Beyond the actual edible structure itself, the footprint of the gigantic cake also included surrounding lawns and roads. Back then, the <a href=\"https:\/\/www.sfgate.com\/food\/article\/viral-dancing-robot-haidilao-22088101.php\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">Cupertino<\/a> shopping center was <a href=\"https:\/\/www.facebook.com\/groups\/SanJoseHistory\/posts\/3049809831816897\/\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">lush and fountain-filled<\/a>. Shifts in consumer behavior led to the mall being <a href=\"https:\/\/www.sfchronicle.com\/business\/article\/A-dying-mall-near-Apple-s-headquarters-is-13417634.php\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">largely demolished in 2018<\/a>. This is a blow to the city of <a href=\"https:\/\/www.census.gov\/quickfacts\/fact\/table\/cupertinocitycalifornia\/PST045224\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">roughly 60,000<\/a>, which was relying on the redevelopment to fulfill a significant portion of its <a href=\"https:\/\/www.cupertino.gov\/files\/assets\/city\/v\/1\/departments\/documents\/community-development\/planning\/major-projects\/housing-element-update\/2nd-draft-housing-element-submitted-to-hcd-oct-16-2023.pdf\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">state-mandated affordable housing goals<\/a>.<\/p>\n<p>Now it\u2019s falling short of those goals.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>On\u00a0Feb. 27, city staff gave <a href=\"https:\/\/www.shpco.com\/\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">Sand Hill Property Company<\/a>, which owns the nearly 51-acre Vallco site, permission to decrease the number of lower- and moderate-income units from 890 to 356 in the project. Situated between Interstate 280 and Stevens Creek Boulevard and on both sides of North Wolfe Road, the 4.8 million-square-foot mixed-used development is a mile from Apple\u2019s headquarters. In addition to housing, including buildings that rise to up to 85 feet tall, it is also set to feature parklands, office space, a Hyatt hotel and retail shops. The old mall topped out at three stories with the opening of an <a href=\"https:\/\/elestoque.org\/2018\/04\/04\/news\/amc-cupertino-square-16-closes-doors\/\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">AMC Theatres in 2007<\/a>.<\/p>\n<p>\u2018A bait and switch\u2019<\/p>\n<p>Once a vibrant shopping hub, Vallco now is a dying mall clinging to life: It houses only an ice rink, Benihana and a bowling alley.\u00a0<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p><img alt=\"Today, the Vallco property is home to an ice rink,\u00a0Benihana and a bowling alley.\" loading=\"lazy\"   style=\"aspect-ratio:3 \/ 2\" class=\"x100 y100 opc bgpc ofcv bgscv block bg-gray200 mnh0px fill\"\/><\/p>\n<p>Today, the Vallco property is home to an ice rink,\u00a0Benihana and a bowling alley.<\/p>\n<p>Google Maps<\/p>\n<p>The project, known as <a href=\"https:\/\/therisecalifornia.com\/\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">The Rise<\/a>, <a href=\"https:\/\/sanjosespotlight.com\/controversial-vallco-project-can-continue-under-sb-35-judge-rules\/\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">qualifies for streamlined approvals<\/a> under <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=201720180SB35\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">Senate Bill 35<\/a> \u2014 a 2017 law that requires cities to greenlight changes to projects that include affordable housing units, so long as they fulfill certain parameters. These include maintaining a set percentage of affordable units and using union labor for construction. They\u2019re [developers] getting out of building the affordable units that they don\u2019t really want to do because that doesn\u2019t make them money.\u201d<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>At a <a href=\"https:\/\/www.youtube.com\/watch?v=ehTlSBJoCvY\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">Dec. 1 meeting to discuss the changes<\/a>, then-Cupertino Mayor Liang Chao said the staff had little time to review them since <a href=\"https:\/\/sanjosespotlight.com\/cupertino-vallco-development-reduces-its-affordable-housing\/\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">the holidays were coming up<\/a> and the changes were \u201cvery conveniently timed \u2026 to screw us.\u201d<\/p>\n<p><img alt=\"Renderings of the proposed mixed-used development on the former Vallco mall property in Cupertino, Calif.