{"id":179218,"date":"2026-02-15T17:01:08","date_gmt":"2026-02-15T17:01:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/179218\/"},"modified":"2026-02-15T17:01:08","modified_gmt":"2026-02-15T17:01:08","slug":"san-joses-mask-policy-holds-despite-federal-ruling","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/179218\/","title":{"rendered":"San Jose&#8217;s mask policy holds despite federal ruling"},"content":{"rendered":"<p>A federal judge has temporarily blocked California from enacting a law that would ban federal agents from wearing masks \u2014 but a similar policy in San Jose remains intact.<\/p>\n<p>On Feb. 9, federal Judge Christina Snyder <a href=\"https:\/\/apnews.com\/article\/california-mask-ban-ice-agents-lawsuit-715a24629f112ca3f12b0b619461dc60\" rel=\"nofollow noopener\" target=\"_blank\">ruled<\/a> that California\u2019s \u201cNo Secret Police Act\u201d appears to be discriminatory since it only bans federal agents from wearing masks and not state law enforcement. The law was supposed to take effect Jan. 1, but was halted following a lawsuit from President Donald Trump\u2019s administration. Snyder\u2019s ruling also upheld the \u201cNo Vigilantes Act,\u201d which requires law enforcement to display names or badges when on duty.<\/p>\n<p>San Jose Councilmember Peter Ortiz \u2014 who initiated <a href=\"https:\/\/sanjosespotlight.com\/san-jose-council-approves-policies-to-freeze-ice-out\/\" rel=\"nofollow noopener\" target=\"_blank\">San Jose\u2019s anti-mask policy<\/a> to address <a href=\"https:\/\/sanjosespotlight.com\/santa-clara-county-immigration-advocates-speak-against-ice-violence\/\" rel=\"nofollow noopener\" target=\"_blank\">community concerns<\/a> about U.S. Immigration and Customs Enforcement (ICE) \u2014 said he confirmed with the city attorney the ruling has no effect on the city\u2019s policy because it applies to all law enforcement.<\/p>\n<p>\u201cThis is a significantly important issue for the safety and welfare of our community, and this decision upholds the right of the state and local government to protect its citizens,\u201d Ortiz told San Jos\u00e9 Spotlight.<\/p>\n<p>City Attorney Susana Alcala Wood did not respond to requests for comment.<\/p>\n<p>The San Jose City Council passed a <a href=\"https:\/\/sanjosespotlight.com\/san-jose-advances-plan-for-ice-agents-to-identify-themselves\/\" rel=\"nofollow noopener\" target=\"_blank\">similar policy<\/a> requiring law enforcement officers to identify themselves along with it\u2019s anti-mask measure last fall. San Jose leaders have also <a href=\"https:\/\/sanjosespotlight.com\/san-jose-bans-ice-from-using-its-properties\/\" rel=\"nofollow noopener\" target=\"_blank\">banned ICE from using city properties<\/a>\u00a0for immigration enforcement activities.<\/p>\n<p>Snyder\u2019s ruling leaves open the possibility for future state legislation banning federal agents from wearing masks if it applies to all law enforcement. State Sen. Scott Weiner, who proposed the \u201cNo Secret Police Act,\u201d has said he will immediately introduce new legislation to include state police in the law.<\/p>\n<p>\u201cICE and Border Patrol are covering their faces to maximize their terror campaign and to insulate themselves from accountability,\u201d Weiner said in a statement. \u201cWe will ensure our mask ban can be enforced.\u201d<\/p>\n<p>In her opinion, Snyder wrote the two state laws \u201cserve the public interest by promoting transparency\u201d and that there is no reasonable justification for law enforcement to hide their identities.
