The government will seek to have the case permanently withdrawn within weeks if Huerta continues to comply with the terms of his pretrial release and stays out of trouble, prosecutors said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cms3zeaw700063b6r2cd2o7mt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Huerta said in a statement that he was tackled, pepper-sprayed and detained for exercising his constitutional rights to protest and cast the case against him as part of a broader \u201cweaponization of the judicial system.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cms3zeaw700073b6rwgnk3smw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThere was never a real case, only an attempt to punish and silence me for exercising my constitutional rights,\u201d he said in a statement. \u201cI will keep exercising my constitutional rights and protest every abuse this administration commits, and I will keep working to build a country that treats immigrant families and all workers with the dignity they deserve.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cms3zeaw800093b6rgd6s67gb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Justice Department had <a href=\"https:\/\/apnews.com\/article\/immigration-los-angeles-protest-huerta-union-arrest-36f2ad59b7babd67969b89148a29fe90\" target=\"_blank\" rel=\"nofollow noopener\">earlier reduced the felony obstruction charge<\/a> to a misdemeanor, and in moving to dismiss it entirely, is now backing away entirely from a prosecution that had been announced with fanfare on social media after Huerta\u2019s arrest more than a year ago. It\u2019s the <a href=\"https:\/\/apnews.com\/article\/immigration-protests-arrests-prosecution-trump-bondi-1b2285e82fa27e0d53fb58f1201eb747\" target=\"_blank\" rel=\"nofollow noopener\">latest courtroom setback for a department that has struggled<\/a>, in offices across the country, in its prosecutions of people accused of assaulting or hindering federal officers while <a href=\"https:\/\/www.youtube.com\/watch?v=2hRTt_e3zhw\" target=\"_blank\" rel=\"nofollow noopener\">protesting President Donald Trump\u2019s immigration crackdown<\/a>.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cms3zeaw8000a3b6ri0ogpkrm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The US attorney\u2019s office in Los Angeles signaled in its own statement that law enforcement was justified in arresting Huerta, noting that he was charged with interfering with a judicial search warrant and asserting that the Justice Department does not arrest people for simply peacefully protesting. The office also said that Huerta has complied with the terms of his bond for more than a year and was prepared to dismiss the case if he continues to do so.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cms3zeaw8000b3b6rest3ev0f@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cPursuant to an agreement entered into with our office, if Mr. Huerta continues to comply with his pretrial release terms, we expect the criminal case against him to be fully dismissed by the end of next month,\u201d the statement said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cms3zeaw8000c3b6r9yaewq2m@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Huerta was arrested in June 2025 while protesting outside a business in Los Angeles where federal agents were investigating suspected immigration violations. The incident occurred amid widespread protests over the federal immigration crackdown that drove Trump to <a href=\"https:\/\/apnews.com\/article\/insurrection-act-trump-troops-newsom-military-national-guard-a842f79e1c0e244039be274a6f266a7a\" target=\"_blank\" rel=\"nofollow noopener\">take the extraordinary move of deploying<\/a> the National Guard to the nation\u2019s second-largest city.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cms3zeaw8000d3b6rhdd1ruaf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Authorities said Huerta sat down in front of a vehicular gate and encouraged others to walk in circles to try to prevent law enforcement from going in or out, and he pushed back when an officer told him to leave and put his hands on Huerta to move him out of the way of a vehicle.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cms3zeaw8000e3b6r8rnkat43@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            According to a copy of a letter laying out the terms of Huerta\u2019s diversion agreement, Huerta and the government agreed to a stipulated set of facts, including that he arrived at the search warrant location, positioned himself in the driveway outside the front gate \u201cto oppose the policies and tactics of the enforcement activity he observed and encouraged others to do the same\u201d and that, as a result, \u201cat least one federal agent\u201d who participated in the search warrant \u201ccredibly believed he was unable to enter the front gate.\u201d\n    <\/p>\n<p>        Huerta\u2019s arrest brought pushback from advocates and senators<\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cms3zeaw8000g3b6rie4rinhq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Union leaders and immigrant advocates rallied in cities across the country demanding Huerta\u2019s release, and he became the face of the pushback against the Republican president\u2019s effort to drive up <a href=\"https:\/\/apnews.com\/article\/immigration-enforcement-border-trump-ice-6fecdf2313788bd889b51adfb003ca7a\" target=\"_blank\" rel=\"nofollow noopener\">immigration arrests<\/a>. Top Democrats also fired back. Senate Democratic Leader Chuck Schumer and California\u2019s two Democratic senators wrote a letter to federal officials demanding answers regarding Huerta\u2019s arrest. California Sen. Adam Schiff attended Huerta\u2019s bond hearing.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cms3zeaw8000h3b6rhwjbyjly@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt is deeply troubling that a U.S. citizen, union leader, and upstanding member of the Los Angeles community continues to be detained by the federal government for exercising his rights to observe immigration enforcement,\u201d the senators wrote.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cms3zeaw8000i3b6r8600xk9a@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Federal prosecutors initially charged Huerta with felony obstruction, with Bill Essayli, the top federal prosecutor in Los Angeles, saying that it didn\u2019t matter who was protesting \u201cif you impede federal agents, you will be arrested and prosecuted.\u201d In October, prosecutors <a href=\"https:\/\/apnews.com\/article\/immigration-los-angeles-protest-huerta-union-arrest-36f2ad59b7babd67969b89148a29fe90\" target=\"_blank\" rel=\"nofollow noopener\">reduced the charge<\/a> against Huerta to a misdemeanor.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cms3zeaw8000j3b6ryhstbb9u@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Huerta\u2019s lawyers, Abbe Lowell and Marilyn Bednarski, said in a statement that the case against their client had no legal basis.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cms3zeaw8000k3b6rmuszyqzb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThis case, like others, sought to silence criticism of the administration\u2019s improper immigration actions.
