{"id":37293,"date":"2025-11-04T09:20:06","date_gmt":"2025-11-04T09:20:06","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/37293\/"},"modified":"2025-11-04T09:20:06","modified_gmt":"2025-11-04T09:20:06","slug":"robinhood-seeks-to-dismiss-lawsuit-brought-by-indian-tribes-in-california","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/37293\/","title":{"rendered":"Robinhood seeks to dismiss lawsuit brought by Indian tribes in California"},"content":{"rendered":"<p>Robinhood Markets, Inc., and Robinhood Derivatives, LLC is pushing to dismiss <a href=\"https:\/\/fxnewsgroup.com\/forex-news\/retail-forex\/indian-tribes-sue-kalshi-robinhood-for-illegal-sports-gambling\/\" rel=\"nofollow noopener\" target=\"_blank\">the complaint filed by three Indian tribes<\/a> in California.<\/p>\n<p>The Blue Lake Rancheria, the Chicken Ranch Rancheria of Me-Wuk Indians, and the Picayune Rancheria of the Chukchansi Indians seek to enjoin Robinhood and Kalshi from allegedly engaging in illegal sports gambling on the Tribes\u2019 respective reservations and recover damages.<\/p>\n<p>On March 19, 2026, at 10:00 AM, before the Honorable Jacqueline Scott Corley, Robinhood will move the Court for an order dismissing the Complaint.<\/p>\n<p>Robinhood argues that the Plaintiffs\u2019 claim under the Indian Gaming Regulatory Act (\u201cIGRA\u201d) fails because:<\/p>\n<p>there is no right of action for Indian tribes to enjoin violations of IGRA\u2019s restrictions on gaming on Indian lands under 25 U.S.C. \u00a7 2710(d)(1);<br \/>\nRobinhood\u2019s activities do not violate 25 U.S.C. \u00a7 2710(d)(1) because they are neither \u201cclass III gaming activities\u201d nor \u201con Indian lands\u201d;<br \/>\nIGRA does not displace exclusive the Commodity Futures Trading Commission\u2019s (CFTC) jurisdiction over event contracts traded on Designated Contract Markets (DCMs); and<br \/>\nRobinhood\u2019s activities are not unlawful gaming because they are expressly exempted by the Unlawful Internet Gaming Enforcement Act (\u201cUIGEA\u201d).<\/p>\n<p>Further, Robinhood says that Plaintiffs\u2019 claims under tribal gaming ordinances fail because Plaintiffs lack authority to regulate Robinhood (a nonmember of the tribes) and the Commodities Exchange Act (\u201cCEA\u201d) preempts any conflicting tribal law.<\/p>\n<p>Also, Robinhood notes that Plaintiffs\u2019 tribal sovereignty claim fails, both because there is no cause of action for violation of tribal sovereignty and because the tribes have no tribal sovereignty interest as against Robinhood.<\/p>\n<p>Finally, Robinhood argues that Plaintiffs\u2019 claim under the Racketeer Influenced and Corrupt Organizations Act (\u201cRICO\u201d) fails, as they have failed to adequately plead (1) standing, (2) predicate offenses and (3) the existence of an enterprise.<\/p>\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"Robinhood Markets, Inc., and Robinhood Derivatives, LLC is pushing to dismiss the complaint filed by three Indian tribes&hellip;\n","protected":false},"author":2,"featured_media":37294,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[6],"tags":[7,9,8,93,25980,11792,11793],"class_list":{"0":"post-37293","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-california","8":"tag-california","9":"tag-california-headlines","10":"tag-california-news","11":"tag-featured","12":"tag-indian-tribes","13":"tag-kalshi","14":"tag-robinhood"},"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/posts\/37293","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/comments?post=37293"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/posts\/37293\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/media\/37294"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/media?parent=37293"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/categories?post=37293"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-ca\/wp-json\/wp\/v2\/tags?post=37293"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
