{"id":69630,"date":"2025-11-25T20:18:07","date_gmt":"2025-11-25T20:18:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ca\/69630\/"},"modified":"2025-11-25T20:18:07","modified_gmt":"2025-11-25T20:18:07","slug":"oakland-police-again-dinged-by-federal-official-for-investigating-misconduct-too-slowly-times-herald-online","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ca\/69630\/","title":{"rendered":"Oakland police again dinged by federal official for investigating misconduct too slowly \u2013 Times Herald Online"},"content":{"rendered":"<p>OAKLAND \u2014 The city\u2019s police department is no closer to ending two decades of direct oversight by a federal judge, having <a href=\"https:\/\/www.mercurynews.com\/2025\/07\/03\/oakland-police-federal-oversight-complaint\/\" target=\"_blank\" rel=\"noopener nofollow\">failed once again to investigate<\/a> enough complaints against officers within a timeframe set by the court.<\/p>\n<p>Between January and March of this year, the Oakland Police Department\u2019s internal affairs unit finished\u00a0vetting just 65% of the most serious complaints within six months \u2014 far short of a required 85% threshold.<\/p>\n<p>This marks another backslide for OPD, which in an earlier reported period fell short on just one investigation of such allegations. This time around, OPD\u2019s internal affairs missed the mark on 19 occasions.<\/p>\n<p>It is a key task that U.S. District Court Judge William Orrick expects OPD to complete before he <a href=\"https:\/\/www.eastbaytimes.com\/2024\/09\/04\/oakland-police-detectives-felony-bribery-scandal-further-threatens-departments-local-control\/\" target=\"_blank\" rel=\"noopener nofollow\">brings an end to court oversight<\/a>, where the department has remained ever since a brutality scandal at the start of the century.<\/p>\n<p>OPD has been plagued by other controversies in the ensuing years, as well as high turnover. Chief Floyd Mitchell\u2019s resignation in October will again <a href=\"https:\/\/www.eastbaytimes.com\/2025\/11\/14\/oakland-interim-police-chief-james-beere\/\" target=\"_blank\" rel=\"noopener nofollow\">leave the department without a permanent leader<\/a>.\u00a0His last official day is Dec. 5.<\/p>\n<p>The latest report by federal monitor Robert Warshaw may signal that oversight is here to stay beyond OPD\u2019s next court hearing in January.<\/p>\n<p>Achieving timely internal affairs investigations of officers is one of 52 court-ordered reform tasks the department was required to fulfill as part of a 2003 negotiated settlement following the Riders scandal.<\/p>\n<p>The department remains out of compliance with another task that deals more broadly with OPD\u2019s handling of IA investigations as a whole. (Ray Chavez\/Bay Area News Group)<\/p>\n<p>\u201cWe are confident that, under Mayor Lee\u2019s leadership, the Department will fulfill and surpass its obligations to the communities it serves,\u201d Warshaw\u2019s new report notes.<\/p>\n<p>OPD\u2019s regression in investigating complaints quickly is a fairly recent development. The department had previously been in compliance with the \u201ctimeliness\u201d task for years.<\/p>\n<p>And the city\u2019s police trended backward from Warshaw\u2019s last report in another category, which involves a less serious level of misconduct. The department investigated 87% of these claims within the required six-month timeframe, down from 91% in the previous reporting period, according to the report.<\/p>\n<p>Warshaw also determined OPD is out of step in how it investigates complaints in the first place \u2014 a longstanding criticism of the department across various misconduct scandals over the years.<\/p>\n<p>For this task, the monitoring team offers less precise language, only alluding cryptically to a \u201cnumber of issues, concerns, and developments which are not yet appropriate for public discussion.\u201d<\/p>\n<p>Jim Chanin, an attorney for the plaintiffs in the Riders brutality case that first led to OPD\u2019s federal oversight, speculated that Warshaw is awaiting the outcome of a felony case against homicide detective Phong Tran, who has been placed on leave.<\/p>\n<p>Allegations that Tran bribed a witness have <a href=\"https:\/\/www.eastbaytimes.com\/2025\/09\/06\/oakland-detective-under-fire-used-racial-threats-on-murder-suspect-attorney-claims\/\" target=\"_blank\" rel=\"noopener nofollow\">jeopardized a series of murder cases<\/a> in Oakland, led several <a href=\"https:\/\/www.mercurynews.com\/2024\/04\/10\/high-ranking-oakland-cops-including-deputy-chief-face-serious-discipline-for-allegedly-botching-investigation\/\" target=\"_blank\" rel=\"noopener nofollow\">high-ranking police leaders to be disciplined<\/a>\u00a0and <a href=\"https:\/\/www.eastbaytimes.com\/2024\/09\/04\/oakland-police-detectives-felony-bribery-scandal-further-threatens-departments-local-control\/\" target=\"_blank\" rel=\"noopener nofollow\">leveled a blow to OPD\u2019s timeline<\/a> for exiting oversight.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"lazyautosizes lazyload\" alt=\"Oakland homicide investigator Phong Tran, right, leaves the scene where a headless, armless and legless decomposed torso was found on the rocks along Burma Road in West Oakland, Calif., on Wednesday, May 25, 2016. (Jane Tyska\/Bay Area News Group)<\/p>\n<p>\u201cThey need time to judge if internal affairs has really corrected itself,\u201d Chanin said in an interview of the Tran fallout and Warshaw\u2019s response to it.<\/p>\n<p>The court may also need time to vet the performance of OPD under a new chief following Mitchell\u2019s announced departure.<\/p>\n<p>Earlier this month, Lee named Assistant Chief James Beere, an veteran of the department, as the interim chief. He will likely appear before the judge at the next hearing in January.<\/p>\n<p>Lee also announced that Assistant City Administrator Michelle Phillips would serve in a new role that assesses OPD\u2019s systems of internal accountability.<\/p>\n<p>The specifics of what Phillips \u2014 the city\u2019s former inspector general \u2014 will actually do in the role are not fully clear.<\/p>\n<p>And it is still nebulous if the internal affairs unit will be absorbed by the investigative arm of the civilian Oakland Police Commission, which represents yet another arm of outside accountability for the department.<\/p>\n<p>\u201cI\u2019m really not sure if that\u2019s actually happening,\u201d Sgt.
