{"id":433487,"date":"2026-08-15T05:08:13","date_gmt":"2026-08-15T05:08:13","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/433487\/"},"modified":"2026-08-15T05:08:13","modified_gmt":"2026-08-15T05:08:13","slug":"fresno-sues-shuttered-indian-restaurant-for-alleged-wage-theft","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/433487\/","title":{"rendered":"Fresno sues shuttered Indian restaurant for alleged wage theft"},"content":{"rendered":"<p>A restaurant that <a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/www.fresnobee.com\/living\/food-drink\/bethany-clough\/article316602713.html\">was recently evicted<\/a> from its space in central Fresno is now being sued for alleged wage theft by the City Attorney\u2019s Office.<\/p>\n<p>A <a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/acrobat.adobe.com\/id\/urn:aaid:sc:US:8573e59b-4458-4bc8-b1e2-2d0d716c60ab\">civil complaint filed Aug. 7<\/a> in Fresno County Superior Court accuses the Mirchi Massala restaurant, its owners and a manager of labor code violations impacting at least seven workers between December 2024 and March of this year.<\/p>\n<p>Among other violations, they failed to pay the workers all that they were owed, prevented documentation of their work hours and \u201cmisappropriated gratuities,\u201d the lawsuit alleges.<\/p>\n<p>\u201cDefendants had actual knowledge that workers were economically vulnerable and less likely to report wage violations or pursue legal action,\u201d the lawsuit alleges.<\/p>\n<p>Mirchi Massala opened in February 2025 at the Ash Tree Square shopping center at First Street and Shaw Avenue. The restaurant, which billed itself a \u201cfine dining Indian food experience\u201d on <a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/www.instagram.com\/mirchimassala\/?hl=en\">its Instagram page<\/a>, closed in recent months and was served with an eviction notice from the Fresno County Sheriff\u2019s Office.<\/p>\n<p>Ashish Desai, one of the restaurant\u2019s owners, did not return a call Friday requesting comment about the allegations against Mirchi Massala.<\/p>\n<p>City Attorney\u2019s wage theft cases<\/p>\n<p>The suit is at least the fifth wage theft complaint that City Attorney Andrew Janz has filed against local businesses since May 2025. The city had authorized its <a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/www.fresno.gov\/cityattorney\/fresno-wages\/\">Wage Protection Program<\/a>, which receives and investigates workers\u2019 complaints, the year prior after state legislators allowed local prosecutors to sue employers accused of violating California labor law.<\/p>\n<p>Amid pushback from the Fresno Chamber of Commerce, City Councilmember Tyler Maxwell said at the time that the program would <a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/fresnoland.org\/2024\/02\/01\/wage-theft-program\/\">not target small local businesses<\/a> that make honest mistakes. Rather, the city would go after \u201cthe Bitwises of the world\u201d and the \u201cCheesecake Factories of the world.\u201d<\/p>\n<p>Apart from Mirchi Massala, Janz has also sued the <a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/www.fresnobee.com\/news\/local\/article306245211.html\">operators of a Holiday Inn<\/a> in northwest Fresno, a <a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/www.fresnobee.com\/article314404788.html\">shuttered Mexican seafood spot<\/a>, a <a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/www.fresnobee.com\/news\/local\/article315033899.html\">shuttered burrito shop<\/a> and a car wash.<\/p>\n<p>The city attorney in June announced his office is also investigating allegations that <a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/www.fresnobee.com\/living\/food-drink\/article316221885.html\">wage theft occurred at Horn Barbecue<\/a> \u2014 a restaurant opened in January by a Fresno-raised, Michelin-awarded chef that <a target=\"_blank\" rel=\"Follow nofollow noopener\" href=\"https:\/\/www.fresnobee.com\/living\/food-drink\/bethany-clough\/article316495295.html\">closed within months<\/a>.<\/p>\n<p>                                          <img decoding=\"async\" class=\"responsive-image\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2026\/07\/FRS_EPZ_JANZ_SPEAKS_02.jpeg\"   width=\"1200\" height=\"0\" title=\"FRS_EPZ_JANZ_SPEAKS_02\" alt=\"Fresno City Attorney Andrew Janz speaks about the recent subpoena of two journalists in an interview Monday, April 14, 2025 in Fresno.\"\/>                                                                                    Fresno City Attorney Andrew Janz speaks about the recent subpoena of two journalists in an interview Monday, April 14, 2025 in Fresno.                                                                                            ERIC PAUL ZAMORA                                                                            ezamora@fresnobee.com                                                                                        Wage theft allegations against former Fresno Indian restaurant<\/p>\n<p>Mirchi Massala workers began reporting labor code violations to the city just months after the restaurant opened, according to the lawsuit.<\/p>\n<p>The city\u2019s investigation found the restaurant classified several workers as salaried, exempt employees, the complaint alleges. Workers classified as such are not subject to California\u2019s hourly wage, overtime, break or timekeeping requirements.<\/p>\n<p>That means the Mirchi Massala workers did not clock in and their actual hours worked were never recorded, the suit says.
