TONIGHT. THE MAN WHO WAS SHOT, CARLOS IVAN MENDOZA HERNANDEZ, IS OUT OF THE HOSPITAL, BUT HE\u2019S IN CUSTODY AND FACING FEDERAL CHARGES. NOW, THIS STARTED AS AN IMMIGRATION ENFORCEMENT STOP JUST OUTSIDE OF PATTERSON, WHEN MENDOZA TRIED TO DRIVE OFF. THE SHOOTING IS GETTING NATIONAL ATTENTION. KCRA 3\u2019S CECIL HANNIBAL JOINS US LIVE FROM OUTSIDE THE FEDERAL COURTHOUSE WITH THE LATEST ON THE CHARGES. CECIL. ON HIS IMMIGRATION STATUS. RATHER, WHAT HAPPENED WHILE OFFICERS WERE TRYING TO TAKE HIM INTO CUSTODY. THAT\u2019S ESSENTIALLY WHAT LANDED HIM IN A FEDERAL COURTROOM TODAY. FEDERAL PROSECUTORS ARGUE THAT WHEN HE TRIED TO DRIVE AWAY, HE PUT FEDERAL AGENTS IN DANGER. MENDOZA HERNANDEZ IS NOW CHARGED WITH ASSAULTING, RESISTING OR IMPEDING FEDERAL OFFICERS WHILE ENGAGED IN OFFICIAL DUTIES WHILE WITH A DANGEROUS OR DEADLY WEAPON. THE WEAPON IN QUESTION IS THE VEHICLE HERNANDEZ WAS DRIVING. DOCUMENTS REVEAL NEW DETAILS FROM THE PERSPECTIVE OF THE FEDERAL AGENTS MAKING CLAIMS THAT MENDOZA HERNANDEZ REFUSED TO GET OUT OF THE VEHICLE, AND ONE OF THE AGENTS SMASHED THE PASSENGER SIDE WINDOW WHEN HE DID NOT COMPLY. THE FEDERAL JUDGE ACTUALLY DECIDED TO GIVE HIM BOND A $50,000 BOND, BECAUSE THEY BELIEVE THAT HE DID NOT HAVE A CRIMINAL HISTORY HERE IN THE U.S. AND HE WAS NOT A FLIGHT RISK. BUT FEDERAL PROSECUTORS DISAGREED, SO THEY REQUESTED A STAY. SO THAT ESSENTIALLY MEANS ANOTHER JUDGE WILL NOW REVIEW THIS DECISION. Hernandez’ attorney claims he was transferred from Yuba County to Nevada County, whoever, Nevada County officials say he is not in there custody. KCRA 3 has also contacted Yuba County to confirm where Hernandez is. Hernandez is facing a federal charge after he allegedly tried to drive away from immigration agents, according to court documents.
