{"id":284386,"date":"2026-04-24T21:21:15","date_gmt":"2026-04-24T21:21:15","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/284386\/"},"modified":"2026-04-24T21:21:15","modified_gmt":"2026-04-24T21:21:15","slug":"a-lively-debate-over-the-state-of-free-speech-at-uc-berkeley","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/284386\/","title":{"rendered":"A lively debate over the state of free speech at UC Berkeley"},"content":{"rendered":"<p>Six decades after the <a href=\"https:\/\/www.berkeleyside.org\/2024\/10\/14\/free-speech-movement-60th-anniversary\" rel=\"nofollow noopener\" target=\"_blank\">Free Speech Movement erupted<\/a> at UC Berkeley in protest of university-imposed restrictions on political speech and student activism on campus, the Trump administration\u2019s crackdown on the independence of the nation\u2019s higher education system has again thrust First Amendment questions into the limelight.<\/p>\n<p>Last week, the state of free speech and academic freedom at UC Berkeley was fiercely debated in a <a href=\"https:\/\/www.berkeleyside.org\/2026\/04\/07\/free-speech-academic-freedom-uc-berkeley-event-berkeleyside\" rel=\"nofollow noopener\" target=\"_blank\">panel discussion<\/a> Berkeleyside hosted between <a href=\"https:\/\/www.berkeleyside.org\/2026\/03\/10\/uc-berkeley-student-newspaper-daily-californian-editor-referendum\" rel=\"nofollow noopener\" target=\"_blank\">Ananya Rupanagunta<\/a>, editor-in-chief of the Daily Californian student newspaper; Benjamin Hermalin, Cal\u2019s provost; and a pair of professors \u2014 Chris Hoofnagle, a law professor and secretary of the Berkeley Initiative for the Freedom of Inquiry, and Ussama Makdisi, a history professor and inaugural chair of Cal\u2019s program in Palestinian and Arab Studies, who <a href=\"https:\/\/www.berkeleyside.org\/2025\/07\/15\/uc-berkeley-chancellor-rich-lyons-antisemitism-testimony\" rel=\"nofollow noopener\" target=\"_blank\">came under fire<\/a> from Congressional Republicans last summer during a Capitol Hill grilling of Chancellor Rich Lyons over antisemitism.\u00a0\u00a0<\/p>\n<p>About 100 people \u2014 including many old enough to have lived through the free speech battles of the 1960s \u2014 attended the 90-minute April 14 talk at the Brower Center in downtown Berkeley, moderated by <a href=\"https:\/\/www.berkeleyside.org\/2025\/11\/25\/higher-education-beat-berkeleyside-uc-berkeley-felicia-mello\" rel=\"nofollow noopener\" target=\"_blank\">Berkeleyside higher education reporter<\/a> Felicia Mello.\u00a0<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2026\/04\/1777065671_19_hqdefault.jpg\" alt=\"YouTube video\" width=\"480\" height=\"360\" data-pin-nopin=\"true\" nopin=\"nopin\"\/><br \/>\nWatch the 90-minute panel discussion <a href=\"https:\/\/www.youtube.com\/watch?v=YVUPGWKWsUU\" rel=\"nofollow noopener\" target=\"_blank\">on our YouTube channel<\/a>. Grant for Berkeleyside.<\/p>\n<p>Universities have been under intense scrutiny by the federal government since President Donald Trump\u2019s return to power last January. The administration has threatened and followed through on <a href=\"https:\/\/www.berkeleyside.org\/2025\/12\/12\/trumps-doj-pressured-lawyers-to-find-evidence-that-ucla-and-uc-berkeley-had-illegally-tolerated-antisemitism\" rel=\"nofollow noopener\" target=\"_blank\">freezing billions in federal contracts and research grants<\/a> to schools that the president deems ideologically unaligned. The ongoing federal crackdown on immigration has <a href=\"https:\/\/www.berkeleyside.org\/2025\/06\/17\/trump-immigration-crackdown-uc-berkeley-international-students\" rel=\"nofollow noopener\" target=\"_blank\">spread fear among international students and scholars<\/a>. And a federal taskforce was created to <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/additional-measures-to-combat-anti-semitism\/\" rel=\"nofollow noopener\" target=\"_blank\">investigate claims of antisemitism<\/a> and hate speech on college campuses, singling out individuals and groups espousing pro-Palestinian views. UC Berkeley alone <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/additional-measures-to-combat-anti-semitism\/\" rel=\"nofollow noopener\" target=\"_blank\">has been investigated<\/a> over half a dozen times by the administration and congressional Republicans since 2024, and lost out on at least $50 million in federal research grants.