HECTOR AMEZCUA                                                                            hamezcua@sacbee.com                                                                                        <\/p>\n<p>The decision means prosecutors will again seek to hold Martin and Payton criminally responsible for the deaths of three women caught in the gunfire that <a href=\"https:\/\/www.sacbee.com\/news\/local\/crime\/article273532340.html\" rel=\"Follow nofollow noopener\" target=\"_blank\">erupted shortly after 2 a.m. April 3, 2022, at 10th and K streets<\/a> in downtown Sacramento.<\/p>\n<p>Yamile Martinez, 21; Johntaya Alexander, 21; and Melinda Davis, 57, were killed in the barrage. Three other people \u2014 Sergio Harris, 38; Joshua Hoye-Lucchessi, 32; and Davazia Turner, 29 \u2014 were also killed. Prosecutors alleged the three men were involved in the shootout.<\/p>\n<p>Sacramento Superior Court Judge Michael Bowman <a href=\"https:\/\/www.sacbee.com\/news\/local\/crime\/article316492242.html\" rel=\"Follow nofollow noopener\" target=\"_blank\">declared a mistrial July 21<\/a> after jurors said they were hopelessly deadlocked on the remaining homicide charges against Martin and Payton.<\/p>\n<p>Days before the mistrial, <a href=\"https:\/\/www.sacbee.com\/news\/local\/crime\/article316544496.html\" rel=\"Follow nofollow noopener\" target=\"_blank\">prosecutors dismissed first-degree murder charges<\/a> against the two men after jurors deadlocked a first time. Jurors continued deliberating on whether Martin and Payton were guilty of second-degree murder or voluntary manslaughter in the deaths of Martinez, Alexander and Davis, or if the men acted in self-defense.<\/p>\n<p>They could not reach unanimous verdicts.<\/p>\n<p>Jurors did convict Martin and Payton of being felons in possession of firearms and found allegations of prior felony convictions to be true.<\/p>\n<p>The trial centered on <a href=\"https:\/\/www.sacbee.com\/news\/local\/crime\/article316254274.html\" rel=\"Follow nofollow noopener\" target=\"_blank\">sharply different accounts of what caused the gunfight<\/a> in what became the deadliest mass shooting in Sacramento history.<\/p>\n<p>Prosecutors argued Martin and Payton were armed gang members who participated in a confrontation with rivals that erupted into gunfire on a crowded downtown street as nightclubs closed.<\/p>\n<p>                                          <img decoding=\"async\" class=\"responsive-image\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/us-ca\/wp-content\/uploads\/2026\/10\/GANG-GROUP-SHOT.jpg\"   width=\"1200\" height=\"675\" title=\"GANG-GROUP-SHOT.jpg\" alt=\"In an image captured from surveillance video and labeled by Sacramento police, gang members are identified moments before a shooting April 3, 2022, in downtown Sacramento. Sacramento Police Department                                                                                        <\/p>\n<p>\u201cThey\u2019re not motivated by fear; they\u2019re motivated by animus,\u201d Deputy District Attorney <a href=\"https:\/\/www.sacbee.com\/news\/local\/crime\/article316234081.html\" rel=\"Follow nofollow noopener\" target=\"_blank\">Brad Ng told jurors during closing arguments<\/a>. \u201cThey escalated the terror on K Street and now, they\u2019re looking for an excuse. They escalated at every opportunity. These are gang members who were arming themselves. These two men are guilty of murder.\u201d<\/p>\n<p>Defense attorneys argued Martin and Payton were caught in a sudden burst of gunfire and <a href=\"https:\/\/www.sacbee.com\/news\/local\/crime\/article314350412.html\" rel=\"Follow nofollow noopener\" target=\"_blank\">fired their weapons in self-defense<\/a>.<\/p>\n<p>Attorneys for the men argued Harris fired the first shots, killing Turner and setting off the gun battle. People were getting shot around me. <a href=\"https:\/\/www.sacbee.com\/news\/local\/crime\/article316185901.html\" rel=\"Follow nofollow noopener\" target=\"_blank\">I was scared,\u201d Payton testified in June<\/a>.<\/p>\n<p>\u201cOf what?\u201d his attorney, Reed Kingsbury, asked.<\/p>\n<p>\u201cDying,\u201d Payton replied.<\/p>\n<p>The mistrial left relatives of those killed facing the possibility of another trial more than four years after the shooting.<\/p>\n<p>John Alexander, Johntaya Alexander\u2019s father, said outside the courthouse after the mistrial that his family had been denied justice.<\/p>\n<p>\u201cI did not get justice today,\u201d Alexander said. \u201cI did not get justice in these four years. I did not get justice in these two months of being in the courtroom. Sacramento Bee file                                                                                        <\/p>\n<p>Smiley Martin, Dandrae Martin\u2019s brother, was wounded in the K Street gunfire and later arrested in connection with the shooting. He <a href=\"https:\/\/www.sacbee.com\/news\/local\/crime\/article292691124.html\" rel=\"Follow nofollow noopener\" target=\"_blank\">died in June 2024 in the Sacramento County Main Jail while awaiting trial<\/a>. The charges against him were later dismissed.<\/p>\n<p>The first trial of Payton and Dandrae Martin lasted weeks and included extensive testimony from police investigators, gang experts and the defendants themselves. Jurors repeatedly reviewed surveillance video capturing the hours, minutes and seconds leading to the shooting before ultimately deadlocking on the homicide charges.<\/p>\n<p>Prosecutors also <a href=\"https:\/\/www.sacbee.com\/news\/local\/article287294355.html\" rel=\"Follow nofollow noopener\" target=\"_blank\">struggled to secure testimony in earlier hearings<\/a> from witnesses of the shooting.
