One of the state\u2019s most important safety requirements is wearing a seat belt.<\/p>\n

California has required drivers and passengers to buckle up<\/a> since 1986, according to the California Driver\u2019s Handbook.<\/p>\n

Seat belts save<\/a> nearly 15,000 lives each year in the United States, according to the National Highway Traffic Safety Administration. However, the federal agency said, millions of drivers and passengers \u201caren\u2019t taking the simple step.\u201d<\/p>\n

Can police pull you over for not wearing a seat belt? What if one of your passengers isn\u2019t buckled up?<\/p>\n

Under California Vehicle Code Section 27315, drivers and passengers must wear a properly fastened seat belt<\/a> while traveling on a public road.<\/p>\n

Drivers are responsible for making sure everyone in the vehicle is buckled up before operating a vehicle.<\/p>\n

According to Roberts Jeandron law firm, anyone in the vehicle must keep their seat belt on \u201ceven if it is parked or stopped<\/a>.\u201d<\/p>\n

Are there any exceptions to California\u2019s seat belt law?<\/p>\n

California law provides a few exceptions.<\/p>\n

Taxi drivers are exempt while transporting paying passengers on city streets, though front-seat passengers in taxis must still wear seat belts.<\/p>\n

Similar rules apply to limousines for hire and authorized emergency vehicles, where operators and front-seat passengers are required to buckle up.<\/p>\n

The law also exempts certain public employees riding in authorized emergency vehicles while performing their official duties.<\/p>\n

Will California police pull me over for not wearing a seat belt?<\/p>\n

An officer can stop a vehicle solely because the driver or a passenger is not wearing a seat belt<\/a>, according to the Sargon Law Group.<\/p>\n

Who gets the ticket if a passenger isn\u2019t wearing a seat belt?<\/p>\n

According to the California Vehicle Code, whether the driver receives the ticket for a passenger not wearing a seat belt<\/a> depends on the passenger\u2019s age.<\/p>\n

For passengers younger than 16<\/a>, the driver is responsible for ensuring they are properly restrained and can receive the citation if they are not, according to Piering Law Firm.<\/p>\n

Passengers who are 16 or older are responsible for wearing their own seat belts and can be cited directly for failing to buckle up.<\/p>\n

According to the 2026 Judicial Council of California Uniform Bail and Penalty Schedule, failing to wear a seat belt carries a base fine of $20<\/a>.<\/p>\n

After penalty assessments and court fees are added, the total cost of the citation can amount to nearly $200.<\/p>\n
