{"id":258554,"date":"2026-04-09T01:27:32","date_gmt":"2026-04-09T01:27:32","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/258554\/"},"modified":"2026-04-09T01:27:32","modified_gmt":"2026-04-09T01:27:32","slug":"court-unseals-warrants-riverside-sheriff-used-to-seize-ballots","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/258554\/","title":{"rendered":"Court unseals warrants Riverside sheriff used to seize ballots"},"content":{"rendered":"\n<p>Secret warrants obtained by the Riverside County Sheriff\u2019s Department to seize more than 650,000 ballots in a <a class=\"link\" href=\"https:\/\/www.latimes.com\/california\/story\/2026-03-23\/riverside-county-sheriff-has-seized-650-000-ballots-heres-what-we-know\" rel=\"nofollow noopener\" target=\"_blank\">controversial investigation<\/a> of election fraud allegations were made public Wednesday, raising new questions about whether the probe was based on solid evidence of crimes. <\/p>\n<p>Riverside County Superior Court Judge Gail O\u2019Rane on Tuesday ordered the warrants unsealed after several media organizations, including The Times, sued to review the documents. The release of the documents came soon after the California Supreme Court halted the investigation pending a further review of the case.<\/p>\n<p>Riverside County Sheriff Chad Bianco, also a Republican gubernatorial candidate, has championed the election fraud investigation and ballot seizure, which has drawn widespread criticism and several legal challenges, including from California Atty. Gen. Rob Bonta. Bonta had requested the intervention from the state Supreme Court. <\/p>\n<p>The warrants provide the first glimpse into the contested court documents related to the allegations of fraud \u2014 claims that election officials say are unfounded. They do not, however, identify a specific scenario or person who carried out a specific instance of voter fraud. Riverside officials had previously sought to keep the documents secret, citing an active investigation in response to records requests. <\/p>\n<p>The three search warrants, which were signed by a county judge, were requested by Riverside County Sheriff\u2019s Investigator Robert Castellanos. He said the election materials were needed to \u201cprove or disprove any criminal conduct\u201d from the 2025 election, citing an audit from the Riverside County Election Integrity Team that purported a major miscount of ballots. <\/p>\n<p>Castellanos identified himself as a 21-year veteran of the department with previous experience investigating claims of voter fraud for the department. The warrants detailed the seizure of more than 1,000 boxes of ballots <a class=\"link\" href=\"https:\/\/www.latimes.com\/california\/story\/2026-03-27\/riverside-sheriff-seizes-more-ballots-defying-california-officials\" rel=\"nofollow noopener\" target=\"_blank\">in February and March<\/a>. They still didn\u2019t provide an exact figure for the number of ballots seized, but the March warrant says that deputies went through 22 boxes which contained 12,561 ballots.<\/p>\n<p>Bonta had previously said his office found \u201cdeficiencies\u201d in the warrants that justified a halt to the investigation and execution of the warrants, according to court filings. Bonta said that \u201cthe affidavits did not identify any specific felony offense the sheriff had probable cause to believe had been committed or that a particular person had committed a felony.\u201d<\/p>\n<p>David Becker, the executive director of the Center for Election Innovation &amp; Research and a former senior trial attorney overseeing voting enforcement for the U.S. Department of Justice\u2019s Civil Rights Division, echoed some of Bonta\u2019s concerns, calling the probable cause in the warrants \u201cincredibly thin.\u201d<\/p>\n<p>\u201cFor a warrant, you need to establish probable cause that a crime has been committed and there\u2019s evidence that you need to seize related to that crime,\u201d Becker said after reviewing the newly released documents. <\/p>\n<p>\u201cThis is the same conspiracy theory-fueled stuff that we\u2019ve seen elsewhere,\u201d Becker said. \u201cIt\u2019s really unfortunate to see law enforcement officers fall victim to these same easily disprovable conspiracy theories and then misuse the warrant process with very flimsy claims before a friendly judge in order to seize materials that were already transparent and reviewed multiple times.