It supports expanded access to care for patients with the most need through free or low-cost medications, health care, preventive services, transportation, and more. But we live in a world where good things like 340B are ripe for the pickings, and profit-seeking third parties are cashing in big.<\/p>\n<p>What started as a program to help patients access health care services and medications through rural hospitals and certain clinics has turned into a $66 billion (and growing!) industry with more companies popping up every day to take advantage. Unfortunately, massive program growth does not mean massive patient benefit. In fact, a\u00a0<a href=\"https:\/\/www.wsj.com\/opinion\/white-house-drug-price-reform-340b-hospital-lobby-e4753acf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Wall Street Journal editorial<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.cbo.gov\/publication\/60661\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Congressional Budget Office report<\/a>\u00a0found that program growth \u2013 including the expanded use of \u201coff-site\u201d or \u201ccontract\u201d pharmacies \u2013 has led to increased provider consolidation and inflated costs for patients, as well increased state and federal spending.<\/p>\n<p><a href=\"https:\/\/communityoncology.org\/wp-content\/uploads\/2018\/06\/COA_340B-PatientStories_FINAL.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Even in 2018<\/a>, oncology providers were\u00a0<a href=\"https:\/\/mycoa.communityoncology.org\/news-updates\/press-releases\/community-oncology-alliance-files-amicus-brief-opposing-340b-contract-pharmacy-abuses-in-west-virginia-case\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">calling out the obscene financial resources extracted by 340B contract pharmacies<\/a>\u00a0\u2013 especially those affiliated with pharmacy benefit managers (PBMs) \u2013 stating these conglomerates hoard discounts by \u201ccreating delays, denials, and higher costs for patients with cancer and others with serious illnesses.\u201d<\/p>\n<p>Through the contract pharmacy loophole, where 340B hospitals and clinics contract with an off-site pharmacy, for-profit companies are able to capitalize on discounted drug prices, thereby diverting savings away from patients in need. In practice, this has led to the top 4 pharmacy giants (Walmart, CVS, Rite Aid, and Walgreens)\u00a0<a href=\"https:\/\/www.sph.umn.edu\/news\/increase-in-retail-pharmacies-participating-in-340b-drug-discount-program-is-largely-driven-by-the-four-largest-pharmacy-chains\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">owning 71% of all contract pharmacies participating in the 340B program<\/a>.<\/p>\n<p>Without real oversight and accountability, these are the very types of deceptive, anti-patient behaviors that 340B has enabled over the years.<\/p>\n<p>Unfortunately, Sacramento\u2019s very own, Representative Doris Matsui, is going the opposite route. She recently introduced HR 4581, which follows in the footsteps of State Assemblymember Chris Rogers\u2019 AB 1460 by enabling the unchecked expansion of contract pharmacies. Neither measure offers real program reform. Instead, these bills only serve to encourage more program exploitation by rewarding vertically integrated, corporate profiteering giants that are already abusing the program at the expense of patient benefit.<\/p>\n<p>Already,\u00a0<a href=\"https:\/\/chds.hsph.harvard.edu\/vertical-integration-is-hurting-healthcare\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">patients are suffering<\/a>\u00a0from\u00a0<a href=\"https:\/\/www.gao.gov\/products\/gao-25-107450\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">less competition among hospitals and health care providers<\/a>\u00a0because of higher prices, fewer access points, and reduced services. In fact,\u00a0<a href=\"https:\/\/www.commonwealthfund.org\/publications\/podcast\/2025\/may\/how-private-equity-deals-are-reshaping-your-health-care\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">it\u2019s been proven<\/a>\u00a0time and time again that hospitals eliminate services and see fewer low-income patients after being acquired by a for-profit entity.<\/p>\n<p>As someone living with HIV and leading an organization in service of people living with HIV, Hepatitis C, substance use disorders, and co-occurring conditions, we rely on each other and our communities to navigate a burdensome and complex health system that, too often, treats us with derision and suspicion. It\u2019s up to us to stand up to corporate profiteering and to call out the conflation of large health system interests with patients\u2019 interests: although there is some convergence, it is not always the same.<\/p>\n<p>Take for example what happens when hospitals decide administering treatment will hurt their profits: they simply\u00a0<a href=\"https:\/\/www.statnews.com\/2025\/09\/22\/hospital-acquired-infection-reporting-healthcare-dirty-little-secret\/?utm_campaign=dc_diagnosis&amp;utm_medium=email&amp;_hsenc=p2ANqtz-8FvaNtzcaq9DrXRxSZwjMtY6egIRfc6PbG8Edy5G5kDWilRcI8HzwXVB9qXB0ROxMI0lGFjGauY0noFKGa5CUymba0ig&amp;_hsmi=381794937&amp;utm_content=381794937&amp;utm_source=hs_email\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">discourage the necessary tests<\/a>. Perhaps if 340B dollars were regularly reinvested into patient care, as they should be, paying these fees would not be so worrisome. Yet now that\u00a0<a href=\"https:\/\/www.iqvia.com\/locations\/united-states\/library\/white-papers\/unintended-consequences-how-the-affordable-care-act-helped-grow-the-340b-program\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">roughly half of the country\u2019s hospitals<\/a>\u00a0participate in the 340B program, it is hardly a shock that patients\u2019 needs fall through the cracks as large systems continue to expand and pursue exponential monetary gain. Even now, instead of working to protect existing patient programs,\u00a0<a href=\"https:\/\/www.healthcaredive.com\/news\/a-50b-rural-health-fund-was-negotiated-with-hospitals-in-mind-experts-are\/757714\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">hospitals are lobbying<\/a>\u00a0for their share of the $50 billion rural health fund. It\u2019s clear that hospitals continue to treat patient care as an afterthought.<\/p>\n<p>While Representative Matsui may mean well, we hope the rest of the California delegation sees through her contract pharmacy loophole and instead chooses to support the 340B ACCESS Act \u2013 a measure focused on meaningful 340B Program reform that will ensure patients are directly benefiting from program growth.<\/p>\n<p>We deserve elected officials who put us ahead of large health system and chain pharmacy greed.
