The vehicle struck a large dirt berm and overturned.\u00a0<\/p>\n<p>Both the driver and passenger sustained severe injuries and were transported to a hospital, where they remained in critical condition as of Saturday morning.<\/p>\n<p>It is currently unknown whether alcohol or drugs were factors in the crash. Anyone with information is asked to call the Bakersfield Police Department. The investigation remains ongoing.<\/p>\n<p>Bakersfield Car Accidents and Personal Injury Claims<\/p>\n<p>California law requires drivers to come to a complete stop at posted stop signs and yield the right of way to cross traffic before proceeding through an intersection. A driver who fails to stop and causes a crash may be considered to have committed negligence per se, which would limit the driver\u2019s own ability to recover damages unless another party\u2019s negligence also contributed to the collision.<\/p>\n<p>The passenger, however, may have the right to pursue a claim against the driver regardless of the driver\u2019s own fault, since a passenger\u2019s right to recovery does not depend on establishing an outside party\u2019s negligence.
