{"id":187088,"date":"2026-02-21T04:13:13","date_gmt":"2026-02-21T04:13:13","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/187088\/"},"modified":"2026-02-21T04:13:13","modified_gmt":"2026-02-21T04:13:13","slug":"supreme-court-says-trumps-tariffs-are-unconstitutional-bringing-relief-and-new-questions-to-long-beach-l-a-ports","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/187088\/","title":{"rendered":"Supreme Court says Trump\u2019s tariffs are unconstitutional, bringing relief \u2014 and new questions \u2014 to Long Beach, L.A. ports"},"content":{"rendered":"<p>The Supreme Court on Friday struck down a large chunk of President Donald Trump\u2019s tariff agenda, delivering a major rebuke of a key economic policy that experts say brings immediate relief to shippers but raises new questions about the president\u2019s next moves and when, or if, anyone will be refunded for tariffs they already paid.<\/p>\n<p>In a 6-3 ruling, the court decided that a 1977 law meant for national emergencies did not justify most of the tariffs that the Trump administration <a href=\"https:\/\/lbpost.com\/news\/ports\/tariff-truce-long-beach-port-impact-local-businesses\/\" rel=\"nofollow noopener\" target=\"_blank\">unveiled<\/a> last April. It\u2019s the first time the conservative-leaning court has overruled one of Trump\u2019s second-term policies.\u00a0<\/p>\n<p>In a statement Friday, Long Beach Port CEO Noel Hacegaba said he hopes the ruling brings \u201cgreater certainty to the supply chain.\u201d<\/p>\n<p>\u201cFor now,\u201d he added, \u201cthe only certainty is more uncertainty.\u201d<\/p>\n<p>\u201cThe Port of Long Beach customers and logistics partners depend on clear, predictable trade policy to plan investments, move cargo efficiently, and keep goods flowing to American businesses and consumers,\u201d he added. \u201cAn orderly approach to tariffs helps businesses plan, and ports like Long Beach maximize their contribution to the U.S. economy.\u201d<\/p>\n<p>A spokesperson for Hacegaba said Port officials will share more details on the decision\u2019s effects at a news conference on Wednesday.\u00a0<\/p>\n<p>This comes as the city seaport <a href=\"https:\/\/lbpost.com\/news\/ports\/after-the-busiest-year-ever-port-of-long-beach-ceo-says-he-wants-to-double-cargo-by-2050\/\" rel=\"nofollow noopener\" target=\"_blank\">finished<\/a> its busiest year on record \u2014 9.9 million TEUs, or cargo containers \u2014 and entered the new year with aspirations to move at least another 9 million containers despite headwinds from federal tariffs. The Port of Los Angeles ended the year at 10.2 million TEUs, making it the nation\u2019s busiest for the 23rd year in a row. But the LA Port reported a 13% drop in imports in January, which Executive Director Gene Seroka attributed in part to tariff policies.\u00a0<\/p>\n<p>Seroka said the court\u2019s decision will affect \u201ctwo thirds of the tariffs that have been collected to date\u201d and will \u201copen new avenues of uncertainty.\u201d<\/p>\n<p>Some experts now posit whether the Supreme Court could force the government to pay hefty refunds to importers. The federal government has collected about $130 billion in import taxes under the act.\u00a0<\/p>\n<p>\u201cFirst, there is not yet clarity on whether there will be refunds from the U.S. Treasury Department on tariffs already paid,\u201d Seroka said. \u201cSecond, the administration has already announced a new 10% global tariff in the wake of the ruling with no indication as to when that will take effect.\u201d<\/p>\n<p>Nevertheless, the ruling dealt a massive blow to one of Trump\u2019s boldest assertions of executive power since retaking office. Trump imposed tariffs to aggressively reshape U.S. trade policy, upending decades of agreements and collecting tens of billions of dollars under the International Emergency Economic Powers Act, or IEEPA, which grants authority to regulate international trade during a national emergency.<\/p>\n<p>But this use was unconstitutional, according to Chief Justice John Roberts, who wrote in the opinion that the president had exceeded his authority in imposing what amounted to taxes, a power reserved for the legislative branch.\u00a0<\/p>\n<p>\u201cAnd they gave Congress \u2018alone \u2026 access to the pockets of the people,\u201d the opinion reads. \u201cThe Framers did not vest any part of the taxing power in the executive branch.\u201d<\/p>\n<p>Speaking to several of the nation\u2019s governors on Friday, Trump <a href=\"https:\/\/www.nytimes.com\/2025\/02\/20\/us\/politics\/supreme-court-trump-tariffs.html\" rel=\"nofollow noopener\" target=\"_blank\">called<\/a> the ruling a \u201cdisgrace.\u201d<\/p>\n<p>Congressman Robert Garcia, D-Long Beach, praised the decision Friday, saying tariffs have only \u201craised costs for small businesses, consumers and families.\u201d<\/p>\n<p>\u201cDonald Trump has caused chaos globally with his reckless tariff policies that have raised prices and impacted America\u2019s ports,\u201d Garcia said. \u201cThe Supreme Court has made it clear that these tariffs are illegal and harming consumers.
