THE MAN WHO WAS SHOT, CARLOS IVAN MENDOZA HERNANDEZ, IS OUT OF THE HOSPITAL, BUT HE\u2019S IN CUSTODY AND FACING FEDERAL CHARGES. NOW, THIS STARTED AS AN IMMIGRATION ENFORCEMENT STOP JUST OUTSIDE OF PATTERSON, WHEN MENDOZA TRIED TO DRIVE OFF. THE SHOOTING IS GETTING NATIONAL ATTENTION. KCRA 3\u2019S CECIL HANNIBAL JOINS US LIVE FROM OUTSIDE THE FEDERAL COURTHOUSE WITH THE LATEST ON THE CHARGES. CECIL. ON HIS IMMIGRATION STATUS. RATHER, WHAT HAPPENED WHILE OFFICERS WERE TRYING TO TAKE HIM INTO CUSTODY. THAT\u2019S ESSENTIALLY WHAT LANDED HIM IN A FEDERAL COURTROOM TODAY. FEDERAL PROSECUTORS ARGUE THAT WHEN HE TRIED TO DRIVE AWAY, HE PUT FEDERAL AGENTS IN DANGER. MENDOZA HERNANDEZ IS NOW CHARGED WITH ASSAULTING, RESISTING OR IMPEDING FEDERAL OFFICERS WHILE ENGAGED IN OFFICIAL DUTIES WHILE WITH A DANGEROUS OR DEADLY WEAPON. THE WEAPON IN QUESTION IS THE VEHICLE HERNANDEZ WAS DRIVING. DOCUMENTS REVEAL NEW DETAILS FROM THE PERSPECTIVE OF THE FEDERAL AGENTS MAKING CLAIMS THAT MENDOZA HERNANDEZ REFUSED TO GET OUT OF THE VEHICLE, AND ONE OF THE AGENTS SMASHED THE PASSENGER SIDE WINDOW WHEN HE DID NOT COMPLY. THAT\u2019S WHEN AGENTS CLAIM MENDOZA HERNANDEZ PUT THE VEHICLE IN DRIVE, MOVED IT A FOOT TO THE LEFT AND HIT ONE OF THE AGENTS THERE. AGENTS CLAIM HE BACKED UP AND TRIED TO DRIVE AWAY AND HE COULD HAVE SERIOUSLY HURT OR KILLED OFFICERS. THAT\u2019S WHAT THEY CLAIM NOW. THEY CLAIM THAT\u2019S WHY OFFICERS FIRED SHOTS HITTING MENDOZA MULTIPLE TIMES. HERE\u2019S WHAT HIS ATTORNEY HAD TO SAY ABOUT THIS CASE. WHAT THE REAL CONCERN HERE IS, IS REGARDLESS OF CARLOS\u2019S IMMIGRATION STATUS AT THE MOMENT, A LAW ENFORCEMENT STOPS YOU, THEY DON\u2019T KNOW FOR SURE WHO\u2019S IN THE CAR. THAT STOP COULD HAVE BEEN A U.S. CITIZEN WITH A MISTAKEN IDENTITY, WHO DECIDED TO EXERCISE THEIR RIGHT TO NOT LEAVE THE CAR. WE DON\u2019T KNOW IF THAT COULD HAVE BEEN ANY ONE OF US. YOU KNOW, EVERYONE FROM EVERY POLITICAL SPECTRUM, THERE\u2019S TIMES WHERE YOU DON\u2019T WANT TO COOPERATE WITH LAW ENFORCEMENT. YOU WANT TO SAY, HEY, DO YOU HAVE A WARRANT? AM I DETAINED? YOU HAVE THAT RIGHT. AND SO THE REACTION SHOULDN\u2019T BE SHOOT FIRST, ASK QUESTIONS LATER. NOW, TODAY\u2019S APPEARANCE WAS AN INITIAL APPEARANCE TO DECIDE IF HE WOULD RECEIVE BOND OR NOT. THE FEDERAL JUDGE ACTUALLY DECIDED TO GIVE HIM BOND A $50,000 BOND, BECAUSE THEY BELIEVE THAT HE DID NOT HAVE A CRIMINAL HISTORY HERE IN THE U.S. AND HE WAS NOT A FLIGHT RISK. BUT FEDERAL PROSECUTORS DISAGREED, SO THEY REQUESTED A STAY. SO THAT ESSENTIALLY MEANS ANOTHER JUDGE WILL NOW REVIEW THIS DECISION. SO WE\u2019LL KNOW IN ABOUT 48 HOURS IF MENDOZA HERNANDEZ WILL IN FACT RECEIVE BOND LIVE IN DOWNTOWN SACRAMENTO CECIL HANNIBAL, KCRA THREE NEWS. ALL RIGHT. WE NEED TO WAIT FOR THAT.
