(File photo courtesy UC Berkeley Law)<\/p>\n<p>SAN DIEGO \u2013 A driver who struck and killed a woman who was sitting on a curb in Ocean Beach has pleaded guilty to hit and run and possession of nitrous oxide, otherwise known as laughing gas.<\/p>\n<p>The prosecutor said on Friday that the driver, <a href=\"https:\/\/timesofsandiego.com\/crime\/2025\/12\/06\/driver-charged-killing-woman-ocean-beach\/\" rel=\"nofollow noopener\" target=\"_blank\">Evan Anderson<\/a>, will receive a sentence of two years\u2019 probation, \u201cwith custody to be decided at sentencing.\u201d<\/p>\n<p>The maximum sentence is four years and six months in state prison, though San Diego Superior Court Judge Marian Gaston announced the defendant would likely receive probation. A year in jail is also possible.<\/p>\n<p>The <a href=\"https:\/\/www.sdcda.org\/\" rel=\"nofollow noopener\" target=\"_blank\">Deputy District Attorney<\/a>, whose name, Evan Andersen, is similar to the defendant\u2019s, said he did not sign the plea agreement, which sometimes occurs if the prosecutor doesn\u2019t agree with the terms.<\/p>\n<p>Gaston set Anderson\u2019s sentencing for April 20 and allowed him to remain free on bond.<\/p>\n<p>The incident occurred on Nov. 4, 2025. Tracy Condon, 59, was sitting on a curb at Santa Monica Avenue near Sunset Cliffs Boulevard when Anderson struck her around 5 p.m. as he went to park. She was seated next to her wheelchair.<\/p>\n<p>Anderson fled, leaving his Toyota Tundra pick-up at the scene, but he returned some hours later and was arrested.<\/p>\n<p>A memorial service, attended by approximately 60 people, was held on Nov. 12 for Condon at the end of Newport Avenue. She got to know a lot of people in Ocean Beach and once delivered meals to homeless residents.<\/p>\n<p>\u201cShe was a good person, good spirit,\u201d said her daughter Jesse Jax at the memorial service, which was covered by NBC 7.<\/p>\n<p>\u201cIt\u2019s important to remember that we are all human,\u201d said Carter Moss, the pastor at Submerge Church in Ocean Beach, after the memorial. \u201cWe are all loved and worthy.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"A gavel.
