A judge Monday began mulling Terrence Howard\u2019s request to reconsider her earlier decision to dismiss his lawsuit against Creative Artists Agency LLC in which the actor says the talent agency fraudulently convinced him to take less money for his \u201cEmpire\u201d role.<\/p>\n
Howard\u2019s attorney contends in his Los Angeles Superior Court lawsuit that some exhibits Los Angeles Superior Court Judge Cherol J. Nellon believed had not been lodged indeed had been. Nellon heard arguments on the reconsideration motion Monday and took the issues under submission.<\/p>\n
The judge issued her dismissal ruling on July 31, finding that Howard had failed to create a triable issue as to his entitlement of damages, even though she assumed that Howard could establish duty, breach, fraud elements and causation as to liability.<\/p>\n
The judge explained that even if there were an increase in compensation it would have been to the benefit of Howard\u2019s loan-out company, Universal Bridges, and not the actor.<\/p>\n
A loan-out company is a personal business structure, usually created by an actor, musician, writer or athlete, in which the company\u2019s creator becomes an employee of their own corporation and the company loans out their services to third-party studios or other employers.<\/p>\n
In his court papers, the 57-year-old Howard\u2019s attorney contended that a set of exhibits the judge believed had not been lodged with the court on July 22 had indeed been handed over two days earlier.<\/p>\n
The \u201cHustle & Flow\u201d actor\u2019s lawyer further requests that the CAA dismissal motion be reversed or, alternatively, that additional briefing be permitted along with a further hearing.<\/p>\n
\u201cCAA\u2019s own moving evidence \u2026 did not establish that additional Universal Bridges revenue could not benefit Howard,\u201d the actor\u2019s attorney states.<\/p>\n
In their court papers in support of dismissing or paring Howard\u2019s suit, CAA attorneys argued that Howard lacked standing to bring his claims and that they were barred by the statute of limitations. The defense lawyers also maintain that CAA negotiated diligently on his behalf and that his claims and damages are speculative as well as \u201cutterly meritless.\u201d<\/p>\n
\u201cEmpire\u201d had a debut that averaged nearly 10 million viewers, Fox\u2019s most-watched debut in three years, the suit stated.<\/p>\n
