{"id":195839,"date":"2026-02-27T02:44:17","date_gmt":"2026-02-27T02:44:17","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/195839\/"},"modified":"2026-02-27T02:44:17","modified_gmt":"2026-02-27T02:44:17","slug":"judge-blocks-ice-from-re-detaining-san-francisco-nanny-nbc-bay-area","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/195839\/","title":{"rendered":"Judge blocks ICE from re-detaining San Francisco nanny \u2013 NBC Bay Area"},"content":{"rendered":"<p>A federal judge in San Francisco issued a preliminary injunction Wednesday blocking ICE from re-detaining a 66-year-old nanny from Russia, who immigration agents <a href=\"https:\/\/www.nbcbayarea.com\/investigations\/judge-ice-detention-russian-nanny\/4035350\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">first arrested<\/a> outside her employer\u2019s Diamond Heights home two weeks ago.<\/p>\n<p>The nanny has an active asylum case and no criminal record, according to immigration attorney Ghassan Shamieh, who was retained by the woman\u2019s employer immediately following her arrest.<\/p>\n<p>That same day, Shamieh filed a lawsuit challenging the legality of her detention \u2013 called a \u201chabeas corpus petition\u201d \u2013 and ICE was forced to release the nanny within hours in response to a judge\u2019s order, which called the arrest \u201cinexplicable.\u201d<\/p>\n<p>Immigration attorneys across the country have been filing immigration-related habeas petitions in record numbers in response to the wave of ICE arrests since President Donald Trump began his second term.<\/p>\n<p>Shamieh said his client was already being transported to the California City Detention Facility in the Mojave Desert. <\/p>\n<p>ICE did not respond to NBC Bay Area\u2019s request to discuss the case, but argued in court following the nanny\u2019s release that the agency has the discretion to hold her in detention as her asylum case moves forward.<\/p>\n<p>In Wednesday\u2019s order, however, federal Judge Jacqueline Scott Corley disagreed that the agency could detain the woman absent a bond hearing.<\/p>\n<p>\u201cIf the government seeks to re-detain Petitioner, it must provide no less than seven days\u2019 notice and a pre-detention hearing during which a neutral decisionmaker must consider whether Petitioner is either a danger to the community or flight risk such that her physical custody is required,\u201d Corley wrote in her order.<\/p>\n","protected":false},"excerpt":{"rendered":"A federal judge in San Francisco issued a preliminary injunction Wednesday blocking ICE from re-detaining a 66-year-old nanny&hellip;\n","protected":false},"author":2,"featured_media":36050,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[30],"tags":[14,32521,101,103,102,104,106,105],"class_list":{"0":"post-195839","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-san-francisco","8":"tag-immigration","9":"tag-investigative-unit","10":"tag-san-francisco","11":"tag-san-francisco-headlines","12":"tag-san-francisco-news","13":"tag-sf","14":"tag-sf-headlines","15":"tag-sf-news"},"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/posts\/195839","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/comments?post=195839"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/posts\/195839\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/media\/36050"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/media?parent=195839"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/categories?post=195839"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/tags?post=195839"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
