{"id":155854,"date":"2026-01-30T01:57:12","date_gmt":"2026-01-30T01:57:12","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/155854\/"},"modified":"2026-01-30T01:57:12","modified_gmt":"2026-01-30T01:57:12","slug":"fresno-truck-drivers-in-limbo-after-ca-dmv-revokes-licenses","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/155854\/","title":{"rendered":"Fresno truck drivers in limbo after CA DMV revokes licenses"},"content":{"rendered":"<p>\t\t\t\t\tWhat&#8217;s at stake:<\/p>\n<p>A December lawsuit filed by the Sikh Coalition and others on behalf of the Jakara Movement and five anonymous immigrant drivers challenges the DMV\u2019s planned cancellation of nearly 20,000 commercial driver\u2019s licenses.<\/p>\n<p>He\u2019s a 56-year-old commercial driver from India living in Fresno who says he\u2019s never even had a speeding ticket after nearly 20 years on the road. <\/p>\n<p>But he\u2019s about to lose his license \u2014 and the means to help support his family \u2014 because of a federal crackdown on immigrants that triggered a massive purge of commercial drivers licenses (CDLs) in California beginning late last year.<\/p>\n<p>The Fresno man, who asked not to be identified out of fear of the government, says it felt like his heart stopped when he read the letter from the California Department of Motor Vehicles dated Nov. 6. He now only drives part time. <\/p>\n<p>\u201cI was worried about supporting my family,\u201d he said.<\/p>\n<p>He\u2019s just one of nearly 20,000 immigrant drivers whose CDLs are affected by the DMV\u2019s planned cancellations, according to an <a href=\"https:\/\/cdn.craft.cloud\/5cd1c590-65ba-4ad2-a52c-b55e67f8f04b\/assets\/media\/Programs\/Workers-Rights\/CDL-Class-Action-Complaint-ALC-SC-WR-20251229-FILED.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">ongoing lawsuit<\/a> against the California DMV.\u00a0<\/p>\n<p class=\"has-white-color has-dark-gray-background-color has-text-color has-background has-link-color has-normal-font-size wp-elements-9cc5d354c264e8772c2334173c1af88a\">Never miss the top stories in Fresno \u2014 sign up for our free, daily newsletter.<\/p>\n<p>The Fresno driver said he held onto hope that the letter was a mistake and believed the government would step in to help. Instead, he described an atmosphere of fear that now follows him everywhere, whether at the store or on the road.\u00a0<\/p>\n<p>\u201cWe believe in immigrant and workers\u2019 rights, and we hope the lawsuit brings justice,\u201d he said. \u201cWe\u2019re hoping this allows people to feel safe again and continue their livelihoods.\u201d<\/p>\n<p>Now, the Fresno man is putting his hopes on the lawsuit filed late last year seeking to block the cancellations and allow drivers more time to address the paperwork issues.<\/p>\n<p>A legal battle for drivers\u2019 livelihoods\u00a0<\/p>\n<p>On Thursday morning, representatives of the <a href=\"https:\/\/www.jakara.org\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Jakara Movement<\/a>, a Fresno-based Sikh cultural organization, gathered at the Modern Truck Parking Lot in northwest Fresno to share updates on their case and its impact on immigrant communities across the Central Valley.<\/p>\n<p>The lawsuit was filed in Alameda County Superior Court in December by the <a href=\"https:\/\/www.sikhcoalition.org\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Sikh Coalition<\/a>, the <a href=\"https:\/\/www.asianlawcaucus.org\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Asian Law Caucus<\/a>, and the law firm <a href=\"https:\/\/www.weil.com\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Weil, Gotshal &amp; Manges LLP<\/a> \u2014 on behalf of the Jakara Movement and five anonymous immigrant commercial drivers.\u00a0<\/p>\n<p>According to the lawsuit, the DMV began sending cancellation notices on Nov. 6 to immigrant commercial drivers whose licenses had expiration dates that did not match their federal work authorization documents.\u00a0<\/p>\n<p>\u201cThis case is about more than paperwork,\u201d said Naindeep Singh, executive director of the Jakara Movement and current Fresno City Council candidate. \u201cIt is about dignity, due process and the fundamental right to work. These drivers followed the rules, passed the exams, and maintained valid work authorizations. They built lives, careers and families around the licenses that the state itself issued.\u201d\u00a0<\/p>\n<p>More than 17,000 drivers were told their licenses would be canceled on Jan. 5, with another 2,700 notified in December that their licenses would be revoked in mid-February. Advocates say many of those drivers had valid work permits or were never given a chance to update their records.<\/p>\n<p><img loading=\"lazy\" data-recalc-dims=\"1\" decoding=\"async\" width=\"780\" height=\"586\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2026\/01\/IMG_9373-2.jpg\" alt=\"\" class=\"wp-image-80594\"  \/>Trucks parked at the Modern Truck Parking Lot in northwest Fresno. Gisselle Medina | Fresnoland<\/p>\n<p>The plaintiffs are asking the court to allow this case to be a class action suit, stop the DMV from canceling licenses improperly, declare the November and December cancellation letters invalid, and ensure drivers can get corrected licenses without losing their ability to work. They also seek legal costs and any other relief the court deems fair.<\/p>\n<p>Singh said the organization began hearing from dozens of drivers in November who immigrated from Honduras, El Salvador, India, Mexico, and Punjab, who were feeling confused, scared, and desperate for answers about what was at stake for their families and livelihoods.