{"id":171842,"date":"2026-02-10T12:58:11","date_gmt":"2026-02-10T12:58:11","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/171842\/"},"modified":"2026-02-10T12:58:11","modified_gmt":"2026-02-10T12:58:11","slug":"100-years-after-a-black-family-was-forced-out-a-descendant-sues-a-california-city","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/171842\/","title":{"rendered":"100 Years After a Black Family Was Forced Out, a Descendant Sues a California City"},"content":{"rendered":"<p class=\"mb-4 text-lg md:leading-8 break-words\">Sidney and Ir\u00e9ne Dearing, along with their two small children, faced lynching and bomb threats after they settled in a \u201csundown town\u201d in California in 1924.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">As the first Black homeowners in Piedmont, a wealthy white suburb of Oakland, they endured a racial terror campaign that included a mob of 500 people showing up on their property. The police chief, who was also a high-ranking member of the Ku Klux Klan, failed to protect them. The city eventually took the Dearings to court, claiming it needed to seize their property to build a road.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Within a year they were forced to sell, and a road was never built.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">More than a century later, the city, still majority <a href=\"https:\/\/www.nytimes.com\/2022\/03\/10\/opinion\/school-desegregation-california.html\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:white and wealthy;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">white and wealthy<\/a>, is honoring the Dearing family with a <a href=\"https:\/\/www.ktvu.com\/news\/city-of-piedmont-to-honor-black-family-who-was-forced-to-sell-home-in-1924\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:memorial park;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">memorial park <\/a>near Wildwood Avenue, where the family previously lived. But that\u2019s not good enough for their great-granddaughter, Jordana Ackerman.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">She\u2019s suing the city and is asking for redress, including compensation and a formal apology, according to a Feb. 2 complaint filed by the NAACP Legal Defense Fund and Seyfarth Shaw LLP in Alameda County, California, on behalf of Ackerman.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cThis lawsuit seeks to right some of the many wrongs and compensate for the hopes and dreams, generational wealth, and opportunities that the City denied my family through lies and violence rooted in racial discrimination,\u201d Ackerman wrote in a press release.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">In recent years, some California cities have attempted to rectify past harms toward Black communities and grapple with a history of being a sundown town, which are usually associated with the Deep South. From <a href=\"https:\/\/www.manhattanbeach.gov\/Home\/Components\/News\/News\/5186\/43\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Bruce\u2019s Beach;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Bruce\u2019s Beach <\/a>to <a href=\"https:\/\/abc7.com\/post\/palm-springs-pay-59-million-black-latino-families-forcibly-evicted-homes\/15549037\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Palm Springs;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Palm Springs<\/a> and <a href=\"https:\/\/www.latimes.com\/california\/story\/2025-11-22\/santa-monica-to-pay-350-000-to-family-of-displaced-black-entrepreneur\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Santa Monica;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Santa Monica<\/a>, officials have apologized and provided compensation to some descendants whose families were victims of eminent domain practices. The state and San Francisco have previously created <a href=\"https:\/\/oag.ca.gov\/ab3121\/report\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:a task force;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">a task force<\/a> and <a href=\"https:\/\/www.sf.gov\/sites\/default\/files\/2023-07\/AARAC%20Reparations%20Final%20Report%20July%207%2C%202023.pdf\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:advisory committee;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">advisory committee<\/a>, respectively, to study and develop proposals to provide reparations for descendants of enslaved Americans.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">In the case of the Dearings, the \u201cfraudulent\u201d eminent domain action was racially motivated, and it causes ongoing emotional and traumatic harm to the family, said Leah C. Aden, senior counsel at the NAACP Legal Defense Fund and co-counsel on the case.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cThe home was stolen from the family and has not been passed through the family as a form of generational wealth,\u201d she told Capital B. \u201cThis city is a wealthy enclave, and has one of the strongest educational systems. Had this family not been ousted from the community because they\u2019re Black, the family would have benefited from the education that the city provides.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">When Ackerman learned of the memorial project in 2022, she was asked to participate, the complaint says. She had no clue about the history between her family and the city. After doing more research, she sent letters to the city last year to negotiate reparations for her and other descendants.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">She alleges the city failed to make any effort, so she sued.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">While the city is aware of the lawsuit, it has not been served, a spokesperson told Capital B on Feb. 4. Despite the lawsuit, the city of Piedmont says it is still committed to creating a permanent memorial to ensure the Dearing family\u2019s experience is \u201cnever forgotten.\u201d It even commissioned <a href=\"https:\/\/www.hooddesignstudio.com\/landscape-design\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Walter Hood;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Walter Hood<\/a>, a Black professor, artist, and architect based in Oakland, to create the design.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cWhat Sidney and Ir\u00e9ne Dearing experienced 100 years ago was abhorrent, and is a shameful chapter in the community\u2019s history. It does not reflect the values of the community today,\u201d the statement said. \u201cThe memorial is an important part of the community\u2019s commitment to honest reckoning with the past as we work together to build a more welcoming, inclusive future.\u201d<\/p>\n<p>Bombs, a mob, and a lie<img alt=\"A historical photo of Cafe Creole. (Courtesy of Meghan Burnett)<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">In 1907, Sidney Dearing migrated from Texas to California, where he opened a store and <a href=\"https:\/\/www.sidneydearing.com\/creole-cafe\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Creole Caf\u00e9;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Creole Caf\u00e9<\/a>, a jazz club at 1740 7th Street in West Oakland. It was here he met Ir\u00e9ne, who he married in 1920. A year later, Creole Caf\u00e9 closed due to alleged alcohol consumption during the Prohibition Era.