<\/p>\n<p>\u201cThis is not an abstract discussion,\u201d Mello said in her opening remarks. \u201cWithin the United States, the basic norms of democracy and rule of law are increasingly under attack. At the same time, we have a federal government that has shown interest in applying pressure on universities to comply with its political vision.\u201d<\/p>\n<p>It\u2019s a climate in which UC Berkeley\u2019s leaders have had to walk a fine line. Lyons has affirmed the university\u2019s commitment to free speech, while also condemning antisemitism on campus. In March, the school reached a <a href=\"https:\/\/www.berkeleyside.org\/2026\/03\/26\/uc-berkeley-brandeis-center-antisemitism-settlement\" rel=\"nofollow noopener\" target=\"_blank\">$1 million settlement<\/a> with a Jewish legal advocacy group over complaints that law student organizations were <a href=\"https:\/\/www.nytimes.com\/2022\/12\/21\/us\/uc-berkeley-free-speech.html\" rel=\"nofollow noopener\" target=\"_blank\">excluding Zionist speakers<\/a> and a <a href=\"https:\/\/www.berkeleyside.org\/2024\/02\/27\/uc-berkeley-israeli-speaker-protest\" rel=\"nofollow noopener\" target=\"_blank\">protest had stopped a pro-Israel speaker<\/a> from addressing students.<\/p>\n<p>At times, the university\u2019s response to the political moment has been met with concern by members of the public and campus community who view the institution\u2019s actions as acquiescing to the Trump administration.<\/p>\n<p>In September, university officials acting at the behest of the UC Office of the President <a href=\"https:\/\/www.berkeleyside.org\/2025\/09\/12\/uc-berkeley-shares-names\" rel=\"nofollow noopener\" target=\"_blank\">handed over names<\/a> and personal information of 160 students, faculty members and staff to the federal government, in response to its probe into antisemitism on campus. Several months later, the school <a href=\"https:\/\/www.berkeleyside.org\/2025\/12\/09\/peyrin-kao-suspended-uc-berkeley-pro-palestinian-activism-regents-policy-2301\" rel=\"nofollow noopener\" target=\"_blank\">suspended a computer science lecturer<\/a> named Peyrin Kao, who\u2019d staged a hunger strike to protest the war in Gaza,\u00a0 after some students complained he\u2019d expressed his political views in the classroom. A student multicultural center <a href=\"https:\/\/www.dailycal.org\/news\/campus\/student-life\/uc-berkeley-administration-silently-shutters-student-multicultural-space\/article_f1141eab-1212-46c0-a749-f5c7e0bf50ed.html\" rel=\"nofollow noopener\" target=\"_blank\">was abruptly closed<\/a> in November 2025, with university officials later citing complaints about pro-Palestinian signs; the space was <a href=\"https:\/\/www.berkeleyside.org\/2026\/02\/05\/uc-berkeley-multicultural-community-center\" rel=\"nofollow noopener\" target=\"_blank\">allowed to reopen<\/a> in February after strong student outcry but all <a href=\"https:\/\/www.berkeleyside.org\/2026\/04\/22\/multicultural-community-center-uc-berkeley\" rel=\"nofollow noopener\" target=\"_blank\">political art was stripped from the walls and new restrictions imposed on hosting events<\/a>. And UC Berkeley was among 31 colleges to recently <a href=\"https:\/\/www.berkeleyside.org\/2026\/02\/20\/uc-berkeley-phd-project-trump-department-of-education\" rel=\"nofollow noopener\" target=\"_blank\">cut ties with a nonprofit<\/a> focused on increasing faculty diversity in business schools, after the organization was investigated by the U.S. Department of Education.