artificial intelligence<\/a> company xAI failed to convince a California federal \u200ccourt on Thursday to temporarily block the state’s law \u200crequiring companies to disclose information about the data they use to train \u200bAI models.<\/p>\nU.S. District Judge Jesus Bernal in Los Angeles said that xAI had not yet shown it was likely to prove the law violated its free-speech rights or was otherwise \u200cunconstitutional.<\/p>\n
Spokespeople for xAI did \u2060not immediately respond to a request for comment on the ruling. A spokesperson for the \u2060California Department of Justice said the department “celebrates this key win and remains committed to continuing our defense” of the law.<\/p>\n
California’s law, \u200benacted \u200bby Governor Gavin Newsom in \u200bSeptember 2024, requires generative AI \u200ccompanies to publicly post a summary of the datasets used to train their systems. The data transparency law went into effect on January 1, and is part of the state’s broader push to regulate AI companies.<\/p>\n
xAI sued the state \u200cin December. It argued the law \u200bviolated its free-speech rights under the \u200bU.S. Constitution and \u200bwould force the company to reveal trade secrets \u200cabout how its AI models \u200bare trained.<\/p>\n
Bernal on \u200bThursday denied xAI’s request for a preliminary injunction to halt the law’s enforcement, finding the company had not \u200bshown at this stage \u200cin the case that its lawsuit was likely to \u200bsucceed.<\/p>\n