\u00a0<\/p>\n<p>He added that drivers were often given conflicting information by DMV officials, and noted that one member, despite having valid work authorization, was pressured into surrendering his license in person and has yet to be told when, or if, it will be returned.<\/p>\n<p>Singh said a commercial drivers license is \u201cmore than a card.\u201d\u00a0<\/p>\n<p>\u201cIt\u2019s a stability. It\u2019s identity and survival,\u201d Singh said. \u201cWhen the government takes that away without warning or recourse, it sends a chilling message about whose work is valued and whose lives are treated as expendable. We refuse to accept that message.\u201d<\/p>\n<p>The California DMV has since announced it is <a href=\"https:\/\/www.asianlawcaucus.org\/news-resources\/guides-reports\/kyr-dot-non-domiciled-commercial-drivers-license\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">extending the licence cancellation date<\/a> for approximately 20,000 drivers from January to March 6.\u00a0\u00a0<\/p>\n<p>Fresnoland reached out to the California DMV for comment on the lawsuit, the license cancellations, and the agency\u2019s compliance with state and federal law. A spokesperson responded that \u201cthe DMV cannot comment on active litigation.\u201d\u00a0<\/p>\n<p>State law requires the DMV, when licenses are issued with incorrect expiration dates, to cancel them and <a href=\"https:\/\/law.justia.com\/codes\/california\/code-veh\/division-6\/chapter-2\/article-1\/section-13100\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">allow drivers to reapply<\/a> or drivers on their own accord can <a href=\"https:\/\/law.justia.com\/codes\/california\/code-veh\/division-6\/chapter-1\/article-3\/section-12816\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">file a renewal application six months prior to expiration<\/a>.\u00a0<\/p>\n<p>The lawsuit alleges the DMV has failed to follow that process, instead canceling licenses outright without providing a timeline or clear path for correction, placing thousands of drivers at risk of losing their livelihoods.<\/p>\n<p>\u201cThe timeline matters deeply,\u201d Singh said. \u201cEvery week of delay means more families living in fear, more drivers sidelined and more uncertainty rippling through our communities and supply chains.\u201d<\/p>\n<p>How federal actions have also impacted immigrant drivers in Fresno County<\/p>\n<p>The Jakara Movement estimates as many as 5,000 drivers in Fresno County received cancellation notices, of around 15,000 drivers throughout the central San Joaquin Valley.<\/p>\n<p>\u201cCommercial drivers transport our food,\u201d Singh said. \u201cThey drive our buses. They keep our ports, warehouses, schools and hospitals functioning. When these workers are abruptly removed from the workforce, everybody feels the impact.\u201d<\/p>\n<p>In November, a <a href=\"https:\/\/www.fmcsa.dot.gov\/newsroom\/newsom-caught-redhanded-trumps-transportation-secretary-sean-p-duffy-exposes-california\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">federal audit<\/a> by the Federal Motor Carrier Safety Administration found that more than 17,000 commercial licenses issued to immigrants in California were set to expire after the drivers\u2019 legal status ended, in violation of state law.<\/p>\n<p>The DMV <a href=\"https:\/\/calmatters.org\/wp-content\/uploads\/2025\/11\/FMCSA-CA-Response-10.26.2026-1-1.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">acknowledged<\/a> that flaws in its computer systems and internal processes led to commercial driver\u2019s licenses being issued with expiration dates that did not match drivers\u2019 work authorization or legal presence documents.<\/p>\n<p>The audit was launched after the Federal Motor Carrier Safety Administration <a href=\"https:\/\/www.fmcsa.dot.gov\/sites\/fmcsa.dot.gov\/files\/2025-09\/Letter%20to%20California_2025%20Annual%20Program%20Review%20Findings.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">notified<\/a> California on Sept. 26, 2025, that the state was not in \u201csubstantial compliance\u201d with federal standards for issuing non-domiciled commercial driver\u2019s licenses.<\/p>\n<p>Three days later, California stopped issuing and renewing the <a href=\"https:\/\/www.dmv.ca.gov\/portal\/important-changes-to-limited-term-legal-presence-cdl-requirements\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">non-domiciled licenses<\/a> to comply with <a href=\"https:\/\/www.fmcsa.dot.gov\/newsroom\/order-granting-administrative-stay-interim-final-rule-titled-restoring-integrity-issuance\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">new federal rules<\/a> that narrowed eligibility to specific visa types (<a href=\"https:\/\/enotrans.org\/article\/legal-back-and-forth-continues-for-cdls\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">H-2A, H-2B, E-2<\/a>), leading to the planned cancellation of roughly 17,000 licenses. The DMV said it planned to begin issuing corrected licenses in December, but those <a href=\"https:\/\/www.kqed.org\/news\/12068027\/california-delays-plan-to-reissue-commercial-licenses-drivers-mired-in-uncertainty\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">plans were blocked by the Trump Administration<\/a>.<\/p>\n<p>The U.S. Department of Transportation <a href=\"https:\/\/www.transportation.gov\/sites\/dot.gov\/files\/2026-01\/California%20Final%20Determination%20of%20Substantial%20Noncompliance.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">said in a Jan. 7 letter<\/a> that California is not following federal rules for issuing commercial driver\u2019s licenses to non-citizens because the DMV issued thousands of licenses with expiration dates that didn\u2019t match drivers\u2019 work or legal status.