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">On Jan. 1, 1924, the couple moved to Piedmont after Julia Davis, Ir\u00e9ne\u2019s white mother, purchased the property for $10,000 using Sidney\u2019s money. At the time, Piedmont and surrounding areas restricted home ownership to only white people. However, the \u201cspecific whites-only restriction in the original deed \u2026 expired in 1923 and may not have been in effect at the time the Dearings moved into the property,\u201d the complaint says. It\u2019s unclear if the white residents knew.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">They protested, and the city forced the Dearings to sell.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">On May 6, a mob of 500 people showed up to their property at 67 Wildwood Ave.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The family received letters from the KKK threatening to lynch them. Bricks were thrown through their windows. Even gunshots were fired at their property. They found at least three bombs planted on their property. \u201cOne of the bombs, which was powerful enough to blow up a few city blocks, was found in his neighbor\u2019s garden,\u201d according to research.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The police department failed to investigate. The police chief, Burton Becker, a Klansman, did not protect them. Sidney hired private security, and even Alameda County Sheriff Frank Barnet provided support.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Sidney decided to negotiate to sell his property for $25,000. The city countered with $8,000 and\u00a0 \u201cdemanded that he leave town or else threatened that the City would start condemnation proceedings,\u201d the lawsuit said.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">By June, the city began the condemnation process. Sidney hired John Drake, president of the NAACP\u2019s Northern Chapter, to represent him. The next month, the city filed an action in Alameda County Superior Court to condemn the property \u201cto build a road between Wildwood Avenue and Fairview Avenue.\u201d The court supported the city\u2019s action to seize the property for public use.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Seven months later, on Jan. 29, 1925, the Dearings agreed to sell their home. Shortly after, the couple divorced, and Sidney moved to Oakland, where he spent the rest of his life until his death. Ir\u00e9ne <a href=\"https:\/\/piedmonthistorical.org\/__trashed.html\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:moved;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">moved<\/a> to the borough of Manhattan in New York with her mother and daughters and became a telephone operator.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Sidney passed away at 83 on Oct. 6, 1983. His death certificate says he succumbed to inanition, or starvation. (Courtesy of Meghan Burnett)<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Three months after the sale, a local newspaper advertised the sale of the property. The road was never built. Piedmont didn\u2019t see its next Black homeowner until the 1950s or 1960s. The consequences of these exclusionary housing practices persist today.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">In 2020, then-Piedmont City Council member and professional city planner Tim Rood told a local newspaper that \u201c68% of Piedmont\u2019s total land area, and over 99% of its residential land, is reserved for the most expensive form of housing ever invented \u2013 the detached single-family home.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The zoning laws have created segregated neighborhoods, making Piedmont \u201cone of the top cities in the Bay Area of California in need of zoning reform,\u201d the lawsuit said.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">However, just as it was in the 1920s, Black families are less likely to own homes within the Bay Area region, including Alameda County, where Piedmont is.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The East Bay region is heavily Black. Alameda County, however, has the second-lowest rate of Black households in the region, according to <a href=\"https:\/\/www.bayareaequityatlas.org\/research\/projects\/black-in-the-bay\/homeownership\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:research;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">research<\/a> by the Bay Area Equity Atlas. Despite being home to three of the largest cities in the Bay Area \u2014 including Oakland \u2014 Alameda has nearly 30,000 more Black renters than homeowners. Between 2010 and 2020, this region lost 5,000 Black owner-occupied households, while the number of Black renter households increased slightly.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The city has taken an active role in trying to reckon with its past.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Six years ago, after the death of George Floyd, the Piedmont City Council passed a <a href=\"https:\/\/piedmont.ca.gov\/common\/pages\/DisplayFile.aspx?itemId=16929873\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:resolution;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">resolution<\/a> to fly the Black Lives Matter flag.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cThe City of Piedmont acknowledges, apologizes for, and condemns all racially motivated, discriminatory or exclusionary aspects of the City\u2019s history, and deeply regrets the pain or suffering such policies have caused to any person,\u201d the resolution said.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Sometime after, Meghan Bennett, a native who had been researching Black history in Piedmont, made her research public, which led to the city\u2019s <a href=\"https:\/\/piedmontexedra.com\/2023\/11\/piedmonters-work-to-unearth-buried-history-paved-way-for-dearing-memorial-project\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:recognition;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">recognition<\/a> of the need to memorialize the Dearing family. By 2022, the city reached out to <a href=\"https:\/\/piedmontexedra.com\/2023\/11\/piedmonters-work-to-unearth-buried-history-paved-way-for-dearing-memorial-project\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:work;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">work<\/a> with the descendants and stakeholders to start the process.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">There is more work to be done, one of Ackerman\u2019s attorneys told Capital B. Arnold Brown II, with Seyfarth Shaw LLP, notes the country can\u2019t turn a blind eye to these acts and seek justice to repair the harm.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cThese acts of racial harm, we can see them perpetuated over and over again,\u201d Brown told Capital B. \u201cIt\u2019s important to address them.
