However, the federal agency said, millions of drivers and passengers \u201caren\u2019t taking the simple step.\u201d<\/p>\n<p>Can police pull you over for not wearing a seat belt?     Who is legally required to wear a seat belt in California?<\/p>\n<p>Under California Vehicle Code Section 27315, drivers and passengers <a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=VEH&amp;sectionNum=27315.\">must wear a properly fastened seat belt<\/a> while traveling on a public road.<\/p>\n<p>Drivers are responsible for making sure everyone in the vehicle is buckled up before operating a vehicle.<\/p>\n<p>According to Roberts Jeandron law firm, anyone in the vehicle must keep their seat belt on \u201c<a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/www.robertslawfirm.net\/seatbelt-laws-ca\/#:~:text=Additionally,%20all%20drivers%20in%20California%20need%20to,seat,%20they%20must%20use%20a%20booster%20seat.\">even if it is parked or stopped<\/a>.\u201d<\/p>\n<p>Are there any exceptions to California\u2019s seat belt law?<\/p>\n<p>California law provides a few exceptions.<\/p>\n<p>Taxi drivers are exempt while transporting paying passengers on city streets, though front-seat passengers in taxis must still wear seat belts.<\/p>\n<p>Similar rules apply to limousines for hire and authorized emergency vehicles, where operators and front-seat passengers are required to buckle up.<\/p>\n<p>The law also exempts certain public employees riding in authorized emergency vehicles while performing their official duties.<\/p>\n<p>Will California police pull me over for not wearing a seat belt?<\/p>\n<p>An officer can stop a vehicle solely because the driver or a <a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/www.sargonlawgroup.com\/california-seat-belt-laws-what-you-should-know\">passenger is not wearing a seat belt<\/a>, according to the Sargon Law Group.<\/p>\n<p>Who gets the ticket if a passenger isn\u2019t wearing a seat belt?<\/p>\n<p>According to the California Vehicle Code, whether the driver receives the ticket for a <a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=VEH&amp;sectionNum=27315.\">passenger not wearing a seat belt<\/a> depends on the passenger\u2019s age.<\/p>\n<p>For <a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/www.pieringlawfirm.com\/blog\/2020\/january\/driver-or-passenger-who-is-responsible-for-no-se\/\">passengers younger than 16<\/a>, the driver is responsible for ensuring they are properly restrained and can receive the citation if they are not, according to Piering Law Firm.<\/p>\n<p>Passengers who are 16 or older are responsible for wearing their own seat belts and can be cited directly for failing to buckle up.<\/p>\n<p>                                          <img decoding=\"async\"
