Gavin Newsom looks on during a news conference on April 16, 2025, in Ceres, Calif.<\/p>\n<p>Justin Sullivan\/Getty Images<\/p>\n<p>Last year, a law hit the books in California that would, in 2027, force <a href=\"https:\/\/www.sfgate.com\/politics\/article\/social-media-health-warning-new-bill-21076519.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">social media<\/a> companies to dramatically overhaul the feeds scrolled by millions of children across the state. Last week, three <a href=\"https:\/\/www.sfgate.com\/tech\/article\/meta-makes-billions-scammy-ads-21145991.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">tech juggernauts<\/a> \u2014 the companies that run those feeds \u2014 ramped up their battle to stop the law from taking effect.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/cdn-channels-pixel.ex.co\/events\/0012000001fxZm9AAE?integrationType=DEFAULT&amp;template=design%2Farticle%2Fplatypus_two_column.tpl\" alt=\"\" class=\"x1px y1px vh abs\" aria-hidden=\"true\" width=\"1\" height=\"1\"\/><\/p>\n<p><a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.459655\/gov.uscourts.cand.459655.1.0.pdf\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">Meta<\/a>, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.459645\/gov.uscourts.cand.459645.1.0.pdf\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">TikTok<\/a> and <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.459658\/gov.uscourts.cand.459658.1.0.pdf\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">YouTube<\/a> each sued California Attorney General Rob Bonta in federal court on Thursday, pointing to the First Amendment and arguing that the law\u2019s attempt to enforce parental controls over social media feeds is a major overreach. They seek an injunction against the state\u2019s enforcement of the law, a push that comes as California\u00a0<a href=\"https:\/\/www.politico.com\/news\/2025\/10\/13\/california-law-online-age-checks-00606115\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">ramps<\/a> up its <a href=\"https:\/\/www.sfgate.com\/politics\/article\/hollywood-silicon-valley-fighting-newsom-attention-21093376.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">regulation<\/a> over the relationships between tech platforms and children.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>The law they\u2019re suing over is called the <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billVotesClient.xhtml?bill_id=202320240SB976\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">Protecting Our Kids from Social Media Addiction Act<\/a>. Passed during the 2023-2024 session with bipartisan support, the law blocks companies from giving children the sort of social media feeds we\u2019ve come to expect online \u2014 hyperpersonalized, laden with recommended content based on our past social media usage \u2014 unless those minors\u2019 parents give specific consent. The law\u2019s text dubbed our current algorithmically mediated feeds \u201caddictive,\u201d and tied social media usage to young people\u2019s mental health struggles.<\/p>\n<p>\u201cEvery parent knows the harm social media addiction can inflict on their children\u00a0\u2014 isolation from human contact, stress and anxiety, and endless hours wasted late into the night,\u201d Newsom <a href=\"https:\/\/www.gov.ca.gov\/2024\/09\/20\/governor-newsom-signs-landmark-bill-to-protect-kids-from-social-media-addiction-takes-action-on-other-measures\/\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">wrote<\/a> when he signed the bill in September 2024. \u201cWith this bill, California is helping protect children and teenagers from purposely designed features that feed these destructive habits.\u201d<\/p>\n<p>Should the law go into effect as written, young people in the state will see their social media apps transform, with feeds likely turning into simple, chronological streams of posts based on who they follow. That would buck a trend: Meta and YouTube have followed in TikTok\u2019s footsteps by recommending more content from accounts that their users do not expressly follow.<\/p>\n<p>Meta, TikTok and YouTube, filed their lawsuits after NetChoice, their industry trade group, was <a href=\"https:\/\/epic.org\/wp-content\/uploads\/2025\/09\/SB976-9th-Cir-Opinion.pdf\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">denied<\/a> legal standing by the U.S. Court of Appeals in September for its own attempt to block the law\u2019s personalized feed provisions. In their complaints,\u00a0TikTok and YouTube argue that the law is vague and they skewer the painting of social media feeds as \u201caddictive\u201d; Meta writes that if the law is enforced the company will \u201csuffer an irreparable First Amendment injury.\u201d<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>But Bonta\u2019s office is up for the fight. Spokesperson Elissa Perez pointed out in a statement to SFGATE that a U.S. Court of Appeals tribunal already\u00a0<a href=\"https:\/\/epic.org\/wp-content\/uploads\/2025\/09\/SB976-9th-Cir-Opinion.pdf\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">snubbed<\/a> some of NetChoice\u2019s arguments in the September opinion, and said the state\u2019s Department of Justice will respond to these new lawsuits. She also skewered the idea that they\u2019re about free speech.<\/p>\n<p>\u201cCompanies have blatantly shown us that they are willing to use addictive design features, including algorithmic feeds and notifications at all hours of the day and night, to target children and teens, solely to increase their profits,\u201d Perez wrote. \u201cAnd as shown by multiple lawsuits, under the guise of free speech concerns, these same companies have demonstrated they aren\u2019t willing to let go of those profits without a fight.\u201d<\/p>\n<p>The companies, of course, see things very differently, and cast the law as a dramatic overreach that would make their services worse for children.<\/p>\n<p>YouTube spokesperson Nicole Bell and\u00a0TikTok spokesperson Nathaniel Brown each pointed to their platforms\u2019 existing safety features for young people. Bell wrote that the law doesn\u2019t recognize how YouTube uses recommendations to make sure kids see appropriate content. Meta spokesperson Edward Patterson made a similar point, writing, \u201cOur goal is to build community and provide people with an experience that is relevant and age-appropriate to them\u2014which we would be prevented from doing if this law takes effect.\u201d<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>Brown dubbed the law a \u201cblatantly unconstitutional restriction on free expression that erodes the long-standing and protected practice of\u00a0curating content based on user preferences, which book stores, TV networks and streaming services all use.\u201d<\/p>\n<p>It\u2019s a near-guarantee that the companies will take their arguments through appeals if they\u2019re stymied in court.
