Two bills awaiting the governor’s signature would target private immigration detention facilities and businesses that profit from federal immigration enforcement in California.<\/p>\n
“What these two legislations can do is to create an environment where, number one, corporations are made accountable to the harm that they are causing our community,”Ian Seruelo, chair of the San Diego Immigrant Rights Consortium said.<\/p>\n
Seruelo’s organization is part of the California Immigrant Policy Center, one of the groups that sponsored the bills.<\/p>\n
Assembly Bill 1633 would impose a 25% tax on the gross income of private detention facility operators. Revenue from the tax would go into the Due Process for All Fund and, if approved by the Legislature, could be used for immigration-related services.<\/p>\n
If signed into law, the tax would take effect July 1, 2028. Seruelo notes that increasing access to legal representation could make a significant difference for people navigating immigration court.<\/p>\n
“Once a person is represented in immigration court, the likelihood of them being able to win successfully for a specific relief is more than ten times higher than those who are unrepresented,” Seruelo said.<\/p>\n
The second measure, Assembly Bill 2465, would prevent certain businesses involved with private detention facilities or federal immigration enforcement from receiving state grants or loans. The bill would also prohibit certain taxpayers from receiving state tax credits.<\/p>\n
Seruelo said the restrictions could apply to California businesses that provide services to federal immigration agencies.<\/p>\n
“For example, there’s a California entity, for example, that lets say, provides transportation to ICE entities or to DHS entities, then that corporation would not be able to access any kind of tax breaks, loans or grants from the state,” he said.<\/p>\n
CoreCivic, a private company that operates detention facilities, said it is aware of the bills and is currently reviewing them.<\/p>\n
The Department of Homeland Security was also contacted for comment and had not responded at the time of publication.
