{"id":24529,"date":"2025-10-26T20:34:12","date_gmt":"2025-10-26T20:34:12","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/24529\/"},"modified":"2025-10-26T20:34:12","modified_gmt":"2025-10-26T20:34:12","slug":"scholarship-for-black-students-at-uc-san-diego-rebranded-after-suit-alleges-discrimination","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/24529\/","title":{"rendered":"Scholarship for Black students at UC San Diego rebranded after suit alleges discrimination."},"content":{"rendered":"\n<p>A scholarship for Black students at UC San Diego is now available to anyone, regardless of race, after students and a right-leaning nonprofit organization <a class=\"link\" href=\"https:\/\/pacificlegal.org\/case\/ucsd-basf-scholarship-discrimination\/\" target=\"_blank\" rel=\"nofollow noopener\">sued<\/a> the university on claims of discrimination this July. <\/p>\n<p>The plaintiffs argued that the scholarship fund violated a series of laws, including the Ku Klux Klan Act of 1871, which was put in place to protect Black Americans in the South. <\/p>\n<p>One of the students, Kai Peters, said he was denied access to the scholarship because he isn\u2019t Black. Peters sent a written statement to CalMatters through the Californians for Equal Rights Foundation, the nonprofit plaintiff. He said his rejection is an example of \u201cinstitutionalized racism\u201d \u2014 a phrase that was created in part to characterize how government institutions discriminate against Black Americans. <\/p>\n<p>\u201cI don\u2019t see the irony,\u201d said Joshua Thompson, an attorney for the Pacific Legal Foundation, which represented the plaintiffs. \u201cThe idea is that we don\u2019t want government actors out forcing their discrimination.\u201d<\/p>\n<p>The Black Alumni Scholarship Fund for UC San Diego students is now called the <a class=\"link\" href=\"https:\/\/gasf-sandiego.com\/\" target=\"_blank\" rel=\"nofollow noopener\">Goins Alumni Scholarship Fund<\/a>, named after founding donor Lennon Goins, according to a news <a class=\"link\" href=\"https:\/\/www.sdfoundation.org\/news-events\/sdf-news\/san-diego-foundation-renames-a-major-scholarship-for-uc-san-diego-students-honoring-dr-lennon-goins\/\" target=\"_blank\" rel=\"nofollow noopener\">release<\/a> last week. Its website says each scholarship is worth $2,500 and that nearly 275 scholarships have been awarded since 2016.<\/p>\n<p>The rebranded scholarship program is one of numerous initiatives in California that have come under scrutiny in the last two years. Last summer, the Supreme Court overturned precedent that allowed private universities in the state to use affirmative action, and this year, the Trump administration has ended numerous campus initiatives <a class=\"link\" href=\"https:\/\/calmatters.org\/education\/higher-education\/2025\/09\/minority-student-funding-california\/\" target=\"_blank\" rel=\"nofollow noopener\">promoting diversity<\/a>. <\/p>\n<p>In March, the UC changed its hiring practices, banning its 10 campuses from requiring <a class=\"link\" href=\"https:\/\/calmatters.org\/education\/2025\/03\/university-of-california\/#:~:text=While%20they%20prepare%20for%20budget%20cuts%2C%20UC%20officials%20may%20also%20be%20trying%20to%20head%20off%20scrutiny%20of%20their%20efforts%20to%20promote%20diversity.\" target=\"_blank\" rel=\"nofollow noopener\">\u201cdiversity statements\u201d<\/a> as a condition for employment. Now those statements are voluntary.<\/p>\n<p>Other changes are more subtle. In February, Bakersfield College described its \u201cChicano\/Latino Pre-Commencement Event\u201d as a means to \u201cencourage <a class=\"link\" href=\"https:\/\/web.archive.org\/web\/20250211051115\/https:\/\/www.bakersfieldcollege.edu\/services-and-resources\/graduation\/pre-commencement\/chicano.html\" target=\"_blank\" rel=\"nofollow noopener\">Chicano\/Latino students<\/a> to participate in (graduation) celebrations.\u201d But by the time graduation rolled around in May, the word \u201cChicano\/Latino\u201d had been <a class=\"link\" href=\"https:\/\/www.bakersfieldcollege.edu\/services-and-resources\/graduation\/pre-commencement\/chicano.html\" target=\"_blank\" rel=\"nofollow noopener\">removed from that sentence<\/a>.<\/p>\n<p>Website indicates change of focus<\/p>\n<p>The news release about the Black Alumni Scholarship Fund didn\u2019t address the reason for the change. A spokesperson for the San Diego Foundation, Hiram Soto, declined to comment further.<\/p>\n<p>But a CalMatters analysis of the fund\u2019s website shows how the university changed course.