\u201d<\/p>\n<p>While Bianco initially proceeded with the investigation against Bonta\u2019s request to stop, he <a class=\"link\" href=\"https:\/\/www.latimes.com\/california\/story\/2026-03-30\/riverside-county-sheriff-chad-bianco-halts-his-election-fraud-probe\" rel=\"nofollow noopener\" target=\"_blank\">recently<\/a> suspended the probe pending legal reviews. Bianco is a vocal supporter of President Trump, who has, for years, promoted conspiracy theories casting doubt on the nation\u2019s election process, especially mail-in and early voting. Trump this week endorsed another GOP candidate for California governor, conservative commentator Steve Hilton.<\/p>\n<p>The California Supreme Court on Wednesday granted Bonta\u2019s request for a stay in the investigation and ordered all parties to \u201cpause the investigation into the November 2025 special election and preserve all seized items.\u201d The court also agreed to hear a review of the case in the coming weeks. <\/p>\n<p>Bonta argued that the formal court order was necessary because \u201cwhat the sheriff says and what he does are often two different things.\u201d<\/p>\n<p>\u201cToday\u2019s decision by the California Supreme Court reins in the destabilizing actions of a rogue sheriff, prohibiting him from continuing this investigation while our litigation continues,\u201d Bonta said in a prepared statement. He called the ruling a \u201cnecessary and appropriate response to what is clearly an unprecedented situation.\u201d<\/p>\n<p>The attorney general has argued that the sheriff illegally defied directives from his office and proceeded with a case that \u201cwill only sow distrust in our elections.\u201d<\/p>\n<p>Bianco, in a video <a class=\"link\" href=\"https:\/\/www.instagram.com\/p\/DW4atNDgAc5\/\" target=\"_blank\" rel=\"nofollow noopener\">posted on social media<\/a> Wednesday, said he was \u201cvery happy\u201d with the Supreme Court\u2019s ruling, though he acknowledged it means that the investigation remains in \u201cstatus quo &#8230; at the hold of a court.\u201d<\/p>\n<p>The sheriff said he was \u201cvery confident they will allow us to continue with this investigation despite the attorney general\u2019s attempts to cover it up. &#8230; We will make sure this investigation, like any investigation, is completed, and not swept under the rug.\u201d<\/p>\n<p>Bonta\u2019s office had filed for the Supreme Court review after its petition with California\u2019s 4th District Court of Appeal <a class=\"link\" href=\"https:\/\/www.latimes.com\/california\/story\/2026-03-24\/state-ag-takes-riverside-county-sheriff-to-court-over-seized-ballots\" rel=\"nofollow noopener\" target=\"_blank\">was denied<\/a> last month, prompting the attorney general to file new petitions in both Riverside County Superior Court and the state\u2019s highest court. Both remain ongoing. <\/p>\n<p>The UCLA Voting Rights Project has also filed a <a class=\"link\" href=\"https:\/\/vrp.ucla.edu\/wp-content\/uploads\/2026\/03\/Cervantes-v.-Bianco-Stamped-Copy.pdf\" target=\"_blank\" rel=\"nofollow noopener\">petition<\/a> to the California Supreme Court arguing that all ballots must remain in the custody of the county registrar of voters under state law.<\/p>\n<p>The ballots in question are from the November election for <a class=\"link\" href=\"https:\/\/www.latimes.com\/california\/story\/2025-11-05\/4-takeaways-after-proposition-50s-big-win-in-california\" rel=\"nofollow noopener\" target=\"_blank\">Proposition 50<\/a>, which has temporarily redrawn the state\u2019s congressional districts to favor Democrats in response to partisan redistricting in Republican states, including Texas. After doing its own audit from the election, a local citizens group has claimed the county\u2019s tally was falsely inflated by more than 45,000 votes. Bianco has said he wants to \u201cdetermine the validity\u201d of that claim. <\/p>\n<p>But voting fraud <a class=\"link\" href=\"https:\/\/www.latimes.com\/politics\/story\/2024-10-18\/yes-voter-fraud-happens-but-its-rare-and-there-are-safeguards-to-catch-it\" rel=\"nofollow noopener\" target=\"_blank\">remains rare<\/a> across the U.S., and officials with the Riverside County registrar of voters have emphatically rejected any claims of voter fraud.
