{"id":233114,"date":"2026-03-23T21:36:08","date_gmt":"2026-03-23T21:36:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/233114\/"},"modified":"2026-03-23T21:36:08","modified_gmt":"2026-03-23T21:36:08","slug":"former-san-diego-councilmember-sues-over-empty-home-tax-ballot-measure","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/233114\/","title":{"rendered":"Former San Diego councilmember sues over empty home tax ballot measure"},"content":{"rendered":"<p>Former San Diego councilmember Scott Sherman challenges Measure A over a flawed analysis and misleading terms in its taxation of vacant second homes.<\/p>\n<p>SAN DIEGO \u2014 Former San Diego city councilmember Scott Sherman has filed a court petition seeking substantive changes to a proposed ballot measure that, if passed, would tax owners of additional homes that sit empty for more than half the year.\u00a0<\/p>\n<p>In the writ of mandate obtained by CBS 8, former mayoral candidate Sherman claims that San Diego City Attorney Heather Ferbert&#8217;s impartial analysis of Measure A, also known as the &#8216;Empty Homes Tax,&#8217; is false and misleading. Sherman also named City Clerk Diana Fuentes for her capacity as the city&#8217;s elections officer.\u00a0<\/p>\n<p>                <img decoding=\"async\" class=\"photo__placeholder\" loading=\"eager\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2026\/03\/3b65d77d-9c20-416b-9c1e-90ca1761bdba_16x9.jpg\"\/><br \/>\n                <img decoding=\"async\" class=\"photo__main\" loading=\"eager\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2026\/03\/3b65d77d-9c20-416b-9c1e-90ca1761bdba_1140x641.jpg\"  alt=\"\" style=\"opacity:0\" onload=\"this.style.opacity=1\"\/><\/p>\n<p>In the legal challenge, Sherman&#8217;s attorneys argue that everything from the ballot title to the City Attorney&#8217;s analysis is flawed because there is no clear definition of an &#8220;empty home.&#8221;<\/p>\n<p>&#8220;The subject homes are not necessarily &#8217;empty&#8217;; rather, Measure A defines &#8217;empty&#8217; by the number of &#8216;vacant&#8217; days, with &#8216;vacant&#8217; undefined. This use of &#8217;empty,&#8217; with an artificial definition inconsistent with the plain meaning of &#8217;empty,&#8217; is both false and misleading,&#8221; reads the Writ of Mandate.\u00a0<\/p>\n<p>Sherman also claims that the city attorney\u2019s summary is not a true and impartial statement of the measure\u2019s purpose and will likely create voter prejudice, thus violating the city&#8217;s elections code.\u00a0<\/p>\n<p>According to the ballot measure, owners of so-called empty homes will be taxed $8,000 a year if they remain vacant for 182 days. \u00a0Doing so, reasoned councilmembers, could generate anywhere from $12 Million to $30 Million annually.<\/p>\n<p>The millions in extra revenue would help fill next year&#8217;s widening budget gap, <a href=\"https:\/\/www.instagram.com\/reel\/DVPqW6JEQRy\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">recently estimated at $120 million.<\/a><\/p>\n<p>Councilmember Sean Elo-Rivera first introduced \u201cEmpty Second Home and Vacation Rental Tax\u201d to the city&#8217;s Rules Committee in January. The majority of councilmembers on the committee opposed the proposal because it included vacation homes and would unfairly punish those whose income comes from rental properties.\u00a0<\/p>\n<p>Councilmember Elo-Rivera amended the proposal to tax the estimated 5,115 properties instead.<\/p>\n<p>Sherman&#8217;s attorneys are asking for a judge to &#8220;forbid&#8221; the printing of the measure&#8217;s legal analysis and remove any mention of &#8220;empty&#8221; in the ballot measure.\u00a0<\/p>\n<p>CBS 8 reached out to the City Attorney&#8217;s Office for comment.