\u00a0<\/p>\n<p>UC Berkeley gets mixed reviews on its handling of free speech issues<br \/>\n<img data-recalc-dims=\"1\" decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2026\/04\/Berkeleyside-event-The-State-of-Free-Speech-at-UC-Berkeley.jpg\" alt=\"\"\/>Makdisi and Hoofnagle listen to Hermalin during the panel. Grant for Berkeleyside<\/p>\n<p>Mello began the discussion by asking each panelist to give the university a letter grade for the job it\u2019s done promoting the values of academic freedom and free speech over the past year, beginning with Hermalin. The provost gave the school an \u201cA minus.\u201d<\/p>\n<p>\u201cWe\u2019ve been really working very hard to defend academic freedom and free speech,\u201d he said. \u201cBut where I think we have failed to do it perfectly is we have not convinced our constituents that we\u2019re doing it. We have not provided them that kind of confidence that we are out there protecting free speech and academic freedom.\u201d<\/p>\n<p>Hoofnagle also gave UC Berkeley a high mark, and lauded the institution\u2019s \u201cdeep free speech and academic culture.\u201d But the law professor said he worries about an anonymous complaint system that he believes is being weaponized, and bemoaned what he referred to as the \u201checkler\u2019s veto\u201d to shut down dialogue on campus.<\/p>\n<p><img data-recalc-dims=\"1\" decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2026\/04\/1777065673_361_Berkeleyside-event-The-State-of-Free-Speech-at-UC-Berkeley.jpg\" alt=\"\"\/>Hoofnagle bemoaned what he referred to as the \u201checkler\u2019s veto\u201d to shut down dialogue on campus. Grant for Berkeleyside<\/p>\n<p>\u201cWe\u2019ve had a number of incidents, despite taking many precautions,\u201d he said. \u201cSituations where people have been shouted down by intolerant people. And it tends to be a certain type of speaker who\u2019s shouting down.\u201d\u00a0<\/p>\n<p><img data-recalc-dims=\"1\" decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2026\/04\/1777065674_367_Berkeleyside-event-The-State-of-Free-Speech-at-UC-Berkeley.jpg\" alt=\"\" style=\"width:379px;height:auto\"\/>Rupanagunta said she\u2019s seen students more afraid to express their political views openly. Grant for Berkeleyside<\/p>\n<p>Hoofnagle described one experience he had on campus at an event last November hosted by Turning Point USA, the conservative student-focused advocacy organization co-founded by Charlie Kirk. Hoofnagle said he went there as a curious bystander, but felt intimidated by masked protesters who he believed had assumed he was there supporting the controversial group. He said students and others leaving the event at Zellerbach Hall were met with profanity-laced chants of \u201cfascist\u201d by the protesters waiting outside.<\/p>\n<p>\u201cThere is a heap of liberalism at the heart of this willingness to cancel people who you disagree with, and it\u2019s costing [the university] millions of dollars,\u201d said Hoofnagle. \u201cWe should be willing to listen to the other side.\u201d<\/p>\n<p>Rupanagunta said that as a reporter, she\u2019s observed a growing reticence among people on campus to openly express their political views. Grant<\/p>\n<p>\u201cAre students really feeling that their free speech is protected when it\u2019s been incredibly hard to get people to speak on the record out of fear of retaliation?\u201d she said. \u201cWhen at almost every protest, you feel the need to wear masks because you know you have to hide your identity to speak up for what you believe is right?