\" loading=\"lazy\"   style=\"aspect-ratio:3 \/ 2\" class=\"x100 y100 opc bgpc ofcv bgscv block bg-gray200 mnh0px fill\"\/><\/p>\n<p>Renderings of the proposed mixed-used development on the former Vallco mall property in Cupertino, Calif.<\/p>\n<p>Sand Hill Property Company<\/p>\n<p>The South Bay city is <a href=\"https:\/\/www.cupertino.gov\/files\/assets\/city\/v\/1\/departments\/documents\/community-development\/planning\/major-projects\/housing-element-update\/2nd-draft-housing-element-submitted-to-hcd-oct-16-2023.pdf\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">chasing a 2031 deadline<\/a> to build 4,588 new units of housing in light of the state\u2019s <a href=\"https:\/\/www.ppic.org\/interactive\/californians-and-the-housing-crisis\/\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">housing affordability crisis<\/a>. Cupertino has <a href=\"https:\/\/cupertinotoday.com\/2025\/08\/15\/state-agency-finds-cupertino-is-again-in-violation-of-housing-law-city-disagrees\/\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">been at odds with the state<\/a> over building more housing, including 2,635 low- to moderate-income units. <a href=\"https:\/\/cupertinotoday.com\/2023\/02\/09\/housing-advocates-sue-santa-clara-county-cupertino-and-others-over-missed-housing-element-deadlines\/\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">In 2023<\/a>, three nonprofit housing advocacy groups sued Cupertino, among other jurisdictions, for not submitting their housing plans in time to the state.\u00a0<\/p>\n<p>Housing in the suburb, like much of the Bay Area, is pricey. The average rent for an apartment in\u00a0Cupertino was $3,858 per month in March, according to <a href=\"https:\/\/www.rentcafe.com\/average-rent-market-trends\/us\/ca\/santa-clara-county\/cupertino\/\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">data from RentCafe<\/a>. For very low-income households of four in Santa Clara County, affordable one-bedroom housing <a href=\"https:\/\/www.smcgov.org\/media\/154289\/download?inline=\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">is defined<\/a> as units with monthly rent of $1,836 or less.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>Despite the reduction in affordable units, Sand Hill is increasing the number of housing units in the development at 10123\u00a0N. Wolfe Road from 2,402 units to 2,669 using <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=65915&amp;lawCode=GOV\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">density bonus laws<\/a>. Affordable housing made up half of all units in the original plans submitted to the city in 2018. Per SB 35, some 20% of units must be classified as lower income, but that is based on the base number of units, not those included in the bonus density, so the overall number is closer to 13%, according to planning documents.<\/p>\n<p>Developers reduced office and retail space in the plans, too. They say the reduced office space will decrease the project\u2019s traffic impacts.<\/p>\n<p>Reaction to changes, and what comes next<\/p>\n<p>The city must now look for additional sites to build low- and moderate-income housing but hasn\u2019t found any, Moore said on Thursday. Cupertino had already suffered a blow in January when two other developers shrunk plans \u2014 the Dividend Homes development at 20111 Stevens Creek Blvd. slashed 45 of its affordable housing units, and SummerHill at 20840 Stevens Creek Blvd. cut 59, according to planning documents.\u00a0<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>The Rise project has been in the works since 2014. Residents have pushed back against the project, which they have called\u00a0<a href=\"https:\/\/www.sfgate.com\/business\/article\/Cupertino-approves-Vallco-development-south-of-13243335.php\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">too dense <\/a>for suburban\u00a0Cupertino. <a href=\"https:\/\/www.sfchronicle.com\/business\/article\/Cupertino-s-giant-Vallco-project-near-Apple-15254492.php?cmpid=gsa-sfgate-result\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">In 2020<\/a>, neighbors who didn\u2019t want the mall developed lost a lawsuit that alleged that the city improperly approved the project.<\/p>\n<p>Leora Tanjuatco Ross, California director for <a href=\"https:\/\/yimbyaction.org\/\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">YIMBY Action<\/a>, said that all housing built at the Vallco site will benefit renters by increasing the overall supply of options and chip away at the state deficit.<\/p>\n<p><img alt=\"Renderings of the proposed mixed-used development on the former Vallco mall property in Cupertino, Calif.