Environmental impact assessments would be based on the laws and standards in place when the application is filed.

Applicants could also propose one project alternative to reduce environmental impacts for the agency to consider, rather than requiring government agencies to propose multiple project alternatives. Additionally, agencies and applicants would be required to consult with formally recognized California native tribes.

Courts would be allowed to halt only a part of affected projects, rather than the whole project, in a case where environmental review failed to comply with CEQA.

During the CEQA process, Proposition 45 would limit how long the agency can accept comments from the public about projects by setting a maximum number of days. The current law has a minimum set of days which could be extended by agencies discretion, according to the Secretary of State’s voter guide.

According to the Legislative Analyst’s Office, the initial costs of this measure could potentially exceed $100 million annually, in order to implement new project review and court procedures.

“Fees paid by project applicants and people filing lawsuits would partly cover these costs,” The Legislative Analyst’s office stated.

The measure’s long-term fiscal effects are uncertain.

Supporters remarks

Supporters argue that the state’s environmental review law is outdated and slows development through litigation and bureaucratic challenges.
