At a Thursday news briefing, attorney Patrick Kolasinski said Carlos Ivan Mendoza Hernandez may be able to soon leave the ICU following the Tuesday shooting along Interstate 5 in the Patterson area. <\/p>\n

U.S. Immigration and Customs Enforcement (ICE) Acting Director Todd Lyons initially stated that Mendoza Hernandez was a Los Angeles-area gang member wanted for questioning in connection with a murder in El Salvador. However, Kolasinski said the country told him Mendoza Hernandez was acquitted of that murder in 2019.<\/p>\n
According to the attorney, the U.S. Department of Justice told Kolasinski that the agency is not holding Mendoza Hernandez as a suspect at this point.<\/p>\n

Mendoza Hernandez is only being held by Doctors Medical Center because of his injuries, Kolasinski said, explaining that he has multiple gunshot wounds, including to his jaw. <\/p>\n
“It is absolutely abundantly clear he was shot in the face,” Kolasinski said.<\/p>\n
He has spent much of the past two days unconscious, but Kolasinski said he was able to speak with him about the shooting.<\/p>\n
From Mendoza Hernandez’s recollection, he said he thought he was getting pulled over for a traffic stop. The officers then identified themselves as ICE agents and said they were going to take him into custody.<\/p>\n
Kolasinski said that Mendoza Hernandez repeatedly told him that he only tried driving away because the ICE agents were already firing at him, causing him to panic. <\/p>\n

Mendoza Hernandez had also asserted to Kolasinski that he had never been a gang member and that the only times he visited LA were for trips with his fianc\u00e9e, Cindy.<\/p>\n
Kolasinski again criticized ICE’s handling of the confrontation, explaining that the agency’s training methods and protocol put everyone\u2014including the agents themselves\u2014in danger.<\/p>\n
Cindy and Kolasinski described him as a hardworking family man and father to a 2-year-old daughter.<\/p>\n

The Stanislaus County Sheriff\u2019s Office said ICE contacted their dispatch before the incident to let them know they would be conducting an investigation in Patterson.<\/p>\n
ICE did not provide details about the investigation to the sheriff\u2019s office. This is a common procedure of any agency, whether it\u2019s state, local, or federal, the sheriff\u2019s office said.<\/p>\n