<\/p>\n<p>In September, <a class=\"link\" href=\"https:\/\/web.archive.org\/web\/20250908003304\/https:\/\/basf-sandiego.com\/about-us\/\" target=\"_blank\" rel=\"nofollow noopener\">the website<\/a> said that the university scholarship fund was founded in 1983 by Goins to \u201cexpand educational opportunities for high achieving, civic-minded African American students,\u201d focusing on Black students with a record of \u201ccommunity service\u201d and \u201cresiliency to racial and other identity challenges.\u201d<\/p>\n<p>There was no mistake that this fund was by and for the Black community. \u201c100% of BASF Scholars identify as Black\/African American,\u201d the website said, adding that the goal of the scholarship fund was to \u201cincrease Black graduation at UCSD from 2% to 5% of degrees awarded.\u201d<\/p>\n<p>Despite decades of scholarships, that goal remains unattained. In the 2023-24 school year, <a class=\"link\" href=\"https:\/\/ir.ucsd.edu\/stats\/undergrad\/ug-degree.html\" target=\"_blank\" rel=\"nofollow noopener\">just under 3%<\/a> of UC San Diego\u2019s undergraduate degrees awarded went to students who identify as Black or African American, according to the system\u2019s data.<\/p>\n<p>Racial discrimination is illegal in the U.S., but in California, the standard of what constitutes discrimination depends in part on whether an entity is public or private. While private entities, including nonprofits and foundations, have long offered scholarships and programs for certain racial or ethnic groups \u2014 arguing that spending money is a form of free speech \u2014 state agencies, including the UC campuses, are prohibited from any form of affirmative action after California voters approved Proposition 209 in 1996. <\/p>\n<p>To avoid legal scrutiny, UC San Diego moved the Black Alumni Scholarship Fund to the private San Diego Foundation in 1998, according to the September iteration of the fund\u2019s website.<\/p>\n<p>But in the lawsuit, Thompson and his legal team alleged that the university has remained involved in the scholarship\u2019s operation. \u201cOur allegations were that [UC San Diego officials] were conspiring with a private entity to get around [Prop.] 209 and the Equal Protection Clause.\u201d Specifically, he said the university was giving the San Diego Foundation information about which students identified as Black on their college applications and that the leadership of the fund included some university officials.<\/p>\n<p>The Ku Klux Klan Act of 1871 prohibits government agencies from using private entities to discriminate. Back then, government agencies and law enforcement, especially in the South, often used private groups \u2014 most famously, the Ku Klux Klan \u2014 to terrorize Black communities. <\/p>\n<p>By working with the private foundation to support Black students, UC San Diego is guilty of the same kind of \u201cnefarious behavior\u201d as the government and law enforcement agencies of the Jim Crow South, Thompson said. \u201cThis is the full tradition of our civil rights laws,\u201d he said, citing both the Ku Klux Klan Act and more recent laws, such as Proposition 209. \u201cWe don\u2019t want the government to discriminate against people on the basis of race.\u201d<\/p>\n<p>Soon after filing the lawsuit, Thompson said the scholarship fund reached out to his legal team and agreed to change its name and to open up applications to students who didn\u2019t identify as Black.<\/p>\n<p>He said other changes may be on the horizon. In February, the Pacific Legal Foundation sued UC San Francisco\u2019s Benioff Children\u2019s Hospital regarding another program aimed at <a class=\"link\" href=\"https:\/\/pacificlegal.org\/case\/ucsf-minority-healthcare-scholarship-discrimination\/\" target=\"_blank\" rel=\"nofollow noopener\">minority high school students<\/a>. Thompson said the San Francisco university system is now negotiating how to continue with that program too.<\/p>\n<p>These negotiations happen informally, so there\u2019s no written settlement agreement to show how universities are responding and what changes actually occur.<\/p>\n<p>Today, the scholarship fund website says its applications are to open to UC San Diego students who are involved in community service and those with a demonstrated \u201cability to overcome major challenges,\u201d as well as other race-neutral criteria. <\/p>\n<p>The website includes no mention of Black students. <\/p>\n<p>Echelman writes for CalMatters.
