{"id":247632,"date":"2026-04-02T01:01:13","date_gmt":"2026-04-02T01:01:13","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/247632\/"},"modified":"2026-04-02T01:01:13","modified_gmt":"2026-04-02T01:01:13","slug":"california-suspends-enforcement-of-law-requiring-vcs-to-report-diversity-data","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/247632\/","title":{"rendered":"California Suspends Enforcement of Law Requiring VCs to Report Diversity Data"},"content":{"rendered":"<p>Under a new state regulation, venture capital firms operating in California were supposed to submit <a href=\"https:\/\/www.wired.com\/tag\/diversity-in-tech\/\" class=\"text link\" rel=\"nofollow noopener\" target=\"_blank\">demographic data<\/a> about their portfolio companies, including the gender and race of startup founders they backed. But amid public criticism from some tech leaders, the California agency administering the new requirement suspended it just before the Wednesday deadline for firms to make their first disclosures.<\/p>\n<p class=\"paywall\">\u201cThe California Department of Financial Protection and Innovation (DFPI) has announced that it plans to initiate rulemaking in response to comments by various stakeholders relating to the Fair Investment Practices by Venture Capital Companies Law,\u201d the state agency <a href=\"https:\/\/dfpi.ca.gov\/regulated-industries\/vcc-reporting-program\/\" class=\"text link\" rel=\"nofollow noopener\" target=\"_blank\">posted<\/a> on its website in mid-March. \u201cImplementation and enforcement of the [law] will be suspended pending completion of the rulemaking and until final regulations are in place.\u201d<\/p>\n<p class=\"paywall\">California lawmakers first <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billHistoryClient.xhtml?bill_id=202320240SB54\" class=\"text link\" rel=\"nofollow noopener\" target=\"_blank\">passed<\/a> the measure in 2023, and it was signed into law shortly thereafter by Governor Gavin Newsom. For decades, <a href=\"https:\/\/www.wired.com\/story\/in-banner-year-for-vc-women-still-struggle-to-get-funding\/\" class=\"text link\" rel=\"nofollow noopener\" target=\"_blank\">women<\/a> and <a href=\"https:\/\/www.wired.com\/story\/black-founders-succeed-spite-silicon-valley\/\" class=\"text link\" rel=\"nofollow noopener\" target=\"_blank\">people of color<\/a> have received only <a href=\"https:\/\/www.wired.com\/story\/venture-capital-2020-still-really-white\/\" class=\"text link\" rel=\"nofollow noopener\" target=\"_blank\">a small share<\/a> of overall startup funding relative to their representation in the US population. Lawmakers hoped putting more public scrutiny on investment decisions would help foster <a href=\"https:\/\/www.wired.com\/story\/black-investors-vc-funding-make-hire-send-wire\/\" class=\"text link\" rel=\"nofollow noopener\" target=\"_blank\">greater equity<\/a> in the market, including for people who are disabled, <a href=\"https:\/\/www.wired.com\/story\/thousands-of-veterans-want-to-learn-to-code-but-cant\/\" class=\"text link\" rel=\"nofollow noopener\" target=\"_blank\">retired military<\/a>, or <a href=\"https:\/\/www.wired.com\/story\/inside-the-gay-tech-mafia\/\" class=\"text link\" rel=\"nofollow noopener\" target=\"_blank\">LGBTQ+<\/a>.<\/p>\n<p class=\"paywall\">The law called for venture capital and some other investment firms to file annual reports starting March 1 of last year about the overall makeup of the founding teams they had invested in and the amount of money they provided to diverse founders. Firms were meant to collect the demographic data through a voluntary survey that was then anonymized. California authorities planned to publish the filings online. Lawmakers <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202320240SB164\" class=\"text link\" rel=\"nofollow noopener\" target=\"_blank\">amended<\/a> the law in 2024 to delay reporting until April 1, 2026, and enable the state to levy daily fines for noncompliance.<\/p>\n<p class=\"paywall\">The California Department of Financial Protection and Innovation did not immediately respond to a request for comment on the authority it used to sidestep the deadline set by lawmakers. Newsom\u2019s office also didn\u2019t immediately respond to a request for comment.<\/p>\n<p class=\"paywall\">Financiers focused on funding entrepreneurs from underrepresented backgrounds had supported the law. But the National Venture Capital Association, the tech investment industry\u2019s leading trade group, <a data-offer-url=\"https:\/\/nvca.org\/wp-content\/uploads\/2023\/09\/NVCA-Letter-re-SB-54-82823.pdf\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/nvca.org\/wp-content\/uploads\/2023\/09\/NVCA-Letter-re-SB-54-82823.pdf&quot;}\" href=\"https:\/\/nvca.org\/wp-content\/uploads\/2023\/09\/NVCA-Letter-re-SB-54-82823.pdf\" rel=\"nofollow noopener\" target=\"_blank\">opposed it<\/a>. The group argued that voluntary data collection would inflate diversity statistics and that publishing inaccurate data could lead to unfair attacks on investors genuinely trying to <a href=\"https:\/\/www.wired.com\/story\/vc-pledged-better-diversity-its-barely-changed\/\" class=\"text link\" rel=\"nofollow noopener\" target=\"_blank\">tackle diversity issues<\/a>. Over the past year, the Trump administration <a href=\"https:\/\/www.wired.com\/story\/anti-dei-agenda-reprogramming-america\/\" class=\"text link\" rel=\"nofollow noopener\" target=\"_blank\">has defunded and attacked<\/a> diversity, equity, and inclusion, or DEI, initiatives in both the public and private sectors, leading many businesses and organizations to <a href=\"https:\/\/www.wired.com\/story\/dei-died-this-year-maybe-it-was-supposed-to\/\" class=\"text link\" rel=\"nofollow noopener\" target=\"_blank\">pull back from them<\/a>.<\/p>\n<p class=\"paywall\">In February, the venture capital association <a data-offer-url=\"https:\/\/nvca.org\/document\/ca-sb54-implementation-letter\/\" class=\"external-link text link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/nvca.org\/document\/ca-sb54-implementation-letter\/&quot;}\" href=\"https:\/\/nvca.org\/document\/ca-sb54-implementation-letter\/\" rel=\"nofollow noopener\" target=\"_blank\">wrote to Newsom<\/a> asking for the reporting deadline to be pushed back again because, in its view, the state had bungled the process.
