SAN DIEGO (FOX 5\/KUSI) \u2014 The San Diego City Council unanimously passed a new law to restrict ICE agents in San Diego.<\/p>\n
In the wake of increased ICE activity in San Diego, city council leaders unanimously passed a new law 8-0 during its Tuesday meeting.<\/p>\n
\u201cI have been a 25-year U.S. citizen, and today I carry my passport card with me everywhere because I am afraid of being taken, deported, without due process,\u201d one San Diegan said during public comment.<\/p>\n
The Due Process and Safety Ordinance is as follows:<\/p>\n
Requiring federal and out-of-state law enforcement to have a judicial warrant to gain access to non-public city-controlled property<\/p>\n
Prohibiting the city from supporting discriminatory\/unauthorized enforcement actions that target people based on protected characteristics<\/p>\n
Protecting residents\u2019 data privacy from public systems <\/p>\n
Creating multilingual \u201cKnow Your Rights\u201d programs at city and city-funded facilities<\/p>\n
And extending protections to city contractors, lessees and grantees <\/p>\n
\u201cHaving those laws on the books, it\u2019s not again just a statement of the way we feel, but it\u2019s actually saying this is the official position of the city, in a way that has teeth,\u201d Councilmember Sean Elo-Rivera said.<\/p>\n
The Trump administration has been vocal against cities that limit cooperation with ICE.<\/p>\n
\u201cI think that the Trump administration should do more to be lawful and do less finger-pointing and ranting about the actions of cities like San Diego to stand up for the rights of our residents,\u201d Elo-Rivera said.<\/p>\n
While some don\u2019t agree with the city council\u2019s decision, Elo-Rivera wishes the law could go even further.<\/p>\n
\u201cI can\u2019t protect all people in all places, but what we can do is say if you are on city property, are on private space of the city,\u201d Elo-Rivera said. \u201cThen you\u2019re damn right there\u2019s going to be certain expectations for what happens in our spaces.\u201d<\/p>\n
The approved ordinance now heads to Mayor Todd Gloria\u2019s desk. Once he signs it, it will go into effect in 30 days.<\/p>\n
