BAKERSFIELD, Calif. (KGET) \u2014 A man who was acquitted last month of attempted murder but found guilty of assault with a deadly weapon for stabbing his brother was sentenced Thursday.<\/p>\n
Andy Burgos-Garcia, 27, received a seven-year prison term, prosecutors said. He\u2019d faced a life sentence if convicted of attempted murder.<\/p>\n
His brother survived.<\/p>\n
On March 11, 2024, police were dispatched to a report of a stabbing at a home in the 100 block of Morrison Street, west of north Stine Road and north of Brundage Lane.<\/p>\n
Officers found Hector Garcia out front, bleeding from puncture wounds to his head and neck, as well as other areas of his body, according to the Public Defender\u2019s Office.<\/p>\n
He identified his brother, Burgos-Garcia, as responsible.<\/p>\n
A black 5 inch kitchen knife with blood on it was found in Burgos-Garcia\u2019s bedroom and he was taken into custody.<\/p>\n
At trial, Deputy Public Defender Jennifer Melgar said Burgos-Garcia awoke that morning to screaming and saw his brother \u2014 who stands 6 feet, 3 inches and weighs 260 pounds \u2014 \u201cviolently attacking their sister and her friend.\u201d<\/p>\n
She argued Burgos-Garcia stepped in to stop the attack.<\/p>\n
The jury found him not guilty of attempted murder and attempted voluntary manslaughter, but convicted him on the assault charge.<\/p>\n