\" loading=\"lazy\"   style=\"aspect-ratio:3 \/ 2\" class=\"x100 y100 opc bgpc ofcv bgscv block bg-gray200 mnh0px fill\"\/><\/p>\n<p>Renderings of the proposed mixed-used development on the former Vallco mall property in Cupertino, Calif.<\/p>\n<p>Sand Hill Property Company<\/p>\n<p>\u201cThe reality is that affordable housing is more expensive than ever to build and maintain,\u201d she said in an email to SFGATE. \u201cWe\u2019ve supported this proposal from Day 1, over 10 years ago, and we wholeheartedly support it now. Bedrooms should be prioritized over vacant retail spaces.\u201d<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>Ilya Gurin, volunteer lead with <a href=\"https:\/\/southbayyimby.org\/\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">South Bay YIMBY<\/a>, is not surprised by the reduction in affordable units. He noted that delays in the project have come \u201clargely because the city has been conflicted about what it wants.\u201d<\/p>\n<p>\u201cThe reality of housing development is that the longer a project is delayed, the more costs increase, which necessarily reduces the community benefits (such as subsidized affordable housing) that the developer can afford to provide,\u201d he said in an email. \u201cMacroeconomic conditions continue to be unfavorable, so cities all over the region are grappling with pipeline projects reducing the number of affordable units from earlier projections, even sites that haven&#8217;t experienced as much conflict as Vallco.\u201d<\/p>\n<p>However, this is still a net positive according to Gurin.<\/p>\n<p>\u201cAny affordable housing is more than this site has ever had, so Cupertino should take the win,\u201d he said.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>Members\u00a0of <a href=\"https:\/\/www.cupertinoforall.org\/\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">Cupertino For All,<\/a> a volunteer-led pro-housing group, are disappointed in the percentage of below-market-rate units now included in the plan.\u00a0<\/p>\n<p><img alt=\"A view of the\u00a0Vallco mall property, where part of the mall was demolished in 2018, in Cupertino, Calif. There are plans to redevelop the whole property as a mixed-use development.<\/p>\n<p>Google Satellite<\/p>\n<p>\u201cThe laws are confusing, but the impact is not,\u201d said Yvonne\u00a0Thorstenson, Connie Cunningham and the board of directors for\u00a0Cupertino For All in an email to SFGATE. \u201c[We are] disappointed that the reduced number of affordable homes will result in a severe limit to the number of households that can live there. &#8230; We find it truly disappointing when people who have a comfortable place to live will go out of their way to deny safe and decent housing opportunities for others.\u201d<\/p>\n<p>In the Bay Area, this is common practice.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>Developers of a project to transform a more-than-century-old bus storage and maintenance facility in San Francisco\u2019s Mission District into housing cut their project\u2019s affordable units from <a href=\"https:\/\/missionlocal.org\/2025\/10\/massive-465-unit-mission-district-affordable-housing-project-slashed-to-just-100-units\/\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">465 to 100 in 2025<\/a>. <a href=\"https:\/\/www.paloaltoonline.com\/housing\/2025\/09\/03\/council-allows-east-palo-alto-housing-project-to-reduce-affordable-housing\/\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">In East Palo Alto<\/a>, Sand Hill Property Company also reduced the number of affordable apartments and townhouses in a development that includes more than 250 units of housing at University Avenue and Bay Road.<\/p>\n<p>In the meantime, construction workers should begin paving roadways on the site this spring, Moulds said.<\/p>\n<p>He chalked up the request to cut lower-income housing to help with necessary cost-cutting because of interest rate hikes, economic uncertainties and the increase in remote work.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>\u201cWe think it is important to take a big swing at this [housing affordability] crisis, which is why we planned for roughly two-thirds of the total project\u2019s affordable homes to be delivered in the first phase alone, allowing the first move-ins within a few years from now,\u201d developers said in a <a href=\"https:\/\/therisecalifornia.com\/town-square-west-first-phase-november-2025\/\" data-link=\"native\" rel=\"noopener nofollow\" target=\"_blank\" class=\"\">November 2025 blog post<\/a>.\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"A huge, mall-shaped cake was created to celebrate\u00a0Vallco Fashion Park\u2019s grand opening in 1976.
