The vote also maintained policies banning police from using smoke or pepper spray for crowd control.

The tear gas ban was adopted in 2020 as anti-police demonstrations sprang up nationwide following the murder of George Floyd — and as the pandemic was at its height, prompting new health concerns around the use of chemical agents.

A proposal from Councilmember Rashi Kesarwani would have allowed BPD officers a few tightly controlled uses for tear gas but was voted down 5-4 by councilmembers Ben Bartlett, Cecilia Lunaparra, Terry Taplin, Igor Tregub and Mayor Adena Ishii.

Over several hours of public comment Sept. 15 and again Tuesday, dozens of Berkeleyans and others expressed fear and outrage at the notion of giving back to BPD officers the authority to use tear gas, or broadening their latitude to use pepper spray and smoke.

“‘Tear gas’ is an incorrect term. It makes CS seem trivial,” George Lippman, a member of the Peace and Justice Commission, said Sept. 15. “It’s actually not even a gas, but an aerosol made up of ultrafine particles,” which are hazardous to lung health and especially so to vulnerable populations.

Tear gas works by making “people unable to function,” according to the Centers for Disease Control and Prevention. Long-lasting exposure can lead to glaucoma, eye scarring, cataracts, asthma and other breathing problems, particularly if someone is exposed indoors.

Police supervisors answered council members’ questions on potential uses under the proposal, and officers asked the council during public comment to reverse the 2020 ban.

“Tear gas is an industry standard deescalation tool that allows us time, distance and a higher level of control,” police Sgt.
