Gavin Newsom on Monday issued an <a href=\"https:\/\/www.gov.ca.gov\/wp-content\/uploads\/2026\/03\/3.30-FINAL-Trusted-AI-Procurement-EO-N-5-26.pdf\" rel=\"nofollow noopener\" target=\"_blank\">executive order<\/a> aimed at tightening oversight of artificial intelligence companies contracting with the state, an attempt at countering the Trump administration\u2019s more hands-off approach to AI regulation.<\/p>\n<p>The order directs state agencies to overhaul procurement standards and requires companies seeking state government contracts to demonstrate how their AI systems mitigate risks such as bias, civil rights violations and the spread of illegal or exploitative content.<\/p>\n<p>The order arrives amid escalating tension between states and Washington over AI regulation. <a href=\"https:\/\/statescoop.com\/trump-state-ai-law-order-clash-between-states-industry\/\" rel=\"nofollow noopener\" target=\"_blank\">Recent federal policy<\/a> has discouraged state-level rules in favor of a national framework, but California officials argue stronger guardrails are needed as AI systems are increasingly embedded in public services.<\/p>\n<p>\u201cCalifornia leads in AI, and we\u2019re going to use every tool we have to ensure companies protect people\u2019s rights, not exploit them or put them in harm\u2019s way,\u201d Newsom said in a <a href=\"https:\/\/www.gov.ca.gov\/2026\/03\/30\/as-trump-rolls-back-protections-governor-newsom-signs-first-of-its-kind-executive-order-to-strengthen-ai-protections-and-responsible-use\/\" rel=\"nofollow noopener\" target=\"_blank\">statement<\/a> about the order. \u201cWhile others in Washington are designing policy and creating contracts in the shadow of misuse, we\u2019re focused on doing this the right way.\u201d<\/p>\n<p>Under the directive, the state\u2019s Government Operations Agency and Department of Technology have 120 days to develop new certification and vetting processes for state vendors. Both will require contractors to clearly document safeguards against misuse, including discrimination and privacy harms, before deploying tools in public services.<\/p>\n<p>Newsom\u2019s executive order also calls for statewide standards on watermarking AI-generated content to help curb misinformation and improve transparency, building on California\u2019s broader push for greater AI governance.