\u201d<\/p>\n<p>Makdisi said UC Berkeley\u2019s suppression of speech on campus hasn\u2019t gone as far as some other schools \u2014 he cited UCLA, NYU and Columbia \u2014\u00a0but that its performance is a matter of perspective. The professor of Arab and Middle Eastern history, who has been an outspoken critic of Israel\u2019s war in Gaza, was among those <a href=\"https:\/\/www.npr.org\/2025\/09\/18\/nx-s1-5542204\/uc-berkeley-sends-160-names-to-government-for-alleged-antisemitic-incidents\" rel=\"nofollow noopener\" target=\"_blank\">included on the list of 160 names<\/a> given by the university to the federal government.<\/p>\n<p>\u201cIf you are a lecturer who is disciplined for fasting for Gaza, to protest the Gaza genocide, well, that\u2019s a very different grade,\u201d he said, referencing the university\u2019s suspension of Kao. \u201cAny student who\u2019s protesting what they think of as depravity [and]\u00a0they are being intimidated and punished or threatened with punishment, that\u2019s a very different grade.\u201d<\/p>\n<p>When does academic freedom cross the line?<br \/>\n<img data-recalc-dims=\"1\" decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2026\/04\/1777065675_521_Berkeleyside-event-The-State-of-Free-Speech-at-UC-Berkeley.jpg\" alt=\"\"\/>A crowd of about 100 came to watch the discussion. Credit: Richard H. Grant for Berkeleyside<\/p>\n<p>All of the panelists said they believe universities should be places where the values of free speech and academic freedom are valued and protected. But opinions differed on how the First Amendment can and should be applied in classroom settings.\u00a0<\/p>\n<p>Referring to the Kao case, Hoofnagle said the school was acting within its rights when it suspended the computer science lecturer.\u00a0<\/p>\n<p>\u201cHe talked about a topic that had nothing to do with his class, just as I could be fired if I gave a lecture on physics instead of law,\u201d said Hoofnagle. \u201cThe whole idea is that professors have power over their students, and we have an obligation not to politicize our classroom.\u201d<\/p>\n<p>Hermalin agreed that professors cross the line when their in-class speech veers into political advocacy.\u00a0<\/p>\n<p>\u201cIf I was a professor of, say, biology, and I start talking about President Trump\u2019s tariffs, that would not be okay, because that\u2019s not part of what we normally think about as biology,\u201d he said. \u201cSo again, that might cause some consequences for the professor.\u201d<\/p>\n<p><img data-recalc-dims=\"1\" decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2026\/04\/1777065675_324_Berkeleyside-event-The-State-of-Free-Speech-at-UC-Berkeley.jpg\" alt=\"\"\/>Berkeleyside higher education reporter Felicia Mello moderated the event. Grant for Berkeleyside<\/p>\n<p>For many students who\u2019ve spoken to The Daily Cal, said Rupanaguntra, the idea that Kao\u2019s suspension for expressing his views on Gaza at the end of class had nothing to do with his political activism outside of it, is a tough sell. She said many see the decision as contributing to an overall \u201cculture of fear and intimidation\u201d on campus.<\/p>\n<p>\u201cIt sends a message that when you are specifically discussing certain topics, certain conflicts, and certain politics is when it feels like there is an attack on academic freedom and an attack on free speech,\u201d she said.\u00a0<\/p>\n<p>Makdisi said political indoctrination should have no place at the university. But he urged others to consider these questions of academic freedom within the moral context of a war in Gaza that a United Nations independent commission has <a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2025\/09\/israel-has-committed-genocide-gaza-strip-un-commission-finds\" rel=\"nofollow noopener\" target=\"_blank\">deemed a genocide<\/a>.\u00a0<\/p>\n<p>In such a context, \u201cWho makes a decision about what is indoctrination and what is proper academic teaching?\u201d said Makdisi. \u201cOn what basis does somebody determine this is indoctrination and this has crossed the line, [or] this hasn\u2019t crossed the line?
