{"id":279530,"date":"2026-04-22T02:02:14","date_gmt":"2026-04-22T02:02:14","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/279530\/"},"modified":"2026-04-22T02:02:14","modified_gmt":"2026-04-22T02:02:14","slug":"kayleighs-law-would-allow-25-year-restraining-orders-california","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/279530\/","title":{"rendered":"&#8216;Kayleigh\u2019s Law&#8217; would allow 25-year restraining orders | California"},"content":{"rendered":"<p>(The Center Square) \u2013 The time for lifting restraining orders would be extended to 25 years in California if a new bill passes in the Golden State this year.<\/p>\n<p><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202520260SB1395\" target=\"_blank\" rel=\"nofollow noopener\">Senate Bill 1395<\/a>, nicknamed \u201cKayleigh\u2019s Law,\u201d would increase the length of time for a restraining order from 10 years to 25 years, according to the bill author\u2019s testimony during a Capitol hearing on Tuesday afternoon.<\/p>\n<p>\u201cIn California today, a child who has already been through unimaginable trauma is forced to return to court over and over again, face their abuser and re-tell their story just to maintain basic protection,\u201d Sen. Suzette Martinez Valladares, R-Lancaster and the author of the bill, testified during the Senate Public Safety Committee meeting. \u201cThat is not justice.\u201d<\/p>\n<p>Recent amendments to the bill would allow a judge, at the time of sentencing, to issue a protective order for up to 25 years for felony sex offenses against minors, a change from the previous text of the bill, which would have allowed judges to grant permanent restraining orders. The most recent amendments also aim to make restraining orders longer so that survivors of those crimes don\u2019t have to return to court multiple times to renew their restraining orders, which Valladares said re-traumatizes victims.<\/p>\n<p>\u201cBefore amendments, this bill allowed for a lifetime protection,\u201d Valladares testified. \u201cThat does remain a goal of Kayleigh and myself, both in California and nationally because if the threat doesn\u2019t expire, the protection shouldn\u2019t either.\u201d<\/p>\n<p>Kayleigh\u2019s Law, which has passed in other states, was inspired by the experience of Kayleigh Kozak, who was sexually abused by her soccer coach as a child. <a href=\"https:\/\/www.12news.com\/article\/news\/local\/valley\/lifetime-restraining-orders-in-arizona\/75-c45c07cc-3602-4597-92da-9eff789b67c6\" target=\"_blank\" rel=\"nofollow noopener\">According to NBC 12 News in Arizona<\/a>, the coach was convicted and sentenced to lifetime probation. Kozak and her family got word in 2020 that he was petitioning to have the court lift his probation. <a href=\"https:\/\/www.azleg.gov\/legtext\/55leg\/2R\/laws\/0278.pdf\" target=\"_blank\" rel=\"nofollow noopener\">\u201cKayleigh\u2019s Law\u201d passed in Arizona<\/a> in 2022.<\/p>\n<p>Efforts to get the law passed in California started two years later. In 2024, Assemblymember Diane Dixon, R-Newport Beach, tried to get Kayleigh\u2019s Law passed, but it ultimately failed. Valladares introduced the bill again in 2025 \u2013 <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202520260SB421\" target=\"_blank\" rel=\"nofollow noopener\">Senate Bill 421<\/a> \u2013 but it failed passage in committee on April 1, 2025. This year\u2019s version of the bill was introduced in February 2026.<\/p>\n<p>\u201cAs we know, women, who make up half our population, continue to face gender-based and sexual violence at disproportionately higher rates,\u201d Katherine Squire, legislative analyst for the California Commission on Women and Girls, testified. \u201cIt can take tremendous courage and strength for survivors to come forward and face their abusers in court. It is unimaginable to consider what the long-term impacts are of having to repeatedly appear in court to re-justify their pain.\u201d<\/p>\n<p>Opponents of Kayleigh\u2019s Law, however, testified on Tuesday that they took issue with the length of time restraining orders could be in place if the bill is passed.<\/p>\n<p>\u201cWe appreciate the intention of protecting survivors of sexual violence, but we do not believe this bill is necessary given the sufficiency of existing law,\u201d Alex Tuchman, deputy public defender for the Los Angeles County Public Defender\u2019s Office, testified. \u201cThe increase from 10 years is simply not needed.\u201d<\/p>\n<p>Opponents said there were logistical reasons for why the bill didn\u2019t make sense.<\/p>\n<p>\u201cThere are practical reasons why a 25-year protective order is not going to protect the victim,\u201d Margo George, who spoke on behalf of the California Public Defender\u2019s Association, testified. \u201cTo issue a protective order, the judge has to write on the protective order who the person is supposed to stay away from, and what location they\u2019re supposed to stay away from, in order to give the notice.\u201d<\/p>\n<p>The Senate Public Safety Committee did not vote on the bill as of press time on Tuesday because there were not enough members of the committee to constitute a quorum.<\/p>\n","protected":false},"excerpt":{"rendered":"(The Center Square) \u2013 The time for lifting restraining orders would be extended to 25 years in California&hellip;\n","protected":false},"author":2,"featured_media":279531,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[6],"tags":[7,9,8,1312,49719,5551,1492,8877],"class_list":{"0":"post-279530","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-california","8":"tag-california","9":"tag-california-headlines","10":"tag-california-news","11":"tag-courts","12":"tag-judges","13":"tag-legislature","14":"tag-public-safety","15":"tag-restraining-order"},"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/posts\/279530","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/comments?post=279530"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/posts\/279530\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/media\/279531"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/media?parent=279530"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/categories?post=279530"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/tags?post=279530"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
