{"id":505375,"date":"2026-10-23T12:28:38","date_gmt":"2026-10-23T12:28:38","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/505375\/"},"modified":"2026-10-23T12:28:38","modified_gmt":"2026-10-23T12:28:38","slug":"oakland-man-pleads-no-contest-to-raping-woman-as-she-died-2","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/505375\/","title":{"rendered":"Oakland man pleads no contest to raping woman as she died"},"content":{"rendered":"<p>OAKLAND \u2014 A 77-year-old man has been released from jail after pleading no contest to <a href=\"https:\/\/www.mercurynews.com\/2026\/02\/24\/judge-necrophilia-theory-could-disprove-oakland-rape-case\/\" target=\"_blank\" rel=\"noopener nofollow\">raping a woman<\/a> as she lay dying in his apartment, and police say he left her corpse on a staircase after her death.<\/p>\n<p>Lester Lewis, of Oakland, pleaded no contest to a rape charge in June. On Oct. 13, he was released from jail, after racking up enough good behavior credits to fulfill a three-year jail sentence, which was cut in half to 18 months under the terms of the plea deal, court records show.<\/p>\n<p>Lewis was charged in 2024 with rape of an unconscious person. He allegedly picked up the <a href=\"https:\/\/www.mercurynews.com\/2024\/09\/13\/oakland-man-raped-and-burned-woman-as-she-lay-dying-in-his-apartment-police-say\/\" target=\"_blank\" rel=\"noopener nofollow\">woman from another part of Oakland<\/a> and offered drugs plus\u00a0$100 to have sex with him and clean his apartment on the 1300 block of 81st Avenue in Oakland. He claimed that the agreed-upon transaction occurred shortly after they met, police said.<\/p>\n<p>But after consuming drugs, the woman died of a suspected overdose. Authorities allege he raped her as she was dying, but the defense suggested at Lewis\u2019 preliminary hearing that prosecutors couldn\u2019t prove she wasn\u2019t dead at the time of the alleged sexual assault.<\/p>\n<p>Death lurked around the case in other ways; in 2025, a judge released Lewis after receiving assurances from <a href=\"https:\/\/www.mercurynews.com\/2025\/12\/05\/judge-jails-oakland-rape-suspect-for-failing-to-die-while-out-of-custody\/\" target=\"_blank\" rel=\"noopener nofollow\">his attorney that Lewis was near death<\/a> and likely to succumb to a medical problem at a hospital. When Lewis remained alive months later \u2014 his health having bounced back significantly \u2014 he was returned to jail with the charges still pending, court records show.<\/p>\n<p>Lewis\u2019 lawyer also argued in court filings that police unlawfully arrested him by keeping him handcuffed for hours and then interrogating him before he\u2019d been implicated in the crime.
