{"id":162056,"date":"2026-02-03T15:57:08","date_gmt":"2026-02-03T15:57:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/162056\/"},"modified":"2026-02-03T15:57:08","modified_gmt":"2026-02-03T15:57:08","slug":"rochester-school-board-trustee-files-suit-against-district-the-oakland-press","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/162056\/","title":{"rendered":"Rochester school board trustee files suit against district \u2013 The Oakland Press"},"content":{"rendered":"<p>A Rochester school board member has filed a lawsuit that challenges a newly revised bylaw which restricts what trustees can say publicly.<\/p>\n<p>Trustee Carol Beth Litkouhi has sued the Rochester schools district and five trustees who voted to censure her at a Nov. 10 meeting.<\/p>\n<p>The Mackinac Center Legal Foundation filed the challenge on Litkouhi\u2019s\u00a0 behalf, arguing that the bylaw is unconstitutionally overbroad and violates her First Amendment rights.<\/p>\n<p>Litkouhi was censured and removed for one year from all committees and liaison roles for a published opinion piece that revealed Oakland County\u2019s discussions about a school enhancement millage.<\/p>\n<p>\u201cI ran for this office because I care deeply about our community and our schools,\u201d\u202fsaid\u00a0 Litkouhi in a statement released by the Foundation.\u202f\u201cSilencing trustees only hurts the families we\u2019re supposed to serve. I will always choose openness over secrecy, because the people who elected me deserve transparency from their officials.\u201d<\/p>\n<p>President Michelle Bueltel, Vice President Jessica Gupta, Treasurer Julie Alspach and Trustees Jayson Blake and Barb Anness voted in favor of the censure. Litkouhi and Trustee Shelley Lauzon voted against.<\/p>\n<p>The school board viewed her public comments about\u00a0 the county\u2019s potential millage proposal as a\u00a0 violation of the district\u2019s bylaw 1001, which states: \u201cBoard members will take no private action that might compromise the board or administration and will not share any document or information that has not already been shared by the district, including but not limited to confidential or privileged information.\u201d<\/p>\n<p>The suit claims that all board members received an \u201cenhancement millage package\u201d on Oct. 8 from Superintendent Nicholas Russo. It gave an overview of a proposed countywide millage proposal to be put on the August primary ballot.<\/p>\n<p>Three weeks later Litkouhi wrote the opinion piece highlighting the ramifications of the millage.<\/p>\n<p>\u201cI was even asked not to mention the proposal publicly until after boards completed their votes. When I asked why \u2014 given that I\u2019d like to hear from my constituents \u2014 I was told, \u2018That\u2019s not how it\u2019s done. We shouldn\u2019t influence other districts,\u2019\u201d she wrote in the opinion piece. \u201cBut that\u2019s exactly backward. School boards are accountable to their local communities, not to county-level political strategy.\u201d<\/p>\n<p>According to the Oakland County clerk\u2019s office, the proposal is not on any 2026 ballot and no other school districts have discussed or voted on the proposed millage.<\/p>\n<p>The proposal, listed as an attachment in the lawsuit, would be 1.5-mills to be levied over six years and would generate approximately $700 per pupil annually for each Oakland County public student.
