-of-mayors-meeting\/\" target=\"_blank\" rel=\"noopener nofollow\">U.S. Mayor\u2019s Conference in Washington, D.C.<\/a> Dyer said Fresno police \u201cwill follow state law regarding the wearing of masks,\u201d but emphasized exceptions allowed under the law.<\/p>\n<p>He added that forcing officers to arrest federal agents could lead to dangerous confrontations between armed personnel.<\/p>\n<p>White said Dyer told her, \u201cShould Fresno PD officers see an agent physically abusing a person, I would expect them to stop that as they have a duty to intervene, just as they would if they see a fellow officer abusing a person.\u201d<\/p>\n<p>He also noted that in cases involving shootings, \u201cthe <a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artVI-C2-1\/ALDE_00013395\/\" target=\"_blank\" rel=\"noopener nofollow\">federal supremacy clause<\/a> would take effect,\u201d though he hopes Fresno police would investigate alongside the federal agency.<\/p>\n<p>At the Mayor\u2019s Conference, Dyer said Wednesday that local residents have urged the city to arrest ICE agents under the California mask law, but said he has rejected those calls. \u201cI am not going to do that, I can\u2019t do that, because that is only going to increase the tensions that we have out there.\u201d<\/p>\n<p>Arias Cites ICE Incidents Resulting in Casualties<\/p>\n<p>City Manager White\u2019s clarification followed questions from Councilmember Miguel Arias, who asked the administration to explain whether the law would be enforced for federal agents, particularly in situations similar to the fatal shooting of <a href=\"https:\/\/gvwire.com\/2026\/01\/24\/deaths-mount-as-trump-immigration-push-intensifies\/\" target=\"_blank\" rel=\"noopener nofollow\">Renee Nicole Good<\/a> by ICE agents in Minneapolis.<\/p>\n<p>Arias cited a pattern of deaths in federal custody, noting that 32 individuals died last year while in ICE custody and eight have already died this year in ICE incidents, including Luis Gustavo Nunez Caceres, Geraldo Lunas Campos, Victor Manuel Diaz, Good, and <a href=\"https:\/\/gvwire.com\/2026\/01\/28\/initial-dhs-review-does-not-say-pretti-brandished-gun-contradicting-noem\/\" target=\"_blank\" rel=\"noopener nofollow\">Alex Pretti<\/a>, amongst others.<\/p>\n<p>Arias stressed that residents deserve clarity on whether the law will be enforced universally and said city leaders must ensure that Fresno police will act in situations where federal officers abuse their authority.<\/p>\n<p>Fresno Police Department Cites Policy<\/p>\n<p>The Fresno Police Department said Thursday that it will adhere to department policy as it comes to ICE operations in the city.<\/p>\n<p>The policy, which the department shared with GV Wire, states:<\/p>\n<p>\u201cIf a specific request is made by ICE or any other federal agency, this Department will provide available support services, such as traffic control or keep-the-peace efforts, or in response to officer safety concerns, during the federal operation.<\/p>\n<p>\u201cRequests for assistance beyond that described above should be directed to a supervisor. The supervisor is responsible for determining whether the requested assistance would be permitted under the <a href=\"https:\/\/codes.findlaw.com\/ca\/government-code\/gov-sect-7284-2\/\" target=\"_blank\" rel=\"noopener nofollow\">California Values Act<\/a>, GC \u00a77284.2 et seq.<\/p>\n<p>\u201cAny detention by a member of this Department should be based upon the reasonable belief that an individual is involved in criminal activity.\u201d<\/p>\n<p>The department said that it would not elaborate on comments made by city officials pertaining to ICE agents.<\/p>\n<p>Gov. Newsom to Fight President Trump in Court<\/p>\n<p>California <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202520260SB627\" target=\"_blank\" rel=\"noopener nofollow\">Senate Bill 627<\/a>, signed into law in September 2025, makes it a misdemeanor for law enforcement officers, including federal agents, to wear facial coverings while performing their duties, with limited exemptions.<\/p>\n<p>The law also requires agencies to maintain and publicly post facial covering policies by July 2026. Violations can carry civil penalties, particularly for false imprisonment or unlawful arrests committed while masked.<\/p>\n<p>Gov. Gavin Newsom\u2019s office did not directly address the statement made by Fresno officials on Thursday.<\/p>\n<p>However, Newsom\u2019s Deputy Director of Communications, Diana Crofts-Pelayo, issued this statement to GV Wire: \u201cThe federal government has sued to stop the state from enforcing this law. We are defending the law in court which would go in effect on July 1.\u201d<\/p>\n<p>On Nov. 17, 2025, the Trump Administration sued to block the law citing a 1890 Supreme Court case ruling governing whether a state can prosecute federal law enforcement officers who are performing their duties.<\/p>\n<p>The High Court\u2019s ruling on <a href=\"https:\/\/tile.loc.gov\/storage-services\/service\/ll\/usrep\/usrep135\/usrep135001\/usrep135001.pdf\" target=\"_blank\" rel=\"noopener nofollow\">In re Neagle<\/a> provided a strong shield for federal agents.
